The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell, with the Section, followed up on corrective actions at the YWN. Section staff met onsite with
new town manager Ms. Jane O’Neal and Derrick Edge. Temporary Disaster Debris Site, TDDS, DS78-035, is next to notification. Waste was previously taken into the area of the TDDS, and the Town of Red Springs was instructed to remove the waste. Waste has been removed from the two areas inside the debris site. The TDDS area is clean and grassed. YW is being windowed inside the notification. If not done so please submit 2023 YWN renewal form online. Renewal shall be submitted by June 1st of each year. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
3. The site was gated, and the gate was closed upon arrival. Mr. Powell walked from the road entrance into site to do inspection. Newer YW now has good row separation. EOW marker in place. Good job.

4. Previously, the older YW was mulched and windrowed into an area outside of the notification and where the disaster debris site (DS78-035) was designated. The waste has been removed. Good job. 5. EOW markers for extending the Yard Waste Notification into the Disaster Debris Site were partially in place. One was missing after Mr. Edge installed, so more permanent ones should be used. To extend the
YWN into the TDDS, a map and an operations plan on how the YWN will be operated regularly and if the site is activated during an emergency event. The plan needs to show how both will be utilized with waste kept separate. Once activated the emergency waste must be kept separate from regular weekly YW pickup. This map and plan should explain the management process of this site and be submitted within 30 days receipt of this inspection via email. The map should indicate the corners of the Notification, meet buffers and be under 2 acres, and mark the TDDS site that remains of what was previously approved. 6. It was understood onsite from discussion, that the waste in the YWN currently would be going to Robeson County landfill, and it was the plans of the town to keep and maintain a YWN but to start sending the weekly waste to the landfill instead of using the YWN. Currently, Robeson County has asked the town to wait to send more YW. Once available, the town plans to straight haul everything and slowly remove the waste in the
notification. Waste should be removed within a year of acceptance. 7. DS78-035 - In the event of a disaster, as with any Temporary Disaster Debris Site (TDDS), and you call or email to activate the debris site, be sure to the disaster debris separate from YW material. Any storm related waste, once site is activated during an emergency, will need to be separated from weekly YW collection.
