PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: Resolved OBSERVED VIOLATIONS: No new violations were observed during this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 - The land on which this Land Clearing and Inert Debris Landfill (LCID) is located, is owned by H.D. Newbern (Estate) and Finley S. Newbern and recorded in Book 401 page 46 of the Currituck Co. Register of Deeds. 02 - The Notification was recorded on July 24th, 1997 in Book 413 Page 825 of the Currituck County Register of Deeds. 03 - This was an unannounced Inspection. 04 - Site had a locking gate for security at the access point to the facility. The gate has been removed. 05 - Facility has a CLOSED sign where the locking gate was. 06 - The main road is kept in good condition. 07 - Four Wheelers are starting to cause ruts. Be sure to monitor the ruts in the road and the new areas where the four wheelers have been on the landfill. Need to Cover exposed waste, fill, grade and reseed if gets any worse. A vegetative cover MUST BE MANAGED. 08 - No new waste has been brought into this facility. 09 - Facility footprint is back to less than 2 acres as should be for a NOTIFIED LCID. 10 - The boundaries of the LCID were flagged by Elliott Consulting with grade stakes. Poles have been added. 11 - Facility has the 3:1 side slope completed on most of the landfill. All waste is now inside of the boundaries of the landfill. 12 - Be sure to maintain the vegetative cover with mowing to ensure inspections can be conducted on the total landfill including the toe of the side slopes. 13 - Be sure to meet the deadline of the CLOSURE of this facility which is documented in the letter that was sent to you along with the last inspection report. 14 - Digital pictures were taken with some attached to this report.
