The site was submitted to the State-Lead Program because the responsible party was not able to conduct the required assessment and/or cleanup. During a sampling event conducted on December 29, 2022, groundwater contamination was found above North Carolina Administrative Code (NCAC) 2L standards but below gross contamination levels. No receptors (wells or surface water) are located within 1000 feet of the source area. Based on this information, the UST Section finds it appropriate to classify the risk of the former discharge or release as low and that no further action is warranted for this incident. This determination shall apply unless the UST Section later determines that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. Due to the fact that the groundwater did not meet "unrestricted use" standards, meaning that contamination remains above the applicable standards, a notice of residual petroleum was placed on the deed (Book 3273 Page 52-54) on 3/13/2023 per N.C.G.S 143B-279.9 and 143B-279.11. This Notice states that no drinking water well may be installed on the property. Pursuant to 15A NCAC 2L .0407, you have a continuing obligation to notify the UST Section of any changes that you know of or should know of, that might affect the level of risk assigned to the discharge or release. Due to the fact that the “unrestricted use” standards were not met, we are required to notify the adjacent property owners, county health director, and local city or county manager. They have been copied on this letter simply as part of this requirement. This does not indicate any problem to their properties.
