Clark, Secretary March 31, 1983 MEMORANDUM TO: FROM : RE: Gary Pearce -Office of the Governor Bob Jansen -°!,f()ce of the Governor Bill Phillips~ Warren County PCB Landfill PR 5 On March 21, ?.2, and 23 , Miss Michelle Grasso and Mr. Jeff Heil of the General Accounting Office in Washington, D.C. were in North Carolina investigating the site selection process of t he landfill. This had been requested by Congressman Florio and Delegate Fauntroy and a copy of this letter of request is attached. The two stated that this was one of four landfills to be investigated in EPA Region IV and thn t the need for investigation of landfills in other parts of t he U. S. would be decided after this pilot project. At 1:30 p.m. on March 21, these two repres entatives met with Secretary Clark, Deputy Attorney General Ike Avery, 0. W. Strickland, Russ Edmonston and cme. Following this meeting, I made my complete landfill project file available to them and provided copies of several documents requested. On the morning of March 22, Miss Grasso and Mr. Heil visited the landfill in Warren County and met with County Health Director Joe Lennon. Returning in the afternoon, they reviewed the project files in the OHR office of 0. W. Strickland. On March 23, since I was in Warren County District Court on the Ken Ferrucio matter, the two met with Russ Edmonston to brief him on their visit. They said that noth ing had been found to indicate anything other than normal procedures were followed in the site selection process. They said further that an oral report would be made to the committee and that no written report was anticipated. I pass this along to you as a matter of information. Of particular concern are .Jroblems of uncontrolled and illegal disposal, and the siting and Jperation of hazardous waste facilities. \ recent illustration of these concerns occurred in Warren County, ~orth Carolina, where a new land disposal facility was constructed to .:ontain the contaminated soil from a statewide PCB spill. :n light of the concerns that have been raised by the residents of farren County, and given other information that has been received -egarding the:location of other hazardous waste sites, we are request- ,_ng that GAO conduct an investigation of !_he extent to which the .ocations -0~ hazardous -waste £acilities ,· p~icular1.1--l_an.df_:~J?-~, · :orrelate with the racial and socio-ecopomic status oT tne neighboring :ormmmities. be investigation should include an examination of the following ·actors: +the location of existing on-site and off-site interim status hazardous waste landfills; +a racial and socio-economic charaterization of the neighboring populations to such facilities; +a quantitative correlation between the location of these facil- ities and the racial and socio-economic makeup of the surrounding population; +the extent to which the public participation requirements of the Resource Conservation and Recovery Act (RCRA) have been observed during the permitting process, generally; and PLEASE RESPOND TO . ··-.. +the imoact of the Environmental Protection Agency's class permit proposal on the nature and level of public participation in the permitting process.
