PCB Restraining Order Continued
The North Carolina Department of Transportation today co~sented to a contin-
uation of the Temporary Restraining Order entered on September .2O, which restrain-
ed state officials from temporarily storing soil contaminated with PCB's at a High-
way Maintenance site just west of Warrenton. The restraining order was entered as
a result of a suit brought by the town of Warrenton alleging that the site was unsafe.
W. A. Raney, Jr., Special Deputy Attorney General who represents the state in
this matter,stated that the state agreed to the extension of the Temporary Restraining
Order in order to have more time to negotiate a settl~ment wit~.the town.
"At this point, negotiation centers on finding an alternitive site which meets
the safety criteria of the state and satisfies the town's objections," David E. Kelly,
Assistant Secretary for Public Safety, Department of Crime Control and Public Safety,
said. Kelly is coordinating the state's efforts to clean up and dispose of the PCB's.
"We are convinced that the Department of Transportation Maintenance Yard is a
very good site, and we are hoping to either convince the town of this or to find
· another site suitable to everyone concerned," said Kelly.
Raney added that if a settlement is not reached soon, the state intends to press
for a quick determination of the pending suit. The complaint was scheduled to be heard
at 9:30 a.m. this morning in Warrenton.
