Dear Mr. Malaney:
This has reference to your letter dated March 30, 1981, addressed to
Mr. Tom Bradshaw# .Secretary of Transportation, which has been forwarded
to this Division concerning regulations in regard to transportation of
PCBs and hazardous waste.
The State of North Carolina has received interium authorization from
EPA to administer the Resource Conservation and Recovery Act and does
require compliance with the manifest system for transportation of hazard-
ous waste.
Polychlorinated Biphenyls (RQ-10/4.54) is listed under the hazard
class of ORM-E with transportation identification number UN2315; in
CFR 49, Section 172.101 as amended on Page 34633 of the Federal Register
dated May 22, 1980. Also, CFR 40, Part 761 provides certain requirements
for containers, marking, storage and disposal of PCBs.
Any carrier providing for-hire transportation through or within the
State of North Carolina is required to register its operation with the
North Carolina Utilities Commission. This Division will furnish regis-
tration forms for the type of operation involved.
Fuel permits may be obtained from the North Carolina Department of
Revenue, Gasoline Tax Division, P.O. Box 25000, Raleigh, N. C. 27640,
Phone (919) 733-3401.
Copies of the North Carolina hazardous waste manifest may be obtained
from Solid & Hazardous Waste Management, North Carolina Department of Human
Resources, P. o. Box 2091, Raleigh, N. c. 27602, Phone (919) 733-2178.
Pursuant to G. S. 62-281 of the North Carolina General Statutes and Rule
R2-46 of the North Carolina Utilities Commission Rules and Regulations,
this Commission has adopted the rules and regulations of the U. S. Depart-
ment of Transportation relating to safety of operation and equipment (49
CFR Parts 390-398) and rules and regulations relating to hazardous

materials (49 CFR Parts 170-190) which apply to for-hire motor carriers
engaged in either interstate or intrastate commerce over the highways of
the State of North Carolina. These regulations also cover any transpor-
tation of hazardous waste. These publications may be purchased from the

Re: Request for general information and state manifest
requirements
1. Does your state require compliance with the RCRA manifest
system for transportation of PCBs as defined by the US EPA?
2. Does your state utilize a separate manifest applicable to
the transporation of PCBs?
Please provide copies of your state manifest used for RCRA
classified hazardous wastes. If your state has any additional
transportation permit requirements or special hauling regulations
please include these with your reply.
