The meeting was held at the Coley Springs Baptist Church and was called to order by Co-Chair Dollie Burwell. Present were Jim Warren, Pat Backus, Massenburg Kearney, Betty Kearney, Cessel J. Boyd, Gary Duke, Charlie Richards, Mike Kelly, John Funk, Patrick Barnes, Carmone Rocco, Nan Freelanc;l, Sybil Dorsey, Bill Gallagher, Robin Green. MINUTES ADOPTED AND APPROVED It was motioned by Jim Warren and properly 2nd by Nan Freeland to accept and adopt the minutes for November 6, 2002. PROGRAM REPORT: Dollie Burwell asked for an update on the construction meeting held previous to the Citizens Advisory Board meeting. Mike Kelly updated the Citizens Advisory Board about the change order to the contract with Shaw, which allows them to treat up to 200 tons of the capped material that is contaminated. He said they have written a protocol for how they are going to separate the material. Mike said they have planned to take 50 tons of material, and do a first run. He said the material is on the pad now and is ready to go though to be treated, however they lost power 3 times due to ice. Mike said while the equipment was down they cleaned out the built up material, and began treating soil 7 a.m. March 5, 2003. He said 10:00 March 6, 2003 they will began to pull samples for analysis. Dollie Burwell said she received several calls from the community asking about the PCB Landfill, and the Governor. She asked where is Governor Mike Easley, and has he been informed about the landfill. Mike Kelly said the final press release was sent to the Governor's office, and that they received approval from the Governor's office to release the press release. Mike said a briefing has not been done. Dollie Burwell recommended that the Environmental Groups receive the press release as an update. Jim Warren said he spoke with the people in Kermersville. Mike Kelly, and Pat Backus passed out question & answer sheets as a response to Jim Warrens letter last month. Patrick Barnes spoke briefly about his concerns since the discovery of PCB' s, .and the discovery of a red clay discharge. He said they didn't see the red clay while walking along the River Bank,and that the state will do the analysis in 2-3 weeks. ADJOURNED The meeting was adjourned at 3:30 p.m. The next meeting was schedule for April 9, 2003 at 2:00 p.m. Citizens Advisory Board Detoxification-Redevelopment Project draft January 9, 2003 The meeting of the Warren County Citizens Advisory Board was called to order at 2:00 p.m. Thursday, January 9, 2003. The meeting was held at the Coley Springs Baptist Church and was called to order by Co-Chair Dollie Burwell. Present were Jim Warren, Pat Backus, Massenburg Kearney, Betty Kearney, Cessel J. Boyd, Emily Brown, Mike Kelly, John Funk, Patrick Barnes, Terrence Lyons, Jim Cloonan, Bill Gallagher, Robin Green. MINUTES ADOPTED AND APPROVED The November 6, 2002 minutes were postponed until the next meeting for further discussion on laboratory testing, and treated soils. PROGRAM REPORT: Dollie Burwell suggested that the Citizens Advisory Board discuss the issues about treated soil, outstanding testing results, and laboratory testing. John Funk said they are looking at 2 issues. (1) keeping the average below 200. (2) monitoring the concentrations. He said the below average of 200 is working well. Pat Backus introduced Terry Lyons from EPA in Cincinnati. She said EPA is providing in-kind services with stack sampling for the process demonstration testing. Pat said that Terry Lyons helps with getting stack samples on site and contract work. She said they are operating on a demonstration permit, but to get a national permit they would have to do a demonstration test that consist of 3 runs at 4 hours each at certain conditions. Jim Warren asked is there anything that they might find in the stacks that would cause the community a concern? Terry Lyons said they usually have initial stack test which is a plemenary test. He said they would get the unit up and running to where they want it to be, and than do a full bloom stack test. Terry said there might be a small chance that there would be a higher level of PCB's coming out of the stack than it should be. Pat Backs said for every 5000 ton of soil they do a stack test. She said 3 stacks have been tested and have past the six nines testing. Terry Lyons said that some of the test take longer than others depending on the stagiest. He said the dioxin takes the longest amount of time to run, and that as the test come in they get reviewed and approved which will give the unit more time to run. Terry said if they find something wrong with one of the test the unit will shut down, and that they will go down each step as the results come in. He said it will give them more confidants that things are running right. J draft January 9, 2003 page2 Jim Warren asked about the time frame between collected samples and results coming back. Terry Lyons said it depends on the test, that dioxin takes about a couple of months to come back. Jim Warren also asked about the different material in the landfill. John Funk said they have not seen anything different just gray material. Pat Backus said there is a difference in the North East comer, and that they believe it's cement kill dust to absorb water. Terry Lyons said that if it was a problem they would know how to handle it. Dollie Burwell asked about the time table to issue the final permit. Pat Backus said the final demonstration report has to be in by April 3, 2003 which would allow them to go until May 1, 2003 and then it would be up to EPA to reevaluate it with Doughty. Dollie Burwell asked when will everything be final. Terry Lyons said there are 2 PCB admission test, 2 PBC's in the treated soil test, 1 PCB admission test, hydrochloric acid test, dioxin test, PCB's in treated soil, and an organic test. He said the time frame on that the PCB admission's test and the acid test will take about two weeks for the results to return. Terry Lyons said dioxin test will take ten weeks to get back which will be March 20,2003, and Organic test will take April 3,2003, and a PCB admission test which will be another 4 weeks which will be May 1, 2003. He said that May 1, 2003 the data is done, and then the results will be put into an application and sent to Doughty in Washington, and then a permit is issued. Pat Backus spoke briefly about money and contracts. She said she met with Dempsey Benton, and update him on what they have spent, how much soil they have treated, and where they are now. Pat Backus said at the end of December 971 tons of soil was treated successfully. She said that the Shaw project cost was 7 .31 million, and that they are funded though a change order 5. She said the amount will get them though 8.9 million, but they have up to March to complete it. Pat said to complete the rest of the treatment is a change order 6 which will end in September. She said the complete treatment will end in July and then the demobilizing and restoration of the site and then tum it over to earth tech which would be in October. Pat Backus said that Dempsey Benton stated that the fund authorized will be sufficient to complete the detoxification of the PCB landfill. Mike Kelly said instead of giving money back they will use what they've got to finish the PCB landfill. J draft January 9, 2003 page 3 Jim Warren said that he understand's Pat Backus, and Mike Kelly's relief, but feels that it's a matter even in the minutes, and discussions that the need is of the community. Jim Cloonan updated the Citizens Advisory Board on the locations of the air monitors, and test results. Dollie Burwell asked about the samples, and the way things are going. Terry Lyon said that everything is looking good. Jim Warren asked about the failure rate, and the batches of soil that failed. Jim Cloon said when the system started up 5 batches failed out of 55. Patrick Barnes spoke briefly about the shut down of the equipment, and the 3 batches that failed out of 8. Bill Galligher spoke briefly about the 3 day shut down. Dollie Burwell said she would like a written report. Jim Warren said he heard in the beginning of the meeting that 5 batches of soil failed out of 55 which occurred in the beginning of the process. He said that the Citizens Advisory Board need to be very careful when communicating information to the group, and the community. Patrick Barnes said the state passed it's requirements after samples were collected. He said there have been