8 • The grant rules governing cooperative agreements allow for the State
to request reprogramming of funds when appropriate. If the State and EPA
detei..nine that i•nsuf f icien t funds or hours were budgeted in the initial
award to properly complete the proposed activities, priority for the
remaining funds will be given to completion of the preliminary assessments
contained in the State's workplan. Second priority will be given to site
inspections. (See 40 CFR Part 30, Subpart E for procedures to rebudget
funds.)

Division for Headquarters awards and to the appropriate Grants Administrations Office for State a.ad local

Receipt of a written refusal or failure to retam the properly executed document within the prescribed time, may
result in the withdrawal of the offer by t.he Agency. · Any change to the Agreement by tbe recipient subsequem

which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CF'R
Chapter I, Subpart 3. The recipient warrants, represents, and agrtts that it, and its contractors, subcontractors,
employees and representatives, will comply with: (1) all applicable provisions of 40 CFR Cnapter I, Subchapter B,
' !NCLUDING BUT NOT LIMITED TO the provisions of Appendix A to 40 CF? Part 30, and (2) any special
conditions set forth'. in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425.

1. The $3,000 for office refurnishing and $3,000 for printing for public
consumption identified in the State's application is not an allowable
espenditur~ of the 3012 funds. Nith these funds ' the State shal~ per-
form four or five more site inspections.
2. EPA is making available to State oourses on preliminary assessrrents and site in-
spections .. State errployees performing 3012 "w:)rk must attend these oourses \IDJ.ess
the EPA Regional Project Officer dete.r:mines that the State errployees hav-e already
received the appropriate training. The costs associated with attending these
courses is allc:wable tmder t..""le 3012 program. After corrpleting the EPA si:onsored
training courses,· the EPA project officer will determine if it is appropriate for
the State to attend the University of Arkansas course.
3. In accordance with the EPA 3012 guidance, is~ued on Marc.>-i 8, 1983, (p.20) the
preliminary assessment and site inspection info.nration that the State prepares will
include a narrative discussion as well as the appropriate EPA 2070 forms. The
3012 Regional Project Officer (RPO) will assist the State in developing a standard
rei:ort fo:c:mat.
4. In accordance with EPA 3012 guidance (p. 20) the 3012 Regional Project . Officer
shall have the opportunity to review_ and corrrrent on all site rei:orts. The first
-objective of t.1-ie EPA review will be to ensure cor>.sistency with EPA-developed rei:orts
for similar activities .. A second objective of t.'f-ie EPA review w"ill be to establish
consistency bet~ EPA and the State i...-1 determining the need for fu.r-'"J-ler action.
The State will submit, when requested by the P.egional Project Officer, a revisec.
f inal site rei:ort that considers the Region's corrrrents.

8 • The grant rules governing cooperative agreements allow for the State
to request reprogramming of funds when appropriate. If the State and EPA
det~rmine that insufficient funds or hours were budgeted in the initial
award to properly complete the proposed activities, priority for the
remaining funds will be given to completion of the preliminary assessments
contained in the State's workplan. Second priority will be given to site
inspections. (See 40 CFR Part• 30, Subpart E for procedures to rebudget
funds.)

Division for Headquarters awards and to the appropriate Grants Administrations Office for State and local
awards within 3 calendar weeks after receipt or within any extension of time as may be granted by EPA.
Receipt of a written refusal or failure to retum the properly executed document within the prescribed time, may
result in the withdrawal of the offer by the Agency. · Any change to the Agreement by the recipient subsequent
to the document being signed by the ·EPA Award Official which the Award Official determines to materially
alter the Agreement shall void the Agreement. · .
