Yard Waste Facility Notification application received by Solid Waste Section for the first time on November 18, 2019. Yard Waste Facility Notification expires on June 1st each year PURPOSE OF SITE VISIT:

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On May 26, 2023, Chuck Kirchner conducted a closure inspection of the David Blackwell Farm #2 YWN off Vaughn Road in Burlington, Alamance County. 1. The yard waste notification (YWN) was located at 1340 Vaughn Road in Burlington which is property owned by David Blackwell. 2. The site is a property owned by Mr. Blackwell and leaf debris was collected and composted to be used on his own property according to Mr. Blackwell.
3. Mr. Blackwell previously stated that this site has not been used since June 1, 2020. 4. No stockpile or composted material was observed on site during this inspection. 5. The designated area used for the YWN is less than 2 acres. 6. Good grass cover was observed at this site. 7. The Yard Waste Notification is closed at this time and inspections will cease at this site.
8. The Yard Waste Notification facility shall obtain a new YWN prior to small composting and/or mulching operations designed to repurpose yard waste into a soil addition or beneficial landscaping material. A small-scale facility can operate without the need for a full permit from the Division of Waste Management. While there is no permit required for operation, the DWM does require that a notification form detailing facility operations be submitted prior to beginning operations and annually
thereafter. In addition, Yard Waste Notification facilities must meet specified criteria. Facilities larger
than two acres in size must submit a permit application as required in 15A North Carolina Administrative Code 13B .1405.