some discussion about saving money, and presenting it to the Citizens Advisory Board. Pat Backus said the state laboratory is who found the problem in the beginning, and that she is trying to save money so that Shaw can continue the project. Jim Warren suggested splitting samples. Jim Cloonan said that there would be a better chance that the state laboratory would find PCB' s . . Dollie Burwell, Patrick Barnes, and Massenburg Kearney said they don't have a problem with the state laboratory testing. Jim Warren said that he has a problem with State laboratory testing. Bill Gallagher spoke briefly about the maintenance shut down in the landfill. ADJOURNED The meeting was adjourned at 4:30 p .m. The meeting was held at the Coley Springs Baptist Church and was called to order by 1st Vice Chair-Jim Warren. Present were Dollie Burwell, Pat Backus, Massenburg Kearney, Betty Kearney, Cessel J. Boyd, Gary Duke, Emily Brown, Charlie Richards, Mike Kelly, Daria Holcomb, John Funk, Luke Lucus, Karen Siper, Clareance Kearsey, Patrick Barnes, Juanita Yancey, Robin Green. MINUTES ADOPTED AND APPROVED It was motioned by Daria Holcomb and properly 2''d by Jim Warren to accept and adopt the minutes for August 7, 2002. PROGRAM REPORT: Pat Backus updated the Citizens Advisory Board that the Inactive Hazardous Site Cleanup Fund gave the Department of Environment and Natural Resources $2,500,000 for the clean up of the PCB Landfill. She said if additional funding is needed the Department of Environment and Natural Resources may also use up to $500,000 with stipulations that everything is spent out of the funds . Pat Backus also reported that she presented the Warren County PCB Landfill Analysis Summary to Deputy Secretary Dempsey Benton, and Mike Kelly. She said the Analysis basically shows the $13. 7 million, Expenditures, Remaining requirements, and the additional $4.5 million to end the project in September 2003. She said the actual treatment of the soil will be finished July 2003. Pat Backus also updated that they have switched from clean soil to contaminated soil, and that they have a demonstration permit to treat 5000 tons of soil. She said Terry Lyons from EPA in Cincinnati, EQM Company contracted by EPA has taken samples of the stacks, and several other places around the system. Pat said for every 5000 tons they will do stack testing up until 20,000 ton, and then the 4 day test which is the big demonstration performance test. She said the first stack testing will be in January, and that they have met the requirements of the six nines performance (99.999999991 %). Jim Warren asked about the air releases, and the safety of the community. Pat Backus said that Jerry Winberry has been doing air monitoring and shakedown testing. She said they tested 5000 tons in October, and that a 3rd test is set for the week of the 18th. Pat said it takes a while for the results to return for review, and that the results of the October test should be back by the next meeting. Pat Backus said she met with contractors before the Citizens Advisory Board meeting, and was updated that roughly 10,000 tons of soil had been treated. She said because of the limit on soil treatment, 200 parts per billion it would be hard to treat, and measure. Pat said because of the different results back from some of the laboratories, they met with an expert in PCB Analysis, and spoke with other laboratories to make sure the procedures were running correctly. She said the draft November 6, 2002 page 2 expert has been working with paradigm in Wilmington, Delaware. Dollie Burwell asked about the laboratory that they have normally worked with. Gary Duke said the laboratory in Wilmington was Recommended by Earth Tech, and has worked out real well. He said their procedure is very sit because they can get samples to them in the morning and have them back by the afternoon. Gary said that other laboratories would take 1 to 3 days before results would return. Pat said they have used Southern Kinston, Wilson, and another Lab in Toxicon Massachuset. She said that Earth Tech sends there samples to Paste Minnesota. Dollie Burwell asked is there a difference in where the test go? John Funk said limitations to do air monitoring or water samples. Patrick Barnes updated the Citizens Advisory Board that the state cut his contract 60%, and that he will attend the construction meetings once a month. He said he has prepared another proposal. Mike Kelly said they will take another look into Patrick's proposal. The meeting was held at the Coley Springs Baptist Church and was called to order by Co-Chair Dollie Burwell. Present were Pat Backus, Jim Warren, Massenburg Kearney, Betty Kearney, Cessel J. Boyd, Gary Duke, Bill Gallagher, Emily Brown, Nathan Hawes, Patrick Barnes, Sybil Bond Dorsey, Robin Green. MINUTES ADOPTED AND APPROVED It was motioned by Nan Freeland and properly 2nd by Jim Warren to accept and adopt the minutes for April 4, 2002, May I, 2002 and June 6, 2002. PROGRAM REPORT: Dollie Burwell asked Cessel Boyd if she would give the Citizens Advisory Board a Brief report on the conference call with Kathleen Curry of EPA July 9, 2002. Cessel Boyd said that Cathy Alston-Kearney updated Kathleen Curry with a basic overview of what's been going on with the training program. She said Brian Holtzclaw inquired about copies of news footage regarding the history of the landfill, demonstrations, and events surrounding the remediation project. Dollie Burwell asked how often will the conference call's with EPA occur. Cessel Boyd said they will continue every second Tuesday of the month. Pat Backus said that Cathleen Curry was pleased with the report submitted by the Warren Family Institute. Dollie Burwell suggested that a Citizens Advisory Board member attend the next conference call with EPA Dollie Burwell asked Cessel Boyd if she would update the Citizens Advisory Board on the EPA Grant. Cessel Boyd reported that the 40-hour HAZWOPER training will began August 12, 2002, and end August 16, 2002 at the Vance Granville Community College. She said a number of people from the previous training has had an interview with Midwest Soil. Gary Duke said Midwest Soil's is looking to hire 2 people, Shaw has hired 2, and that Kenny Hawkins has hired 4. Patrick Barnes reported that the contractor's are doing an outstanding job in the PCB Landfill, and that the general concerns about testing is going well. draft August 7, 2002 Meeting Minutes Page 2 Dollie Burwell asked if someone could update the Citizens Advisory Board on what's been happening over the last few weeks in the PCB Landfill. Bill Gallagher said the equipment is 95 percent set up and that they hope to start running clean soil next week. Pat Backus passed out pictures she took August 1, 2002 of the PCB Landfill. Dollie Burwell asked Pat Backus if she would update the Citizens Advisory Board on the Commissioners meeting. Pat Backus reported that she review the change of The IT Corporation to Shaw with the County Commissioners. She said she also discussed, How the equipment is running, How clean soil is processed, TSCA Permits, and Funding. Pat Backus said the contract with Shaw is $6.6 million from march oflast year, and that last month $2.25 million was added to the account for the PCB project. She said the Citizens Advisory Board needs $4.5 million. EPA Bryan Holtzclaw, EPA; Pat Backus, DENR Cathy Alston-Kearney, WFI; Emily Brown, WFI Nathan Hawes; WFI; Cessel Boyd; WFI The conference call began at approximately 11 : 1 Oam on July 9, 2002. The call opened with greetings from Kathleen and introductions of call participants. The discussion topics were as follows: Outreach Report: Cathy gave an overview of the outreach activities and will be sending Gloria a copy of the report and attachments (video, role- play script, etc.) later this week. Job Training Quarterly Report: Cathy inquired about the accuracy of the previous report. Kathleen gave the "thumbs up" regarding content and format. A correction was given regarding the title. The correct title is, "Environmental Justice Job Training" Pictures: Kathleen inquired about pictures taken during outreach and training activities. WFI staff will email Kathleen the pictures and send copies to Gloria and Bryan. New WFI Personnel: Cathy introduced the new additions to the Warren Family Institute Staff. Nathan Hawes-Interim Director during Cathy's leave of absence, Emily Brown-Contract for Landfill Project Newsletter, Cessel