Lofton, Secretary Department of Environment, Health & Natural Resources Raleigh, North Carolina Re: PCB Land Fill Agreement -Warren County Dear Secretary Harrelson and Secretary Cobey: On June 15, 1990, the environmental permit under which the PCB landfill site is operated was issued to the Department of Administration. This department has agreed to assume managerial responsibility for the site with the Department of Environment, Heal th & Natural Resources providing technical assistance and the Department of Transportation providing maintenance. The mutual responsibilities of our departments have been previously discussed. The purpose of this letter is to set forth those responsibilities in writing. The responsibilities to be performed by each department are as follows. Department of Transportation 1. Mow landfill grass as needed. 2. Maintain existing structures such as fences, roadway, and entrance gates. 3. Incorporate the expenses to perform all of the above tasks into the operating budget of the Department of Transportation. Department of Environment. Health and Natural Resources 1. Report to the Department of Administration any malfunctions or irregularity in the operation and performance standards of the PCB landfill. 3. Provide technical assistance to the Department of Administration on future projects necessary to maintain the integrity of the landfill site. 4. Inspect and test privately owned wells within one and one-half mile radius of the landfill site, upon special request from the owners of the wells. 5. The Department shall include in its operating budget funds to monitor, inspect, and report on the landfill site. Department of Administration 1. The Department of Administration shall supervise the management and operation of the landfill site. 2. Any additional construction or activity at the landfill site shall be approved by the Department of Administration. 3. The Department of Administration will be re- responsible for any future expenditure of funds to improve the landfill site. These funds will include, but not be limited to fencing the lagoon, replacement of wells, and replacement of irrigation pumping equipment. Please indicate your approval to this agreement by signing below.
