Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All photos were taken by Lee Hill on May 17, 2023. 2. The facility is open Monday through Saturday, 8:00am to 4:00pm. 3. The facility is secured by gates at both entrances and a portion of the facility is fenced to prevent unauthorized access. In areas where fencing has not been installed, topography serves to limit access as well. 4. Signs providing the hours of operation, the permit number and disposal procedures were observed at the scale house and the entrances to the facility. Operations Inspection of the MSWLF Unit (8807-MSWLF-1990) 5. The facility is currently filling in Phase 5. 6. The access roads were of all-weather construction and were being maintained at the time of inspection. 7. The side slopes of Phases 2 and 3 have been seeded, matted, vegetation is growing, and the facility plans on reseeding sparsely vegetated areas. The side slopes of Phases 4 and 5 have been seeded and matted, or mulch has been applied. No erosion issues were observed on the outer slopes of the landfill. 8. Windblown waste was minimal, well managed and confined to the cell at the time of inspection. 9. The facility was in the process of adding intermediate cover to Phase 6 at the time of inspection. Please ensure that all areas that are not going to have additional waste placed on them for 12 months have no less than one foot of intermediate cover. 10. The facility was in the process of adding a "fluff layer" on the southeastern corner of Phase 5. Construction and demolition waste and rigid materials were being segregated and placed in a separate fill area from household waste to prevent damage to the liner system. 11. Some of the edge of waste markers have been removed on the eastern side between Phases 4 and 5. Reinstall the markers so the limits of the cell can be easily identified. Operations Inspection of the Household Hazardous Waste (HHW) Collection Area 12. The facility is permitted to receive household hazardous waste (HHW) generated by homeowners and conditionally exempt generators in Transylvania County. Unacceptable HHW that shall not be collected at this facility includes radioactive waste, explosives, and infectious waste. 13. The HHW collection area is open Monday through Saturday, 8:00 am to 4:00 pm. Citizens place material on carts and facility staff sort and store the materials.