Boyd-Workforce Developer. Cathy will email Kathleen with copies to Bryan and Gloria of contact infonnation for each of the new employees. Landfill Site Visit: Ciloria inquired about a visit to the landfill site. Ccssel will make contacts and set-up a visit for the last of July or the first of August. Warren County PCB Landfill Detoxification and Redevelopment Project July 9, 2002-Minutes Continued Environmental News Footage: Brownflelds Conferences: Travel Funding: Bryan inquired about copies of news footage regarding the history of the landfill, demonstrations, and events surrounding the remediation project. Pat Bac kus has a video and will make copies for Kathleen, Gloria, Bryan, and Warren Family Institute. Ccssel made reference to the upcoming Brownfields Conference in Atlanta and Charlotte. She will not be able to attend the Atlanta Conference but will prepare to attend the Charlotte Conference. Cessel also requested the contact information for individuals working on the Winston-Salem Brownfields Project. Kathleen gave the contact names and phone numbers: John Allen (336) 747- 7475 and Derwick Paige (336) 727-8040 A question was posed in reference to funding for conference travel in the grant. Pat Backus suggested that travel scholarships be applied for through ICMA. Cathy stated that there is enough money to cover expenses for travel to the Charlotte Conference. Cessel will check on scholarships for future conference attendance. The call was brought to a close with the agreement of all parties, to continue the scheduled calls every second Tuesday of each month at 11 :00 am. Citizens Advisory Board Detoxification-Redevelopment Project draft May 1, 2002 Meeting Minutes The meeting of the Warren County Citizens Advisory Board was called to order at 1 :00 p.m. Wednesday, May 1, 2002. The meeting was held at the Coley Springs Baptist Church and was called to order by Co-Chair, Dollie Burwell . Present were Mike Kelly, Pat Backus, Betty Kearney, Patrick Barnes, Rev. Carson Jones, Bill Gallagher, Gary Duke, Hattie Davis, Glen Richardson, Robin Green. MINUTES ADOPTED AND APPROVED Approval of the April 4, 2002 meeting was tabled until the next meeting UNFINISHED BUSINESS: Dollie Burwell asked for an update on the HAZWOPER training. Pat Backus spoke briefly about the 40-hour HAZWOPER training at the Vance-Granville Community College. Dollie Burwell asked for an update on the progress meeting. Gary Duke reported that last Wednesday The IT Group was sold to Shaw Environment and Infrastructure. Gary said the project is a go and that contractors will be paid by the end of May. Gary Duke also reported that they have delivered 4 pieces of equipment to the landfill site and that one piece will be deliver next week. He said the last of the equipment should be in by the end of the month and set up between May 30, 2002 and July 15, 2002. Dollie Burwell asked about the Community Outreach piece and the scheduled date around the time the equipment is complete. Gary Duke said sometime in July. Dollie Burwell suggested that the Citizens Advisory Board and Shaw do a press release. Dollie Burwell asked about permits. Pat Backus said one permit is with TSCA for the equipment and the other is with region 4. Patrick Barnes reported that he was available to the community April 30, 2002 at the CAB office. He said he spoke briefly with Charlie Richards from the Daily Dispatch and updated him on where the project is now. Dollie Burwell asked about funding. Mike Kelly said Dempsey Benton and Johnny Gray is still looking for funding for the project. He said hopefully next month they will hear something. draft May 1, 2002 Meeting Minutes Page 2 Pat Backus updated that Earth Tech is in the landfill with Jerry Winberry working on setting up the air monitors. Cathy Alston-Kearney updated the Citizens Advisory Board that the 8-hour refresher training did not have the same response as the 40-hour HAZWOPER training. She said 17 people attended and completed the 40-hour HAZWOPER training and that they have not set a date for the 10-hour safety training. Dollie Burwell asked Cathy Alston-Kearney if she would help with getting the word out about the open house after the equipment is set up. The meeting was held at the John Graham Building and was called to order by Nan Freeland. Present were Dollie Burwell, Pat Backus, Massenburg Kearney, Patrick Barnes, Sybil Bond Dorsey, Robin Green. MINUTES ADOPTED AND APPROVED It was motioned by Nan Freeland and properly 2nd by Massenburg Kearney to accept and adopt the minutes for February 7, 2002 and March 7, 2002 with corrections. PROGRAM REPORT: Pat Backus updated the Citizens Advisory Board that the surety company made a $300,000 payment to Midwest soil Remediation to complete the fabrication and modification of equipment. She said that the Yancey Brothers also got paid $34,000. No other payment have been made because the subcontractors have not finish the paper work. Pat Backus said bids are due for The IT group on April 16, 2002. If more than one bid is received, there will be an official action on April 18, 2002. She said a confirmation of the successful bidder will be on April 19th and a hearing before the bankruptcy judge on April 24, 2002. Pat said that an auditor has been to review the claim of the unsecured creditor committee that the company is undervalued and will present his report on April 10, 2002 to the judge. The offer from Shaw to buy The IT Group ends on April 30, 2002. Dollie Burwell asked what was the bottom line. Pat Backus said if it go's though and Shaw gets the company they will have to pay everybody that hasn't been paid. Pat said Bill Gallagher will be back at the landfill on April 15, 2002 and that equipment will start arriving also. Dollie Burwell asked Patrick Barnes if he would follow up with Cathy Alston-Kearney about the HAZWOPER training program. The meeting was held at the Coley Springs Baptist Church and was called to order by Co-Chair Dollie Burwell. Present were Mike Kelly, Pat Backus, Cathy Alston- Keamey, Massenburg Kearney, Jim Warren, Diane Long, Robin Green. MINUTES ADOPTED AND APPROVED It was motioned by Jim Waren and properly 2nd by Dollie Bun-veil to accept and adopt the minutes for November 21,2000 and January 18, 2001. PROGRAM REPORT: Dollie Burwell spoke briefly about the article in the Warren Record about The IT Bankruptcy. Pat Backus passed out information concerning the IT Bankruptcy. She said that January 16, 2002 The IT Corporation filed voluntary petitions for relief under chapter 11 . Pat said that chapter 11 is part of the U.S. Bankruptcy Code that helps companies who are in trouble stay in business. She said The Shaw Group has agreed to provide The IT Corporation with a debtor in possession loan of $55 million. Pat said The IT Group is open for business and will continue to working on the detoxification project. Diane Long asked about local and minority contractor's getting paid. Pat Backus said that the contractor will get paid because of the payment bond. Dollie Burwell said she's concerned about the psychological effect this would put on the project. She suggested that a flyer be sent out to the community. Pat Backus said that Midwest said they will continue to work on the project with whomever has the contract. Dollie Burwell suggested a press release go to the Warren Record and the Daily Dispatch. She said a press release would give the community a chance to hear what the Citizens Advisory Board have to say about the IT Bankruptcy. Pat Backus said she will work on the press release to the Warren Record and the Daily Dispatch. Jim Warren asked for an update on funding. Mike Kelly said that he and Pat Backus met with Chief Deputy Dempsey Benton and he said that he will continue to work on funding for the project. Mike said Pat Backus prepare spread sheets on projections, cost, and spending for Dempsey Benton. He said the project has slipped from the January and February time frame because of the permitting process and other things. J,.. He said the down side is that a big piece of equipment will be corning in June or July and they would need the money quickly. Mike said that Dempsey Benton has had some success discussing a pot of money in an unclaimed capital fund . Cathy Alston-Kearney updated the Citizens Advisory Board on the job training program. On January 16, 2002, The IT Group filed voluntary petitions for relief under chapter 11 of the U.S. Bankruptcy Code. In connection with those filings and the proposed transaction, The Shaw Group agreed in principle to provide The IT Group with debtor-in-possession (DIP) fmancing. Full case name: In re: The IT Group, Inc., et al. Case number: 02-10118 Place filed: U.S. Bankruptcy Court in Wilmington, Delaware Judge: Mary F. Walwrath 2. On January 25, 2002, The IT Group entered into a defmitive asset purchase agreement to sell substantially all of the Company to The Shaw Group. The Company also obtained court approval, on an interim basis, for Sugar Acquisition Inc., a subsidiary of The Shaw Group, to provide a DIP credit facility of $55 million. 