At today's meeting of the N. C. Capital Building Authority, your firm
was tentatively selected to provide professional design services in
conne ction with the above referenced project. Execution of a design
contract with your firm is subject to reaching acceptable terms with
the Division of State Co nstruction regarding your fee, schedule of s u b-
mittals, consultants and complete unde rstanding of your responsi bilities
as set forth in the desig n contract.
Will you pl e ase submit the following info rmation to C. Carlton My rick ,
Administrator of our Contracts and Budge t Control Office:
(1). Lump sum f ee for professional s e rvice s
(2) Names of your consultants
(3) Schedule of dates for submission of: Schematics, Desig n
De velopment, Working Drawings, and Estimated Bid Date
Once the above is received, the Division of State Construction will con-
side r this information and will make a r e commendation regarding final
selection of your firm to the Capital Building Authority at thei r next
meeting·. Upon confirmation of final selec tion by the Authority , a de-
sign contract will be executed.
If you have any questions rega rding the preparation of your proposal,
please contact Mr. Myrick. We look forward to hearing from you soon.

site preparation activities on the land

determine pertinent characte ristics
of the land may be conducted) ... "
As you can see the language is not v ery specific and
could cause problems with activ ities such as surveys. The
question of whether a survey is a test to de t e rmine land
characteristics or whether it is a site pre paration activ ity
is debatable. In the future it would probably be wise to
inform Warren County of any activities we plan to undertake.
Another item of concern is a Supplemental Complaint
filed by Warren County alleging that the Fina l EIS is de-
ficient in certain respects. I hav e attached a copy of the
supplemental complaint for your revie~. The complaint al-
leges inadequate design detail as well as inadequate response
to comments submitted by Warren County. The supplemental
complaint will probably be allowed in which case the State
will have a short period of time to file a r e sponse. I will
be in touch with you concerning the appropriate course o f
action.
I suggest that a copy of this me mo be given to the con-
sultant but that it otherwise be kept con f i dential as an
attorney/client communication.
