ADDITIONAL COMMENTS
On May 11, 2023, Chuck Kirchner met with Matt Baskerville and Lee Cloer with Orange County Solid Waste to conduct a comprehensive inspection of the Eubanks Road Permanent Household Hazardous Waste Facility on Eubanks Road in Chapel Hill, Orange County.
1. The facility is a permanent household hazardous waste (HHW) facility owned by Orange County. 2. The facility is located at the Eubanks Road Convenience Center. 3. The facility is open Monday through Friday (Closed Wednesday) 7:00 am to 6:00 pm, Saturday 7:00 am to 5:00 pm, and Sunday 1:00 pm to 6:00 pm.
4. The facility household hazardous waste generator identification number is NCPH0681302.
5. Orange County Solid Waste is the operator of the HHW facility and Orange County Solid Waste has contracted
with Tradebe, Inc. to manage the waste at this facility.
6. The facility contingency plan is included in the Operation Manual, dated October 1, 2017 (FID 1214445). The contingency plan was discussed.
7. The facility is only permitted to receive HHW from Orange County residents. This facility does not receive HHW from residents outside Orange County or from conditionally exempt small quantity
generators (CESQG).
8. Orange County no longer stores any HHW material at the 68-01 HHW building across the street. The only activity at the 68-01 HHW site is the paint solidification operation. 9. During this inspection the paint drying procedure was discussed with Orange County Solid Waste. 10. On the 68-01 approved Ops Plan dated 12/4/19 Section B-4 states in part: “Should the paint be dried, paint will be mixed within the paint cans containing the paint, metal vats, plastic lined containers, such as a plastic lined carboard box, or similar containers conducive to drying paints. Mixing will be done by adding an appropriate
amount of kitty litter, clean soil, sawdust, shredded paper or similar material to adequately dry the paint. The dried consistency of the paint will be determined by Orange County Solid Waste employees to verify the paint has thickened adequately and no liquid remains. Drying will be performed by manual labor. Staff performing
drying procedures will wear appropriate safety personal protective equipment (PPE).” 11. The 68-01 approved Ops Plan dated 12/4/19 Section B-4 also states in part: “Dried paint will be disposed of as MSW at an approved, permitted facility. Dried paint will be transported to the City of Durham Transfer Station
for transfer to Sampson County Landfill. The dried paint shall not be disposed of in the C&D landfill.” 12. The 68-01 approved Ops Plan dated 12/4/19 Section B-4 also states in part: “As the dried paints will be disposed offsite, the County will be responsible for ensuring solidified paints cross the scales and appropriate tax is paid. Taxes will be paid in cost savings by not paying a HHW vendor to dispose of the paint.” 13. Resident zip codes are recorded on a daily log when the residents drop off HHW. Records were reviewed from January 9, 2023 through May 11, 2023.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

14. No unacceptable waste was observed at the facility during this inspection. Unacceptable wastes that must not be collected at this site include radioactive materials, infectious or biological wastes, explosives/shock sensitive material, organic peroxides, ammunition, friable asbestos wastes or material and polychlorinated biphenyls (PCB) with the exception of fluorescent light ballasts and PCB HHW. 15. If an uninformed or misinformed citizen brings such waste to the facility, program representatives will
consider taking the wastes anyway to avoid improper disposal. The decision regarding the acceptance of these wastes will be based upon established policies as well as the specific details of each case, as well as advice from contractor personnel. As necessary, the transportation and disposal contractor may help find specialized vendors and or agencies to remove any such waste for treatment or disposal. 16. The facility stores HHW in a chemical storage building. Cars pull into a secondary containment area where facility staff log in origin and type of HHW material. Material is placed on a sorting table inside the chemical building. Liquid paints are poured off into 55-gallon drums near the table or waste is sorted inside their containers into an appropriate container. Adequate aisles were observed during this inspection. 17. Household hazardous waste is sorted by class and poured into 55-gallon drums or are kept in their original container and collected into 55-gallon drums, plastic drums or 5-gallon buckets depending on size and quantity of waste being collected. All containers were observed to have a label with the material inside the container and a start date of accumulation in that container. Most of the collection boxes’ start date was less than three months old and the oldest container observed had a start date of December 15, 2022. No waste shall be kept on
site for greater than one year. 18. All containers with accumulating hazardous wastes shall be labeled or marked clearly with the words "Household Hazardous Waste" unless the material is recyclable (e.g., used oil, latex paints, batteries) and is
separated from other hazardous waste, or the materials is deemed Universal Waste as defined by 40 CFR Part 273. 19. The building walls in the chemical storage building have been installed so the walls are below grade to
seal the building and function as secondary containment.
20. All household hazardous waste is stored inside of the chemical storage building. Waste ready to be
shipped is stored under the awning by the HHW loading dock.

22. Mr. Baskerville stated that Tradebe, Inc. generally picks up HHW from the facility weekly or every other week. Tradebe staff are usually on site approximately 24 hours per week. 23. The chemical storage building is equipped with an indoor fire suppression system. Pye Barker Fire & Safety last inspected this system in April of 2023.

24. There are two portable fire extinguishers. The fire extinguishers were last serviced by Dr. Fire Protection in October 2022.
25. The facility maintains an adequate supply of absorbent material.
26. Emergency equipment is inspected weekly. Records were observed from December 1, 2022 through May 11, 2023.
27. Tradebe Inc. sends the facility a Uniform Hazardous Waste Manifest of material received (by generation date) for verification of the material shipped out. 28. The facility annual report (FAR) was received by the SWS, dated July 25, 2022. Facility throughput for July 2021 through June 2022 is 130,229.00 lbs. and serviced 6,100 residents. 29. The convenience center accepts municipal solid waste (MSW), mixed recyclables, clean wood, food waste, used oil, motor vehicle oil filters, antifreeze, batteries, food oil, food waste, textiles, bulky waste, etc. Collected materials are stored in containers. 30. The Chapel Hill Fire Department and/or the New Hope Volunteer Fire Department can be contacted to address an emergency at the facility. 31. Orange County Solid Waste staff are on site during operating hours. 32. The site is secured by a locked gate. County personnel also work in the convenience area. 33. The facility has proper signage.