3. A number of motions, notices, and orders have been filed. IT is going a very good job making this information available at their Internet site, hllp://www.lheitgroup.com , under the heading of restructuring news. Several motions are being heard next Tuesday which should provide more insight as to what their future will be. 4. The project has performance and payment bonding. The bonds are with Kemper Insurance and are each for the full amount of the contract, $6,658,000. I have been contacted by Kemper concerning IT's performance. My response letter is attached. That information was as of January 8. An invoice of with payment of $12,105.12 for January is in the invoice review process. I have received a few calls from subcontractors and have supplied them with bonding company information. The contact for these bonds is as follows . Mr. Stephen J. After notifying the State Construction Office of the bankruptcy filing, I was advised to send a letter to cure to The IT Group. The procedure is explained under Article 29 of the General Conditions of our contract with IT. The General Conditions are essentially the same as the standard State Construction Office contract. Some modifications were made to make it applicable to a design-build, remediation project. Our letter was signed by Laird Davison and received by IT on February 1. It is attached. They have fifteen days to respond. 6. IT invoices the State each month for work that has been completed. The invoice is certified by our oversight contractor, Earth Tech, and sent to me for fmal approval for payment. This is not a "rubber stamp" process. We examine and question and modify to ensure that work is completed before we approve. A 5% retainage is held by the State until completion of the project. 7. Phase I is approximately 60% complete. Essentially all the site work has been completed and most of the equipment work has been completed. What remains is completion of equipment modification, mobilization of equipment, and demonstration testing. The current schedule estimates that Phase I will be completed at the end of the fiscal year in June. Pat Backus 919-733-4996 x308 02/07/02 Page 1 of2 8. The State does not pay in advance. A significant amount has been paid to IT for work being performed to modify and fabricate equipment for the job. The equipment is being assembled and tested by Midwest Soil Remediation in Elgin, IL. IT has contracted with MSR for the actual soil treatment. I have visited the firm and seen the equipment and work done. We have required a consent of surety on the work done in IL before we pay. IT is paying MSR in advance on a subcontract. MSR is continuing work to obtain the TSCA permit but has ceased working on the equipment until they receive a $300,000 payment from IT. 9. Most of work that will be performed by subcontractors on Phase I, excluding the treatment by Midwest, has been completed and paid for. Prior to the bankruptcy filing, subcontractors had been paid before terms and even in advance in some cases. The IT Group has bent over backward to work with local and minority subcontractors on the project. (An example is suspending their bonding requirement to allow participation.) The following table lists the subcontractors and/or vendors with outstanding invoices with IT which have not been paid as of February 5, 2002. It they go beyond seven days, they are required to pay the subcontractors interest. Conditions to withhold payments to IT are listed in Article 33 and must be authorized by the Department of Administration. If the State withholds payment without cause, it is subject to payment of interest to IT. 11 . IT has terms in their subcontracts for payment when they are paid or net 60 days, whichever it later. 12. IT has continued to perform on the contract since the bankruptcy filing and is making progress. The critical path item at this time is the receipt of a demonstration permit from EPA-TSCA. They have received a rough draft of the demonstration permit and anticipate the final permit in the next few weeks. Midwest is the owner of the permit. In Patrick Barnes absent, Dollie Burwell mentioned a proposal he prepared for use when contacting prospective private foundations for funding. She gave the draft to Pat Backus for further review Pat Backus reported that she and Patrick Barnes gave the Warren County Commissioners and Congresswoman Eva Clayton a brief update of progress on the project since the ground breaking and a tour of the landfill site. Dollie Burwell said that Commissioner Richardson has been adamant about the County Commissioners taking leadership around the redevelopment of the site. Dollie Burwell said that Congresswoman Eva Clayton thought it would have been a possibility to go back to the Department of Defense ,but September 11 1h happened. Dollie Burwell said that Congresswoman still has hope in the person she talked with at Department of Defense. She said Congresswoman Eva Clayton also talked about introducing some appropriation legislation for the Federal Government to support funding of landfills that were not superfund sites. Dollie Burwell said she was not sure if the new Governor was aware of the PCB Project. Mike Kelly said that the Governor is aware of the project and that Secretary Bill Ross has sent a letter out lining where the project is now and what the short falls are. Mike said that he and Pat Backus met with Secretary Bill Ross and Deputy Secretary Dempsey Benton to review the project schedule that Gary Duke and Bill Gallagher had prepared. He said they looked over where the project will be in the next few months and at what point the other money is needed. draft December 6, 2001 Meeting Minutes page 2 Mike said Deputy Secretary Dempsey Benton knows the project need extra money based on current plans to get the project from March pt to July pt _ He said the State Budget Office is looking at other pots of money and where they may be able to get money. However, those funds won't be available until after the General Assembly finishes . Gary Duke updated the CAB that the site work is essentially complete. Gary said that he, Pat Backus, Kathleen McNelis, and Carl Palmer had met with TSCA regulators inWashington the previous week. The regulators say they will try to have a TSCA demonstration permit issued by the end of January or early February. With that approval, equipment will be coming on site in late February or early March. Gary Duke also spoke briefly about the DRE(destruction and removal efficiency) that will be required and testing of the BCD process. Dollie Burwell asked if anyone from EPA would be at the site during the testing. Gary Duke said someone from TSCA will be there for the DRE testing. Cathy Alston-Kearney updated that no activities has been going on at the Warren Family Institute in support of the project. It is her desire to contract the newsletter layout design. She is discussing this with a person that has experience in doing this. She said that Sandy Williams, the job planner for the training grant has retired. WFI is receiving resumes and interviewing for a new job planner. Cathy also reported that Aviva Meyer is continuing to work with WIF on a video project with school children about the landfill. Dollie Burwell suggested that Patrick produce a report that could be signed by the CAB outlining the economic impact of the project on the local economy. This would be sent and could be reported orally to Local Chambers of Commerce, County Commissioners, Economic Development Directors, Mayors and Media. Jim Warren asked if the target of the Outreach documents is private funding organizations or legislators. Dollie said both. Jim suggested that it be good quality but not to professional. Jim Cloonan update the CAB on the ambient air sampling results. The baseline air monitoring was