(Trigon) has completed our review of public information records, interviews, and site reconnaissance of the SOUTHBank Building property located at 400 West Main Street in Durham, North Carolina. This executive summary is provided for convenience and should not substitute for review of the complete report, including all appendices. 1.1 SITE The site is located in downtown Durham at 400 West Main Street in Durham, North Carolina. The site contains a seven -story building used primarily as a bank on the first floor and offices on the remaining floors. A parking deck is located in the basement of the building along with a maintenance room. The site was developed in the late 1800's and has contained residential dwellings, city shops, furniture stores, a filling station, and the current bank and office building. Underground storage tanks (USTs) were previously located on -site and associated with the filling station. A Preliminary Environmental Site Assessment and Soil Sampling investigation was performed at the site in 1994. Seven soil samples were collected in the northwestern, northeastern, and southeastern corners of the site where the USTs would have likely been located. No petroleum contaminants were detected in the soil samples collected. At the time of our site reconnaissance, the site contained two structures that included a seven -story building with a sub -terrain parking deck and a parking attendant gate house. The interior of the larger building had a bank which was located on the first floor and vacant and occupied offices on the remaining floors. The occupied spaces were used as offices and for furniture storage for the bank. A maintenance room was located on the basement level with the parking deck. Drive -up teller stalls and a transformer vault were located on the east side of the building. Parking areas were located to the north, east, south, and west of the building. Page 1 Mr. Joe Lemanski, Greenfire Development June 15, 2007 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 1.2 SURROUNDING PROPERTIES The site is bound to the north by West Morgan Street and further north by Great Jones Street (loop), RBC Centura, and a parking deck; to the east by Morris Street and further east by the Durham Arts Council, and commercial shops; to the south by West Main Street and further south by West Chapel Hill Street, and commercial shops; and to the west by Great Jones Street, West Main Street, and commercial shops. 1.3 CONCLUSIONS Trigon performed a Phase I Environmental Site Assessment in general conformance with the scope and limitations of ASTM Practice E 1527-05 of the SOUTHBank Building property located at 400 West Main Street in Durham, North Carolina. Any exceptions to, or deletions from, this practice are described in Section 2.5 of this report. This assessment has revealed no evidence of recognized environmental conditions (RECs) in connection with the property. 2.0 INTRODUCTION 2.1 PURPOSE The purpose of this Phase I Environmental Site Assessment (ESA) is to identify, to the extent feasible pursuant to the processes described herein, recognized environmental conditions (RECs) relative to the site. For the purpose of this report, a REC is defined as the presence or likely presence of any hazardous substance or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. 2.2 DETAILED SCOPE OF SERVICES The Phase I ESA was performed in general accordance with ASTM E 1527-05, "Standard Practice for Environmental Site Assessment: Phase I Environmental Site Assessment Process". Page 2 Mr. Joe Lemanski, Greenfire Development June 15, 200' 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 The Phase I ESA included a site walkover and review of the property for indications of recognizable environmental conditions including but not limited to transformers, distressed vegetation, on -site chemical and/or drum storage, and above and underground storage tanks. The historical land use of the site and its surroundings was established through the evaluation of various historical sources of information such as aerial photographs, Sanborn Maps, City Directories, and zoning maps. Persons knowledgeable about the site and surrounding area were interviewed. Environmental records included in various governmental databases were reviewed for the site and surrounding area to determine the potential impact from solid waste disposal, hazardous waste activity, underground storage tank releases, chemical spills, and other waste release occurrences. These data were compiled through a review of documents available from Durham County, the City of Durham, the United States Environmental Protection Agency (USEPA), various Departments of the North Carolina Department of Environment and Natural Resources (NCDENR), and by a database search of the site and surrounding areas within a one -mile radius of the site by Environmental Data Resources, Inc. (EDR). The search by EDR included review of database files maintained by NCDENR and the USEPA and the Sanborn Library, LLC (Sanborn Maps) database. The scope of services did not include surveys for asbestos, radon, lead -based paint, mold, lead in drinking water, wetlands, regulatory compliance, cultural and historic resources, industrial hygiene, health and safety, ecological resources, endangered species/critical habitats, indoor air quality, high voltage power lines, or urea formaldehyde. 