OBSERVED VIOLATIONS:
No new violations observed

STATUS OF PAST NOTED VIOLATIONS:

A. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”

Attachment 3, Permit Condition 8 of the Permit to Operate issued March 25, 2014, states, “Excavation, grading
and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1).”

15A NCAC 13B .0565(3)(j) states “Proposed excavation, grading, and final contours at a minimum of five-foot
intervals. Where necessary, a smaller interval shall be utilized to clarify proposed grading. Excavation, grading,
and fill material side slopes shall not exceed three to one (3:1).”

Tommy Price, Inc. is in violation of 15A NCAC 13B .0203(d) and 15A NCAC 13B .0565(3)(j) by exceeding a 3:1 ratio
on the landfill slopes.

CORRECTIVE MEASURES IN PROGRESS: It was stated that the northeast slope of the landfill has been regraded to
a 3:1 ratio. This appeared to be correct from what was visible from the top of the landfill. Other slopes are to be
regraded or certified to be stable by a licensed engineer during the closure process.

B. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”

Attachment 3, Permit Condition 15 of the Permit to Operate issued March 25, 2014 states, “Within 120 calendar
days after completion of the final disposal operations, the disposal area must be closed and covered with a
minimum of 1 foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. However,
for ditches with depths greater than 6 inches and widths less than 3 feet located on the landfill, at least 2 feet of
soil is required between the bottom elevation of the ditches and the waste mass.”

15A NCAC 13B .0566(5) states: “120 calendar days after completion of any phase of disposal operations, or
upon revocation of a permit, the disposal area shall be covered with a minimum of one foot of suitable soil
cover sloped to allow surface water runoff in a controlled manner. The Division may require further action in
order to correct any condition which is or may be injurious to the public health, or a nuisance to the
community.”

Tommy Price, Inc. is in violation of 15A NCAC 13B .0203(d) and 15A NCAC 13B .0566(5) by failing to apply one foot
of suitable soil cover over areas that have remained inactive for a period of greater than 120 days.

CORRECTIVE MEASURES IN PROGRESS: Areas with exposed debris were observed during site visit. These areas
are to be covered with 1 foot of suitable soil during the closure process.

C. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”
Attachment 3, Permit Condition 16 of the Permit to Operate issued March 25, 2014 states, “All required
sedimentation and erosion control measures must be installed and maintained to mitigate excessive on-site
erosion and to prevent silt from leaving the site of the landfill unit during the service life of the facility.

CORRECTIVE MEASURES IN PROGRESS: The Permittee was previously cited in that vegetative cover
was inadequate in the prevention of erosion. Vegetation is still insufficient in some areas. Native grass is to be
established on all closed areas of the landfill during the closure process.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:

1. A site visit was conducted on 04/6/2023 to follow up on the status of closure.

2. Site visit summary in which the following was discussed and/or observed:

• Claire Osborn with NCDEQ- Solid Waste Section stated in an email sent on 6/23/2022 that she intended
to send an approval letter for closure. However, Mr. Price did get a verbal agreement from Claire Osborn
to start the closure process.

• The facility is no longer accepting waste and has started the closure process around December 2022.

• Final grading of about 2 acres on the Northeast side of property appears to be completed. Vegetation is
established on what appears to be a 3:1 slope. Mr. Price is awaiting final approval from their engineer to
show slopes stability.

• After the engineer verifies slopes stability Mr. Price intends to start regrading the next section.

• It was discussed with Mr. Price that after the completion of a section being regraded, he is to notify Claire
Osborn with NCDEQ and Rochelle Rattray with Mecklenburg County LUESA. A representative of one
or both agencies will visit site to verify compliance with agreed upon closure plan.
