STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: NONE. OBSERVED DEFIECENCIES: 15A NCAC 13B .0839(a) requires, in part, that (a) Each permit holder shall maintain a log which includes at least the following information for each septage pumping event: (1) The date, type, quantity, and location of septage pumped; (2) Location of the discharge of the septage. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Ray's has failed to consistently maintain the required records by not recording the all of the following required information for each septage load: 1. Date that each instance of pumping (either collection or discharge) septage occurred, and 2. Type of septage material (e.g. septage grease; household septage; etc.) that was pumped (either collection or discharge), and 3. The quantity of septage amount, in gallons, that was pumped (either collection or discharge), and 4. The location where the septage was discharged. To achieve compliance with all of the requirements in rules 15A NCAC 13B .0839(a) by January 19, 2015 Ray's must complete the following: For every load of septage that this facility receives, Ray's must record and maintain the following information: 1. Date that each instance of pumping (either collection or discharge) septage occurred, and 2. Type of septage material (e.g. septage grease; household septage; etc.) that was pumped (either collection or discharge), and 3. The quantity of septage amount, in gallons, that was pumped (either collection or discharge), and 4. The location where the septage was discharged. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Inspection done to investigate a complaint concerning the possible unauthorized dumping of septage into the collection system of the City of Gastonia's waste water treatment system. 2. Courtney Barnett and Robbie Ray, from Ray's, were on site to provide access to the septage firm's records. 3. Ray's also operates a permitted Septage Detention & Treatment facility (SDTF-36-12) which consists of two above ground septage detention tanks: (1) 5,000-gallon and (1) 10,000-gallon. 4. Ray's Septage Management Firm is permitted to collect septage wastes from Catawba, Cleveland, Gaston, Iredell, Lincoln, and Mecklenburg counties in NC. 5. Septage from these pumper four trucks is approved for final disposal at only the following facilities: • A Sani-Can Service Inc. (SDTF-55-20) — Denver, NC • Clark Creek Waste Water Treatment Plant (WWTP) — Newton, NC • Clover WWTP — Clover, SC • Manhole behind the Food Lion at 3123 Dallas High Shoals Rd. (Town of Dallas WWTP collection system) — Dallas, NC 0 Carolinas Resource Recovery (SDTF-34-05) — Charlotte, NC FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 7. A review of the records for Ray's Septage Management Firm (NCS-00888) found that grease-septage had been collected eight times between 10/07/14 and 11/24/14. (Table 1) Mr. Ray stated that collections of grease-septage are routinely taken (within 24-hours of collection) directly to Carolinas Resource Recovery's (CRR) facility (SDTF-60-08) for final disposal. 8. Records also showed that the 1,942-gallons septage from the SDTF tanks was taken to Carolinas Resource Recovery's (CRR) facility (SDTF-60-08) in Charlotte, NC for final disposal on September 18, 2014. Mr. Wagner provided Ray's Septage Management Firm with a modified copy of the Section's "SEPTAGE PUMPER LOG" for their use to ensure that each of Ray's pumper trucks consistently maintains the required records. 10. This inspection did not find any evidence to substantiate the allegation the Ray's Septage Management Firm has done any unauthorized dumping of septage into the collection system of the City of Gastonia's waste water treatment system.