2.3 SPECIAL TERMS AND CONDITIONS Refer to Trigon Proposal No. 042-07-068-P for Terms and Conditions. 2.4 USER RELIANCE This report is intended solely for the use of Greenfire Development, their agents, and consultants and is not to be relied upon by or transmitted to other parties without the expressed written consent of the aforementioned parties. The information provided herein is relevant to the dates of our site work and document review and should not be relied upon to represent conditions at future dates. Much of the information provided in this report is based upon personal interviews and review of available public documents, records, and maps held by government and private agencies. This report is subject to the limitations of historical documentation, availability and accuracy of pertinent records, and the personal recollection of those persons contacted. The Phase I ESA is not intended to be an environmental audit or address compliance -related issues. Information not found or missing is considered a data gap and is addressed in Section 8.0. 3.0 SITE DESCRIPTION 3.1 SITE OWNERSHIP According to the Durham County website and Mr. Macon Perry with Greenfire Development (Appendix A), the site is currently owned by SOUTHBank. Information regarding previous ownership of the site was not provided to Trigon. 3.2 SITE LOCATION AND VICINITY CHARACTERISTICS The site is located at 400 West Main Street in Durham, North Carolina (Figures 1 and 2). The site which has a Tax Pin No. 0821-08-88-2076 and a Parcel -ID No. 103105 (Figure 3) is surrounded by commercial businesses and shops. The site is bound to the north by West Morgan Street and further north by Great Jones Street (loop), RBC Centura, and a parking deck; to the east by Morris Street and further east by the Durham Arts Council, and commercial shops; to the south by West Main Street and further south by West Chapel Hill Street, and commercial shops; and to the west by Great Jones Street, West Main Street, and commercial shops. The main tenants include SOUTHBank and several legal firms. According to Ms. Amy Wolfe with the City of Durham Planning and Zoning, the site is zoned "CBD" which is defined as "Central Business District". 3.4 DESCRIPTIONS OF STRUCTURES, ROADS, AND OTHER IMPROVEMENTS ON THE SITE At the time of our site reconnaissance, the site contained two structures that included a seven -story 65,000 square foot building with a sub -terrain parking deck and a parking attendant gate house. The a interior of the building had a bank which was located on the first floor and vacant and occupied offices on the remaining floors. A maintenance room was located on the basement level with the parking deck. Drive -up teller stalls and a transformer vault were located on the east side of the building. Parking areas were located to the north, east, south, and west of the building. Access to the site was provided by Morris Street, located east and adjacent to the site. 3.4.1 Site Utilities Electrical service is reportedly provided to the site by Duke Energy. The on -site structures are heated and cooled with electric units located in the basement and on the roof. Mr. Steve Andrews, Facility Manager 1 of the building, reported that battery backup is provided to ran lights for exiting the building if a power failure should occur. No other emergency power is located on -site. 3.4.2 Water and Sewer Services Water and sewer services are reportedly provided to the site by the City of Durham. 