preformed in May before any work was performed at the site. All the data had been reviewed and validated. PCB concentration were within limits set by the previous Working Group under the recommendation of Joel Hirshhorn. The dioxin concentration at one of the sampling locations exceeded the Working Group limit. The values were compared to national ambient concentrations and to NC Division of Air Quality limits. The dioxin limit established by the WorkiJ?.g Group was less than the national ambient concentrations. Pat Backus and Patrick Barnes said they had reviewed their files and could not find the basis of Joel Hirshhorn's recommendation. Pat Backus stated that these limits were not part of the statutory requirements for the project and could be changed. The CAB accepted the recommendation to use the NC DAQ limits for ambient air sampling. The next ambient air sampling will be when excavation and treatment begins at the landfill. UNFINISHED BUSINESS Dollie Burwell spoke about Deborah Ferruccio's article in the Warren Record. She said Deborah did raise some valid issues in the letter but some of the things were misguided. Jim Warren asked if the Citizens Advisory Board could talk about the key charge and how the CAB should respond if they are asked about the article in the paper. He also asked if the key charge was that the current process is only another test of the BCD technology. Dollie said that was the main thing. Pat Backus said one of the things Deborah talked about was the performance testing of the process. She said any process that goes on site has to demonstrate that it will perform as expected. Bill Gallagher suggested that the Citizens Advisory Board publish a positive article that will address these items. Dollie Burwell suggested that a contractor write a letter to the ~ditor. Cathy Alston-Kearney said the challenge is to challenge the Warren Record to do an investigative report. Dollie Burwell suggested putting a positive article in the Warren Record and not to challenging the Warren Record. Diane long suggested thanking the Warren Record for there good coverage of the groundbreaking. Jim Warren suggested that the Citizens Advisory Board note that they did discuss and noted a number of factual inaccuracies but choose not to deal with it until further notice. He said that the article deliberately mislead the General Assembly. Dollie Burwell suggested someone contact Joel Hirschhorn. Diane Long suggest that someone draft points and counterpoints and keep them on hold in case of a respond. Dollie Burwell said for the record Pat Backus will address the points, and she will address the political implications. draft August 2, 2001 Meeting Minutes page2 Gary Duke spoke briefly about the 18 to 30 month approval process and time frame for a TSCA permit. He said they will first get approval for the demonstration test. If the test is successful, TSCA will give interim approval and to continue to operate at full scale as long as the test results are positive. Pat Backus said she remembered that the issue about the permit had been brought up by Deborah about a year ago when previous DENR Secretary Bill Holman met with the community . She said that Deborah brought out a letter that had been issued six months before then. DENR had received a copy of the letter when it was sent to Deborah. Pat said she tried to explain to Deborah that they have been working with EPA to understand more about the permitting process and the options that Deborah was not aware of She said she left messages for Deborah offering to talk more about the permitting process. Gary Duke reported that the inspection of the Erosion and Sediment Controls was approved and that grading could start at the site. Pat Backus said there are sign in sheets and safety equipment for those visiting the site. Dollie Burwell asked in terms of people calling or coming to the landfill is there a phone number. Pat Backus said she spoke with Loria Williams and she said to give her about a week and she will move Robin Green out of the receptionist area into an office so they can set up phones. Dollie Burwell said she believes once people see work going on in the landfill they will start asking questions. FUNDING PROCESS Dollie Burwell said that Congresswoman Eva Clayton is trying to get federal dollars but was unable to speak before the Appropriations Committee. She said Congresswoman Clayton asked if she could get with Pat Backus to put together talking points. Dollie said what Congresswoman Clayton is trying to do is not to ask for money just for Warren County but to plan a strategy to show how federal dollars can help state and local government clean up sites that don't qualify as Superfund site, but do need to be cleaned up . She said Congresswoman Clayton met with DENR Chief Deputy Dempsey Benton and they discuss a strategy he had to continue the project so there would be no stopping and restarting. He also asked if the key charge was that the current process is only another test of the BCD technology. Dollie said that was the main thing. Pat Backus said one of the things Deborah talked about was the performance testing of the process. She said any process that goes on site has to demonstrate that it will perform as expected. Bill Gallagher suggested that the Citizens Advisory Board publish a positive article that will address these items. Dollie Burwell suggested that a contractor write a letter to the editor. He said they will first get approval for the demonstration test. If the test is successful, TSCA will give interim approval and to continue to operate at full scale as long as the test results are positive. Pat Backus said she remembered that the issue about the permit had been brought up by Deborah about a year ago when previous DENR Secretary Bill Holman met with the community. She said that Deborah brought out a letter that had been issued six months before then. DENR had received a copy of the letter when it was sent to Deborah. Pat said she tried to explain to Deborah that they have been working with EPA to understand more about the permitting process and the options that Deborah was not aware of She said she left messages for Deborah offering to talk more about the permitting process. Gary Duke reported that the inspection of the Erosion and Sediment Controls was approved and that grading could start at the site. Pat Backus said there are sign in sheets and safety equipment for those visiting the site. Dollie Burwell asked in terms of people calling or coming to the landfill is there ?-phone number. Pat Backus said she spoke with Loria Williams and she said to give her about a week and she will move Robin Green out of the receptionist area into an office so they can set up phones. FUNDING PROCESS Dollie Burwell said that Congresswoman Eva Clayton is trying to get federal dollars but was unable to speak before the Appropriations Committee. Dollie said what Congresswoman Clayton is trying to do is not to ask for money just for Warren County but to plan a strategy to show how federal dollars can help state and local government clean up sites that don't qualify as Superfund site, but do need to be cleaned up. She said the purpose of the letter was to give him a sense of what the community and DENR staff have devoted to the detoxification project over the years. Dollie said that in the letter to Secretary Ross she asked if he would meet with the CAB in Warren County or Raleigh. Mike Kelly said that he has been trying to schedule that meeting and that Secretary Ross has an opening on May 22nd from 1-2 pm. Mike asked if some of the Warren County Commissioners and CAB members could meet with the secretary on that date. Dollie also reported that she had asked Frank Ballance about whether the community should meet with other legislator's such as members of the Appropriations Committee, about funding for the PCB Landfill Project. She said Senator Frank Ballance stated that it would not hurt to contact other legislators and it was most important to meet with Secretary Ross to ensure that the project is a priority for DENR. Mike Kelly said that the project was a priority on the budget prepared last fall. Cathy Alston-Kearney reported that a message was received after that last meeting from Brian Holtzclaw in which he reversed his previous comment that Warren Family Institute could not apply for the EPA Warren County training grant. She said that the training grant application