The attached file for the subject incident has been submitted for Recommendation for State Lead
Cleanup. I have reviewed the submittal, and it appears to be eligible for State Lead.
Comments:
Two 10,000 gallon gasoline USTs and one 550 gallon kerosene UST were removed in June
2005. The USTs had been installed in 1976. Mr. Gary Hodges was the owner of the USTs. A
20 Day Report and Tank Closure Report were submitted in 2005 and a Phase II LSA was
submitted in February 2006. The STF deductible has been met and Mr. Hodges has received reimbursement from the TF. Mr. Hodges had been dba Piedmont Tobacco Equipment Company,
Inc. but he owned the USTs personally. Piedmont Tobacco Equipment Co. has been dissolved.
Mr. Hodges has claimed financial inability to proceed with additional work at the site. Leann
checked on Lexis Nexis and found that Mr. Hodges had filed bankruptcy and that he has seven
civil actions filed against him for failure to pay money that he owes to other people and
businesses.
Submitting to state lead as RP is bankrupt.