3.4.3 On -Site Water Supply Wells No water supply wells were observed on the site at the time of our reconnaissance, or discovered to have been historically associated with the site. Page 5 Mr. Joe Lemanski, Greenfire Development June 15, 2007 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 3.4.4 Septic Tanks and Leach Fields No indications of septic tanks and/or leach fields were observed on the site at the time of our reconnaissance, or discovered to have been historically associated with the site. 4.0 INFORMATION REPORTED BY USER Per ASTM 1527-05, the user of the report is to help identify the possibility of recognized environmental conditions in connection with the site. To assist the user in providing this information, ASTM developed a questionnaire for the user to complete. A copy of the User Questionnaire completed by Mr. Joe Lemanski with Greenfire Development is included in Appendix B. 4.1 ENVIRONMENTAL LIENS FILED AGAINST THE SITE Mr. Lemanski was not aware of any environmental liens filed against the site. 4.2 SPECIALIZED KNOWLEDGE OR EXPERIENCE ABOUT THE SITE Mr. Lemanski did not have any specialized knowledge concerning the subject site. 4.3 ACTIVITY AND LAND USE LIMITATIONS ON THE SITE Mr. Lemanski was not aware of any activity and use limitations (AULs) regarding the subject site. A deed search for AULs was performed and is discussed in Section 5.20. 4.4 COMMONLY KNOWN ENVIRONMENTAL INFORMATION ABOUT THE SITE Mr. Lemanski reported that a previous site assessment and sampling was performed at the site. Mr. Perry provided a copy of the previous Phase I ESA that was completed on January 24, 1994 by Law Engineering along with follow-up sampling at the site. The sampling was conducted to determine if the historic use of petroleum products on the site (old gasoline station) had impacted the soil. TNGONENGINEEILM CONSULTANTS, INC. Page 6 Mr. Joe Lemanski, Greenfrre Development June 15, 2007 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 4.5 RELATIONSHIP OF THE PURCHASE PRICE TO THE FAIR MARKET VALUE OF THE SITE Mr. Lemanski indicated that the purchase price being paid for the property reflected the fair market value of the property. 4.6 OBVIOUS PRESENCE OF LIKELY CONTAMINATION AT THE SITE Mr. Lemanski was not aware of any obvious indicators that would point to the likely presence of contamination at the property. 5.0 RECORDS REVIEW 5.1 STANDARD FEDERAL AND STATE ENVIRONMENTAL RECORD SOURCES Environmental and regulatory agencies of the State of North Carolina, Durham County, and the City of Durham were contacted to determine if environmental problems were known to exist or have formerly existed at the site. The following issues were addressed: • Groundwater and Soil Contamination • Solid Waste Disposal • Hazardous Waste • Underground Storage Tanks Federal (EPA) and state databases available from Environmental Data Resources (EDR) were also reviewed. EDR is a national company specializing in the management of more than 150 state and federal databases. EDR updates ASTM-suggested databases according to ASTM Standard E 1527-05. The most recent database update is shown in the EDR report. The following federal and state databases obtained from EDR were reviewed according to the zip codes occurring within a one -mile radius of the subject site and are included in Appendix C. No adjacent properties were identified as generators of hazardous waste. No TSD listings were identified on or within 0.5 miles of the site. 5.7 EMERGENCY RESPONSE NOTIFICATION SYSTEM The site was not listed on the ERNS list. 5.8 CORRECTIVE ACTION REPORT No CORRACTS listings were identified on or within 1.0 mile of the site. 5.9 LEAKING UNDERGROUND STORAGE TANKS No LUST listings were identified for the site. Sixty LUST listings were identified for properties within 0.5 miles of the site and are summarized below. 5.9.1 "Open" Incidents An "Open" incident indicates a release of hazardous materials to the soil and/or groundwater that has not been addressed to the satisfaction of NCDENR. Information regarding the historical uses of the site was obtained from a review of the 1999 aerial photograph (Figure 4), a previous Preliminary ESA of the site dated January 25, 1994, a recent conversation with Mr. Steve Andrews and Ms. Paula Davis of SOUTHBank (Appendix A), and from a review of City Directories and Sanborn Fire Insurance Maps, if available. 5.18.1 Aerial Photographs Based on a review of the 1999 aerial photograph, the existing building was shown in the southwestern portion of the site. Parking areas were shown to the east, north, west, and southeast of the building. 5.18.2 City Directories City Directories were available for the site between 1964 and 2007. Tenants of the building have included, One Hour Martinizing, First Federal Savings and Loan, SOUTHBank, Bentley and Associates, C Marts of the Carolinas, Convenience USA, Durham Companions, Express Stores, Holiday Markets of Georgia, Kevric Company, Sharon Thompson Law Firm, YMCA of Durham, Jean Wilson Attorney At Law, Senior Center Campaign, Injury and Accident Law Firm, Focus Productions, Culley and Calhoun, and Bio Match. The 1888 Sanborn Map shows the site with several buildings labeled as a tobacco company, car stables, a boarding house, and a shoe shop. Morgan Street does not loop around the northwestern portion of the site as it does today. Great Jones is shown bordering the northwestern portion of the site. Cooper Shop and an unidentified