was submitted on April 20, 2001 . Cathy also updated that the EPA Outreach grant was submitted on May 3rd. She said she is not sure whether any others have submitted there applications. Cathy said the grant includes funding for the newsletter and support for a program to educate kids about the environment. She said WFI has a graduate student coming for the summer from UNC School of Public Health. Jerry Winberry stated that he has approached the NCSU Extension service in the past about preparing a video that could be used for educational purposes. He said that he was meeting with them the next day and would bring up the possibility that they prepared a video of the PCB landfill project if it was acceptable with the community. draft May 10,2001 Meeting Minutes page 2 Diane Long reported that she had spoken to Cynthia Profil of EPA She said that Cynthia has contacted her in the past to learn more about EJ communities that are requesting grants. Patrick Barnes reported that Emily Brown has been helping Robin Green get the postcards out to the legislators. He said that the May newsletter was issued and on time. Patrick said that the deadline for articles for June issue is May 14th. Pat Backus reported that when she and Robin Green were delivering the flyers for the Community Information Meeting, she learned that some of the people that live in the trailers on Limertown Road were not getting copies of the newsletter. Patrick said that he was looking into that problem. Dollie suggested that Patrick talk to the Warren County Commissioners to see what could be included in the newsletter to help them with their working group on recreational planning for the county. Dollie also indicated that she had asked Angelena to send a copy of the recent resolution of support to the governor and DENR secretary in addition to those listed on the resolution. Diane Long said she would talk to DENR Deputy Secretary Dempsey Benton and also to Richard Rogers to identify others who the community should be talking to about the landfill funding issue. Dollie suggested that someone look at the cost of maintaining the landfill over a 30-year period. Mike Kelly and Pat Backus from the North Carolina Department of Environment and Natural Resources (DENR), met with Wayne Boyles of your staff in March to discuss this issue. He was presented with information on the project and our funding needs. This disposal facility was forced upon the residents of this county in 1982 after PCB- contaminated oil was illegally sprayed along North Carolina roads in the late 1970s. The environmental justice movement originated here as citizens from across the country fought against the disposal of the toxic PCBs in our county. As the chairperson for the Citizens Advisory Board, I am writing to ask your support in the detoxification of this facility. A promise was made to the citizens of this county that the facility would be detoxified once the technology was available. The state has provided more than $10 million for this project thus far and recently issued a contract for Phase I of the detoxification. We expect the groundbreaking to be on June 4. $7.5 million is needed by March 2002 to continue into Phase II without costly delays. The estimated completion date is the fall of 2002. This date will coincide with the twentieth anniversary of the facilities construction. A promise would be fulfilled. The state's financial outlook for this year is not very promising. We need your support to obtain federal money to continue this project through completion. Unfortunately, many of the remediation funds used for decontamination of hazardous substance sites are not available for this project. The PCB disposal facility is not a Superfund site, nor is it a Brownfield site. The Honorable Jesse Helms May 10, 2001 Page 2 We are working closely with the county commissioners in planning the redevelopment portion of this project. Warren County has few recreational facilities and at the current time, a recreational facility with ball fields and hiking trails around the 142 acres of this site is at the top of the list. We have explored the possibility of obtaining grant and private sector funds for this type of facility and the prospects look good. The detoxification project will provide the infrastructure to support such a facility. Mr. Boyles indicated that it might be possible to explore funding through the VA-HUD bill. We also would recommend exploring options through the Department of Interior that would potentially have funds for the type of redevelopment we are exploring. Also, as a reminder, 10 percent of the material in the landfill came from Ft. Bragg. Our experiences with the Department of Defense to have them share in the detoxification cost have not been very successful. Your experience and work with DOD may be very influential in this process. Detoxification is a permanent solution for the disposal of this waste. Once the site is detoxified, the Department of Defense and the state will no longer have any future liability associated with this site. The citizens of Warren County, in conjunction with DENR officials, have worked on this project for more than six years. We did a complete assessment on the facility, and explored several technologies prior to selecting the Base Catalyzed Decomposition (BCD) technology for the detoxification. It is a very safe technology, and is capable of achieving PCB destruction rates low enough so there will never again be a worry that PCBs will contaminate the community. Senator Helms, we need your support. Congresswoman Eva Clayton's office has agreed to take the lead on this issue, but your office is very critical to the success in our obtaining the $7.5 million needed to complete this project. MINUTES ADOPTED AND APPROVED Minutes from March 12, 2000 meeting were adopted and Approved UNFINISHED BUSINESS Mike Kelly updated the Citizens Advisory Board that he and Pat Backus had attended the Warren County Commissioners meeting on April 2. He said that they updated the County Commissioners on the status of the PCB Landfill Detoxification and Redevelopment Project and the need to secure $7.5 million to complete the project. Mike stated that the Commissioners had unanimously approved a resolution that supports the detoxification and effort to secure the additional funds. It was also resolved by the Commissioners that resolution be forwarded to Warren County's Legislative Representatives and Congressional Delegation. Cathy Alston-Kearney indicated that she would check to see if it had been forwarded. Mike Kelly also updated the Advisory Board that Sandra Gardei of Congresswoman Eva Clayton's office had conducted a conference call on April 3 with representatives from EPA, DENR, and DOD to discuss sources of additional funding. Brian Holtclaw, Jewel Harper, Kristi Latimer and Rosalind Brown represented EPA Region IV; Lynn Richardson represented the Department of Defense, Artie Stanberry of the congresswoman's office substituted for Dollie Burwell; and he and Pat Backus represented DENR. The history of the landfill, the status of the detoxification project, the need for additional funding and attempts to secure funding through federal agencies were presented by he and Pat. The EPA representatives indicated that the landfill is not on the National Priorities List and does not have any ranking. It does not fit under any existing program they have to fund remediation. Jewll Harper did suggest trying the interagency Working Group. Lynn Richardson of the DOD indicated that they are not funding anything that is not defense related. However, he stated that there have been changes in personnel with the change in administration and suggested that Congresswoman Clayton send a letter to Ray Fatz, Deputy Assistant Secretary for Army Environmental. Mike was asked to provide Sandra with a letter that was sent from the governor's office a year or two ago to use as an example. Mike told the CAB that he had don that. Mike also indicated that he and Pat had followed up with thank you letters to the members of Congresswoman Delegation that they visited in March as had been suggested at the previous CAB meeting. draft April 12, 2001 Meeting Minutes page 2 Pat Backus spoke briefly about the detoxification project initiation meeting with IT Corporation, Earth Tech and DENR held on March 13 . The purpose of the meeting was to allow some of the individuals that will be involved with the work