STATUS OF PERMIT:
The Original Yard Waste Notification was submitted to the Section on November 3, 1993. The most recent renewal was
received on June 27, 2016.
The YWN was identified to be located on top of the pre -regulatory landfill, Gaston Refuse Disposal (NONCD0000475).
PURPOSE OF SITE VISIT:
Compliance Inspection
NOTICE OF VIOLATIONS
None.
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1402 (g) (1)(D), "the facility shall not be located over a closed -out disposal site."
As identified in previous inspection reports, the facility is located on the top of the Pre -Regulatory Landfill
(PRLF) #NONCD0000475. A yard waste notification cannot be over a closed -out landfill, such as a PRLF.
All waste must be removed from the facility and the notification closed. Cease accepting waste and begin
removal of the waste. When removing the waste, do not disturb the soil cap of the PRLF. The cap will
need to be evaluated by the PRLF Group. Mr. Ryan Channell, PRLF Unit Supervisor, [phone],

another property, pending Section approval, in which to operate a yard waste notification.
B. 15A NCAC 13B .1406 (6)9 "A site shall only accept those solid wastes that it is permitted to receive,"
During this inspection, unacceptable wastes such as plastic sheeting, metal, and construction and
demolition (C&D) wastes were identified within the yard waste stockpiles. The unacceptable wastes must
be removed from the facility and properly disposed of at a permitted facility.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The facility is secured by a locking cable with fencing along Porch Drive.
2. A sign identifying the yard waste facility with a phone number was identified but obscured by overgrown vegetation.
15A NCAC 13B .1406 (9)(a) "Signs providing information on wastes that may be received, dumping
procedures, the hours during which the site is open for public use, and the permit number shall be posted at
the site entrance." and 15A NCAC 13B .1406 (9)(c) "Signs shall be posted stating that no hazardous waste,
asbestos containing wastes, or medical waste may be received at this site." Please post the appropriate signs at
the entrance to the site. Please remove the overgrown vegetation so that the current signage is visible.
3. No areas of standing water were observed, and the area was sloped to properly shed water.
4. Digital photographs were taken during the inspection.
5. Corrective actions are required as a result of this inspection report.