smaller building are shown on -site on the 1893 Sanborn Map. The small structure shown in the 1893 Sanborn Map is shown and labeled in the 1989 Sanborn Map as O'Hara Soap Chemical Warehouse. The 1902 Sanborn Map shows seven dwellings along the western and eastern portions of the site and a church in the northeastern corner of the site. The 1907 Sanborn Map shows a livery and carriage building in the southwestern portion of the site and a bicycle repair shop in the southern portion of the site. The 1913 Sanborn Map shows a garage in the western portion of the site. The 1937 Sanborn Map shows an auto repair shop, a bake house, a restaurant, a Salvation Army Hall, and a furniture repair building. A filling station with a repair shop is shown in the northeastern portion of the site where the church had been previously located. The 1950 Sanborn Map shows several furniture businesses on the site, a beauty ry school, and the filling station. There appears to be four tanks located north of the filling station. The 1979 Sanborn Map shows a structure in the central portion of the site with a drive-in teller on the east .J side. This structure is located where the current building is and appears to be the same building. West Loop is shown along the northwestern side of the site in the 1979 Sanborn Map. 5.19 HISTORICAL USES OF PROPERTIES ADJACENT TO THE SITE Information regarding the historical uses of properties adjacent to the site was obtained from a review of the 1999 aerial photograph and from review of City Directories and Sanborn Fire Insurance Maps. 5.19.1 Aerial Photographs Based on a review of the 1999 aerial photograph, the adjacent properties to the site were developed with a variety of different commercial buildings. Tenants in the office buildings around the site have included various commercial and retail shops, loan companies, and 0 attorney offices. A copy of the City Directories is included in Appendix D. 5.19.3 Sanborn Maps Sanborn Maps were available for the adjacent properties between 1888 and 1979 (Appendix E). The 1893 and 1888 Sanborn Maps show adjacent properties to the north, south, and west as dwellings and tobacco warehouses. The east and adjacent properties are not shown in these Sanborn Maps. The 1898 Sanborn Map shows a tobacco warehouse, dwellings, and a boarding house to the east and south of the site. The north, west, and adjacent properties are not shown in the 1898 to 1979 Sanborn Maps. The 1902 Sanborn Map shows a marble works business to the south of the site. The 1907 Sanborn Map shows a garage and bicycle shop south and adjacent to the site. One of the parcels is labeled as "a gasoline UST to be buried here" on the lot. City High School is shown east and adjacent to the site where a tobacco warehouse was located. The 1913 Sanborn Map shows two parcels located south and adjacent to the site as granite storage and "drugs". The 1937 and 1950 Sanborn Maps show the south and adjacent parcels as being occupied by two filling stations and with tanks. The 1979 Sanborn Map does not show the filling stations south and adjacent to the site. Offices are shown south and adjacent to the site. 5.20 ACTIVITY AND USE LIMITATIONS Greenfire Development had Kennon, Craver, Belo, Craig, and McKee, PLLC (Kennon Craver) perform a title and deed search to identify whether activity and use limitations (AULs) as described in 40 CFR 312 are associated with the site. No AULs were identified by Kennon Craver. A copy of the letter provided by Kennon Craver is included in Appendix F. TRIGON ENGINEENNG CONSULTANTS, INC. Page 17 Mr. Joe Lemanski, Greenfire Development June 15, 2007 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 6.0 SITE RECONNAISSANCE 6.1 SITE LIMITING CONDITIONS AND METHODOLOGY USED The site reconnaissance was performed on June 11, 2007 by Ms. Tina M. Stewart of Trigon. The methodology used to observe the site included walking the site within and along the boundaries. Site boundaries were determined in the field using an aerial photograph and conversations with Mr. Macon Perry with Greenfire Development (Appendix A). Site limitations to visual observations included areas beneath the structure, concrete parking lots, parked automobiles, and locked rooms in the basement parking deck. Access to the bank and some of the vacant spaces on each floor were provided. The maintenance room located in the basement parking deck was locked and was not accessible at the time of our site visit. A vehicle reconnaissance of the surrounding community was conducted by driving streets and public thoroughfares in the vicinity of the subject site. 6.2 GENERAL SITE DESCRIPTION At the time of our site reconnaissance, the site contained two structures that included a seven -story building with sub -terrain parking deck (Appendix G: Photographs 1, 2, and 3) and a parking attendant gate house. The interior of the building contained a bank which was located on the first floor and vacant and occupied offices on the remaining floors (Photograph 4). The occupied spaces were used as offices and for furniture storage for the bank. A maintenance room was located on the basement level with the parking deck. Drive -up teller stalls and a transformer vault were located on the east side of the building. Parking areas were located to the north, east, south, and west of the building. 