to meet and to review some of activities needed before construction could began( e.g. schedule of values, submittals, permitting, etc.) Pat also indicated that the two grants from EPA Region IV specifically for the detoxification project, training and outreach, had been advertised. Mike Kelly said that perimeter air monitoring by Earth Tech would start in mid May. He said that DENR would like to make the people in the Afton area and particularly on Limertown Road aware of air monitoring and other initial construction activities that will be happening in the near future . To avoid delay Pat Backus had reserved the cafeteria at the South Warren Elementary School for Thursday, May 10. Pat provided an example of a flyer that could be used to advertise the event. Jim Warren suggested that Pat clear the date with Dollie Burwell before proceeding further. The possibility of a groundbreaking ceremony when construction begins on June 4th was also mentioned but tabled until the next meeting. Pat Backus updated the CAB about the HUD Notice of Funding Availability NOFA that Dollie Burwell spoke about at the last meeting. Pat stated that she listed to the webcast presentation on April 5 and ordered a booklet about the grant. She said that while there is a special program called the Brownfields Economic Development initiative that does provide some remediation money, it has to be tied to matching Section 108 funds. She also stated that her impression for listening to the webcast was that there had to be a significant connection to demonstrable economic benefits such as long-term job creation. The application for the grants would have to be made by the county. Pat provided a summary that provided more information she had found . She stated that she didn't think this was a viable option. Robin Green updated the Advisory Board that over 300 post cards have been stamped and mailed to the county's legislative representative in the General Assembly and the Congressional Delegation. Specifically , post cards were sen to Senator Frank Ballance, Representative Jim Crawford, Representative Stan Fox, Congresswoman Eva Clayton, Senator Jim Edwards and Senator Jesse Helms. It was suggested that the CAB follow up with an individual letter to Senator Helms. Mike Kelly indicated that he would draft a letter. Jim Warren and Mike Kelly raised the idea of a legislative day in Raleigh. Diane long stated that it might be to late to have a legislative day because the crossover date had occurred. She also expressed concern about citizens from Warren County being able to get off work to participate in the event and the amount of work that would be required to conduct the event. After some discussion it was the consensus of those present that the idea of taking a small group to Raleigh and focusing on specific legislators be investigated. Diane indicated that she would get Senator Ballance's opinion. draft April 12, 2001 Meeting Minutes page 3 Cathy Alston-Kearney updated the Advisory Board that EPA has drafted a RFA to advertise job training grant for the landfill project. She said it was due April 20th . She had mad some initial contacts with Vance Granvill Community College, Kerr-Tar Regional Development Council, the Employment Security Commission and other about collaboration on the grant. She said she had also talked to Mike Sinew who is familiar with this type of grant and was recommended by Brian Holtzclaw for advice. Patrick Barnes updated the Advisory Board on his efforts to find funding for the project. He stated that he had found about 100 sources of funding but that most would not fund or would provide limited funding for the detoxification part of the project. He has found a number of sources for redevelopment money such as the USDA-Rural Center, which will provide 75% of construction cost. He and Emily Brown are obtaining background information on some of the grants for when it is time to obtain redevelopment money. Pat also updated that he had worked with Pat Kearney and IT to help in the subcontracting agreement they were negotiating. Jim Warren updated that he spoke with Lois Gibbs, who was one of the residents at Love Canal, and that Nan Freeland had spoken with the Ford foundation. There were two primary goals we wanted to achieve: I) Ensure that everyone was aware of the critical time line we are on and that vvith the Phase I contract in place, we had to have the balance of the funds this fall to continue the project and get completed; 2) We wanted the staff to understand that this project does not tit into a lot of the typical environmental molds (Brownfields. Superfund. etc.). and that the EPA had been supportive. They did not hm·e a category from which fund s could be drawn to support this project. Therefore. it is imperative that \,ve seek out other funding options. s uch as parks, Department of the Interior. re-development, etc., and to stay away from the '·landfill" stigma. Pat Backus updated the Citizens Advisory Board that Monday, November 27, 2000 the bid packages would be sent to three qualified bidders. She spoke briefly about the site visit with contractors November 9, 2000. She said that the site visit was to give contractors a chance to ask questions or voice concerns about the bid package. Pat Backus also updated that the leachate pumping system in the landfill has been shut down for the winter to avoid freezing and that a letter documenting that has been sent to Greg Brown of EPA Region IV in Atlanta. Patrick Barnes spoke briefly about the Community & Contractor Open Form on October 26, 2000 He said that 125 people attended the open form and that feedback indicated the forum was very beneficial. Cathy Alston-Kearney updated the Advisory Board on the environmental justice ( E.J). Grant and a conference call with EPA representatives in Atlanta on Friday, November 17,. She said that the new staff is working intensively between now and the first of the year to address the issues that have held up the E.J. Grant. Cathy also spoke briefly about the disappointment of the proposal process. She said that the proposal might have to be rewritten because of the format. Cathy said that she was grateful to have Dollie Burwell and Pat Backus there for the conference call. Dollie Burwell said from what she understood from the conversation was that EPA had not decided the funding authority for the grant. Current legislation does not allow fuding under one grant for both the training and outreach activities mentioned in John Hankinson's letter to the Citizens Advisory Board. However, she said that for typical construction project a State Building Commissioner will ask why your not using local if they are available. The meeting was held at the Coley Springs Church and was called to order by Dollie Burwell. MINUTES ADOPTED AND APPROVED Minute ji-om August 8, 2000 meeting were adopted and approved UNFINISHED BUSINESS Dollie Burwell began the meeting by asking Patrick Barnes to speak about the news letter. Patrick asked his assistant Cessel Boyd to give the Advisory Board an update. She said that 500 copies have gone out to the Sandy Creek and Shocco township area. Cessel said that other copies have gone out to Churches and Schools, as well as other locations. Patrick Barnes spoke briefly about the next news letter. He said that the October news letter will have present and past issues. Patrick said his main focus is on the residents of Warren County. Pat Backus update the E. J. Grant. She said that she spoke with Eddie Wright and he said he is having trouble getting through to his contract people at Region IV. Pat spoke of the budget being approval and the problems reading the grant. She said that Eddie Wright and Roslyn Brown will meet with their contract people September 12, 2000. Mike Kelly updated the Advisory Board on matching funding. Mike said that he received a letter from EPA in August offering in kind services from fee breaks to equipment and testing. He said he spoke with people from the state budget office Thursday, September 7, 2000 and they said that the in kind services would be acceptable for matching funds to release the $7 million. Mike said he also spoke with Carol Browner and Bill Holman and that Carol Browner sa:id that she would continue to look for available money. Dollie Burwell said that Advisory Board might want to discuss strategy before Governor Jim Hunt leaves office. Jim Warren asked what's the Advisory Boards threshold to