HomeMy WebLinkAbout26077_Pattons Facility_Residential Reuse Letter 20230403 April 3, 2023 Sent Via E-mail Adam Gooch KA 3119 South Property Owner LLC 601 Thirteenth Street NW, Suite 300 North Washington, DC 20005 agooch@akridge.com Subject: High Density Residential Redevelopment Pattons Facility Brownfields Property 3119, 3127, 3201, 3205, 3207, 3209, and 3215 South Boulevard and 3232-3234 Weston Street Charlotte, Mecklenburg County Brownfields Project Number 26077-22-060 Dear Mr. Gooch: The North Carolina Department of Environmental Quality Brownfields Redevelopment Section (DEQ Brownfields) issued a Letter of Eligibility (LOE) dated January 12, 2023, for the above referenced Brownfields Property. DEQ Brownfields has reviewed the assessment data included in the November 2022 Brownfields Property Application (BPA) and additional information submitted by Hart & Hickman, PC on March 13, 2023. On March 27, 2023, a virtual kick-off meeting was held with the development team and DEQ Brownfields to discuss assessment to date and redevelopment plans. Based on the available data and our risk assessment of said data in conjunction with redevelopment plans, DEQ Brownfields has determined that the Pattons Facility Brownfields Property with the appropriate measures implemented and maintained may be utilized for the proposed plan of for rent only, high density residential apartments, associated amenities, retail, and parking. Please note that townhome use, including for-rent townhome style units, is not approved for the Brownfields Property. The existing data collected throughout the Brownfields Property were used in the current DEQ Risk Calculator (January 2023), and the hazard indices were determined to represent a potential residential exposure risk for sub-slab and exterior soil gas to indoor air. Therefore, the following land use and engineering controls will be required prior to the proposed high density residential use on the Brownfields Property and as part of the Brownfields Agreement: • A Vapor Intrusion Mitigation System (VIMS), approved by DEQ Brownfields in advance and in accordance with the most current version of the DEQ Brownfields VIMS Design Submittal Requirements, will be installed; Patton Facility April 3, 2023 Page 2 • Pre-occupancy and post-occupancy sub-slab soil gas and indoor air assessment in accordance with the most current version of the DWM Minimum Mitigation & Sampling Requirements for Reuse (February 2023);and • If Trichloroethylene (TCE) is detected in indoor air additional assessment and/or mitigation measures, will be required by DEQ Brownfields. Be advised that this approval from the DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications for demolitions, nor does it waive any requirement to comply with applicable law for such activities.