6.3 HAZARDOUS/CHEMICAL SUBSTANCES IN CONNECTION WITH IDENTIFIED USES At the time of our reconnaissance, three one -gallon containers of latex paint were observed in one of the vacant spaces on the fifth floor. No staining was observed around these containers. Access to the maintenance room was not provided because it was locked and Mr. Steve Andrews, Facility Manager of the building, was out of town. Mr. Andrews reported that minimal amounts and types of chemicals are TRIGON ENGINEERING CONSULTANTS, INC. He believed 100 pounds of Freon and four containers of latex paint were stored in the room. 6.4 ABOVEGROUND STORAGE TANK/UNDERGROUND STORAGE TANK SYSTEMS AND PIPELINES No aboveground storage tanks (ASTs) or indications of underground storage tanks (USTs), such as vent lines or fill ports, were observed during our site reconnaissance. However, based on a review of Sanborn Maps and a previous Phase I ESA performed in 1994, it appears that USTs and/or ASTs were previously located on -site when the filling station was on -site. 6.5 TRANSFORMERS AND INDICATIONS OF POLYCHLORINATED BIPHENYLS (PCBS) A pad -mounted transformer is reportedly located on each floor of the building and a transformer vault is located on the east side of the building where the drive -up teller stalls are located. Mr. Andrews was not aware of any spills or leaks associated with the transformers. 6.6 INDICATIONS OF SOLID WASTE DISPOSAL A solid waste dumpster was observed on the northwest side of the building. No visual evidence of buried solid waste was observed on -site. 6.7 VEGETATION Vegetation on -site consisted of landscaping around the building and perimeter of the site. No stained soil or distressed vegetation was noted on the day of the inspection. 6.8 FILL AND/OR EXCAVATED SOIL No visual evidence of fill or excavated soil was observed on the site at the time of our reconnaissance. Page 19 Mr. Joe Lemanski, Greenfire Development June 15, 2007 400 West Main Street, Durham, North Carohna Trigon Project No. 042-07-056 6.9 PONDS AND STREAMS No ponds or streams were observed on the site. 6.10 PHYSICAL SETTING ANALYSIS 6.10.1 Topography According to the 1973 (Photorevised 1987) USGS Topographic Maps, Northwest and Southwest Quadrangles (Figure 5), the site historically was relatively flat and had a topographical high elevation of approximately 400 feet. 6.10.2 Surface and Groundwater Flow Directions Surface and groundwater flow were not determined. In general, both surface and groundwater flow directions are controlled by the contours of land forms in the Piedmont with the flow occurring perpendicular to the contours from high to low elevations. Surface water flow and presumably groundwater flow across the site are therefore generally to the northeast. 6.10.3 Floodplain Information According to the Flood Insurance Rate Map (FIRM) Community Panel No. 3720082 100J, effective date May 2, 2006, the site is located within Zone X which is defined as "areas determined to be outside the 0.2% annual chance and future conditions 1% annual chance floodplain". 6.10.4 Surficial and Bedrock Geology The site is located in the Triassic Sanford -Durham Sub -Basins Physiographic Province of North Carolina. The surrounding topography consists of rolling land and broad ridges. According to the Geologic Map of North Carolina, the regional bedrock generally consists of the Chatham Group with tan medium -to very coarse -grained, micaceous arkosic sandstone (Brown and others, 1985). Page 20 Mr. Joe Lemanski, Greenfire Development June 15, 2007 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 7.0 INTERVIEWS 7.1 INTERVIEW WITH OWNER AND/OR MANAGER Based on a conversation with Ms. Paula Davis with SOUTHBank, the building has been used primarily as a bank and office space. According to Mr. Steve Andrews with the SOUTHBank Building, the building has been used as an office building since it was built. Mr. Andrews has been the Facilities Manger of the building for 16 years and is also employed by SOUTHBank. Mr. Andrews reported that a dry cleaner was located in the building prior to his employment but was a drop off point. No dry cleaning was performed at the site that he was aware of. 7.2 INFORMATION