HomeMy WebLinkAboutAS-780_9269_C_NFA_2030524_Underwood - Weld North Carolina Department of Environmental Quality | Division of Waste Management UST Section Central Office | 1646 Mail Service Center | Raleigh, NC 27699-1646 | (919) 707-8171 May 24, 2023 Mayland Community Collage 785 Cranberry Street Newland, NC 28657 Re: Notice of No Further Action 15A NCAC 2L .0407(e) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Former Underwood & Weld Inc 159 Old Vale Road Newland, Avery County, NC Incident Number 9269 Risk Classification: Low Ranking: Low Dear Mayland Community College: A review of information on file with the Underground Storage Tank (UST) Section, Division of Waste Management, Green Square Central Office indicates that soil contamination does exceed the soil screening levels established by the UST Section, however, the constituent specific groundwater contamination does not exceed the groundwater quality standards established in Title 15A NCAC 2L .0202. The USTs have been properly closed in place and are located within buildings and capped by up to five feet of concrete and are inaccessible. Groundwater sampling indicates that the remaining soil contamination has not migrated into the groundwater. The UST Section determines no further action is warranted for this incident. All required actions have been completed. As soil contamination exceeds the lower of the soil-to-groundwater or residential MSCCs, public notice in accordance with 15A NCAC 2L. 0409(b) has been completed. This determination shall apply unless the UST Section later finds that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. This No Further Action determination applies only to the subject incident; for any other incidents at the subject site, the responsible party must continue to address contamination as required.