get started with this project. Pat said she hope to have additional money after testing and a Tosca permit. He introduced Jim Cloonan, Kathleen McNelis and John Funk. Jim Cloonan spoke briefly about the services he provides for helping with the detoxification of the landfill. He said that he hopes to apply for this site and is looking forward in working with the Citizens Advisory Board. Pat Backus gave an update on the scope and services. She said that the decision was made by the state commissioner August 22, 2000. She said that Jim Cloonan, Kathleen McNelis and John Funk will put together a proposal to present to the state construction office. John Funk and Kathleen McNelis spoke briefly about the services they provide. They said that they both have PCB experience. Pat Backus updated that she received a letter from Tim Fields offering the Advisory Board available equipment. Jim Warren asked what was the other matching assistance. Pat said that for Tosca $75 thousand a year, for a BCD license fee of which EPA will Waver it's 60% share and that the $7 5 thousand would assist in getting the Tosca permit. Pat Backus updated the condition of the equipment and the qualification of the detoxification contract. Mike Kelly said in the past the Advisory Board has been pushing for technology that can be used on site. He said that BCD was chosen because of it's on site ability. Henry asked about the ground breaking date. Dollie suggested that a ground breaking date be set and presented to Governor Jim Hunt by mid December. September 13, 2000 These were the main topics discussed at the PCB Landfill CAB meeting as best I can remember. (1) The Governor and Congresswoman Clayton received a letter from Tim Fields, the Assistant Administrator for the US EPA. The letter was issued August 11. In the letter he officially extended an offer of in-kind services. In-kind services are basically things that are needed for the project that would have to be paid for by the State but EPA has offered to supply free. The three contributions they offered were the ones I mentioned at the August CAB meeting: □ support in securing a Toxic Substances and Control Act (TSCA) permit for the Base Catalyzed Decomposition (BCD) process. This assistance includes help on preparing the parts of the permit application and sample collection and analysis. □ waiving of the EPA portion of the BCD licensing fee (65% of the fee); and □ making existing thermal desorption equipment available for use at the landfill. I am not positive, but the Governor may issue a press release about this. (2) As you know, $7M of the appropriation the project received last year from the General Assembly required federal matching. The State Budget Office was contacted and they determined that the EPA in-kind services determined that the EPA in-kind services would count as a part of the federal match required to release the $7M. This means the state can now enter into a contract using the phase-funded approach. (3) The State Building Commission selected an oversight contractor. The contractor is Earth Tech. They will provide oversight from start to finish of the project to ensure that the requirements of the design and permits are followed. They will also be providing perimeter air monitoring. Three members (all licensed engineers in the State of North Carolina) of their team visited the landfill and attended the CAB meeting. They also met with the state Tuesday morning to finalize a scope of work for their contract. We hope to get a contract in place by the first of October. ( 4) The state expects to release a Request for Qualifications for a detoxification contractor by the end of this week. This starts in motion the process for selecting and entering a contract with a detoxification contractor. (5) The first printing of the community newsletter is finished. Copies are being mailed to households relatively close to the landfill in the Shocco Springs and Sandy Creek townships, schools and churches in Warren County, and Warren County and other officials. Copies will also be available at locations in Warrenton. He said that these EPA concessions could be assigned dollar value and in kind services. Cathy Alston Kearney updated the Advisory Board that a letter has been sent August 2, 2000 to Region IV. She said the package must clear Atlanta and then Washington and it will take 2 to 3 weeks. Mike suggested that a letter be sent to Governor Jim Hunt reminding him of matching funds. He said a the letter should be sent on the l 5th or mid September. Pat Backus briefly updated the over sight contract. She said that the state construction office evaluation suppose to make a selection by August 21 st and Decision modem public meeting on August 22, 2000. Patrick Barnes gave a brief update on his news letter..Pat Backus gave a brief update on the landfill. Joint Warren County/State PCB Landfill Working Group draft January 7, 1999 Meeting Minutes Henry Lancaster called the regular meeting of the Joint Warren County/State PCB Landfill Working Group to order at 6: 10 p.m. Thursday, January 7, 1999. The meeting was held at the Warren County Working Group office. The meeting began with a work session facilitated by Pat Williamson. She advised the ground rules as follows: 1) Focus on task at hand 2) Focus on one topic at a time 3) Speak for yourself 4) Decisions made by consensus The group was advised to take fifteen (15) minutes to write down what they think the role of the Working Group should be and who they think should be a part of the Working Group. This would be titles or positions, not names. Jim Warren interjected that it would be a good idea to give an overview of where we are. Mr. Lancaster advised that Dollie Burwell questioned if the Working Group had met its charge. She is concerned about citizen participation in the detoxification effort; the size of the working Group, staff support, technical support, community education, health issues, and the need to have some method of getting information to the citizens said Mr. Lancaster. Next, the group took fifteen (15) minutes to write down their thoughts and ideas as they related to the role of the Working Group. Below is a brieflist ofresults. Mr. Lancaster asked Ms. Williamson to prepare a detailed report. Role ofWorking Group 1) Help obtain funding 2) Help develop specifications for detoxification and contractor 3) Lead community involvement 4) Serve as liaison to the State and the Community 5) Provide education and updates about PCB Landfill issues 6) Determine support and budgetary needs Support and Staffing needs for Working group 1) Office space, supplies and equipment 2) Secretarial support 3) Technical support 4) Project Manager Representation on the Working Group l) Education 2) Elected county official or their representative 3) Citizens near the landfill 4) Concerned county citizens 5) Environmental groups 6) Economic development and business 7) Emergency management 8) Civic groups As a result of the work session the following mission statement was developed: Work together to detoxify the PCB Landfill by: A) Working with the State and Science Advisors B) Working together on one accord C) Detoxifying the landfill NEW BUSINESS Phase ID Mike Kelly advised a letter has been sent to purchasing and contracts for sole sourcing phase III. He was told to anticipate and answer by the first of next week. Mr. Kelly continued, advising that two engineering companies have contacted him and are interested in working with ETG. However, according to Steve Detwiler, neither company has contacted ETG. Requests have been sent to two or three ''manpower" like companies soliciting for an engineer, who will head up the detoxification effort. We are looking for someone with landfill experience said Mr. Kelly. Funding Mr. Lancaster advised there is no certified budget, however the mechanism is in place to draw on the $2 million appropriation. Funding for other activities, such as upgrading the leachate collection system, will not come from the $2 million appropriation Mr. Kelly advised. Jim Warren said that we need to make sure that we have accountability. Mr. Lancaster advised that the NER will ca11 Mr. Kelly in late February, early March to show what has been done with the $2 million. County Contract Mr. Kelly advised he has sent through for a new contract with the county. He has talked with the County Manager about staff, what the Working Group needs and expects from staff.