FROM PREVIOUS REPORTS Based on a review of the January 25, 1994 Preliminary Environmental Site Assessment (ESA) performed by Law Engineering on the subject site (Appendix H), the current building was originally built in 1973 (first two floors). The additional five floors were constructed as tenant spaces were leased. First Federal Bank occupied the first two floors when they were built. Prior to the current structure being built, the site reportedly was developed with several retail shops that included a tire store, a furniture store, a restaurant, a grocery store, and parking lots. A kerosene (heating oil) spill was reported to have occurred at the site prior to 1973. During the site visit in 1994 for the preliminary ESA, a maintenance room and boiler room was observed in the central portion of the basement parking deck. Chemicals observed in the maintenance and boiler rooms included pesticides, insect poisons, and solvents/cleaners. Several 55-gallon drums of boiler (electric) chemicals were also observed in this room. Subsequent to the 1994 Preliminary ESA, soil samples were collected to address concerns that a filling station with USTs had been located on -site. Seven soil borings were advanced in May 1994 in the northwestern corner of the site (B-1 and B-2), the northeastern comer of the site (B-3, B-4, and B-5), and the southeastern corner of the site (B-6 and B-7). The samples were collected and analyzed for semi- volatiles and volatile total petroleum hydrocarbons (TPH) from depths ranging from 8.5 to 10 feet to 28.5 TNIGONENGINEENMG CONSULTANTS, INC. No petroleum odors were reported for any of the seven samples collected. The laboratory results did not reportedly exhibit detectable concentrations of TPH. Law concluded that no further environmental assessment was warranted at that time. 7.3 INTERVIEW WITH LOCAL GOVERNMENT OFFICIALS Based on a conversation with personnel in the Durham County and City of Durham Building Inspections Department, Tax Department, and Planning and Zoning Department, they were not aware of any additional information available regarding historical information about the site. 8.0 DATA GAPS Sanborn Maps of the site dating back to 1888 were available for review. Historic information back to first development beyond 1888 were not readily accessible or ascertainable. However, Trigon does not believe this data gap affects the environmental professional's understanding of recognized environmental concerns in connection with the property. 9.0 FINDINGS Trigon has found the following known or suspect recognized environmental conditions: • Former use of the site as a filling station; • Former existence of at least four USTs on -site associated with the filling station; • Maintenance and boiler room located in basement parking deck of the building; • A number of properties identified on several environmental databases within 1.0 mile of the site described in Section 5.0. Page 22 Mr. Joe Lemanski, Greenfire Development June 15, 2007 400 West Main Street, Durham, North Carolina Trigon Project No. 042-07-056 10.0 OPINIONS Based on the findings described in Section 9.0, Trigon has the following opinion(s) on their impact on J the property: • Based on a review of Sanborn Maps and the 1994 Preliminary ESA, a filling station was previously located on -site. At least four USTs appear to have been located on -site and associated with the filling station. No documentation was discovered to suggest the USTs were removed; however, based on the redevelopment of the site in 1973 the USTs were likely removed during grading activities. Soil sampling was performed in 1994 in the general areas where USTs may have been located. Since no petroleum contaminants were detected in the soil samples collected, Trigon does not consider the USTs an environmental concern. • A maintenance shop and boiler room were located in the basement/parking deck of the building. The room was locked during Trigon's site visit and could not be accessed. Mr. Andrews reported that only Freon and latex paint were stored in the room. Assuming Mr. Andrews knowledge of what was stored in the room is correct, Trigon does not consider these items an environmental concern. • Although several off -site incidents were identified within 1.0 mile of the site, these incidents are either closed, down gradient, or a sufficient distance from the site to not be an environmental concern at this time. .J 1 R 11.0 CONCLUSIONS .J Trigon performed a Phase I Environmental Site Assessment in general conformance with the scope and limitations of ASTM Practice E 1527-05 of the SOUTHBank Building property located at 400 West Main Street in Durham, North Carolina. Any exceptions to, or deletions from, this practice are described in Section 2.5 of this report.
