On January 3, 1989, Hazardous Waste Branch began clean-up operations at the old
FCX warehouse facility located on Grimes Road west of Washington. The clean-up
involves a pit excavated behind the FCX warehouse, of which pesticides were
disposed of over a period of years. This site was placed on the Superfund
National Priority List in June 1988.
If I recall correctly, around December 1986; representatives from the EPA and
the Hazardous Waste Branch visited the site to conduct an assessment. I believe
soil and water samples were collected at that time.
According to the information, the pit is approximately
wide; and maybe as much as eight feet deep in places.

Re: "Superfund site" at old FCX dump, Washington, NC.
Dear Paul:
The Pamlico-Tar River Foundation has been concerned by the
recent findings of Stan Riggs (ECU) which indicate
concentrations of several heavy metals in the sediments of
Kennedy Creek. There are at least four potential sources
for these contaminants, including the discharges at National
Spinning and the Washington municipal wastewater treatment
plant, an abandoned city dump that underlies the National
Spinning property and the superfund site at an abandoned FCX lump.
We have been distressed by the comments of the EPA emergency
personnel at the site. They implied a relatively casual
attitude regarding the potential for ground or surface water
contamination, Considering Riggs' findings, and DMF
evidence of fish disease problems in the same locality, an
immediate ~ssessm~nt of the pbtential connection between the
site and the Creek seems imperative. A similar assessment
of the connection between the old city dump a~d the creek is
also necessary.
The EPA, in all probability, will not undertake such a
iroundwater assessment before the remedial investigation
stage which would not be before 1 to 5 years. We're
delighted to have the site cleaned up; however, we feel that
its connection to the local water problems should be
explored immediately, not in a few years.
Please let us know if the state can do anything to answer
these concerns.

FCX -washlngton is located at the intersection of Grimes Road
(SR 1402) and Whispering Pine Road (SR 1404) in Washington, Beaufort county,
North Carolina 27889. The latitude is 35° 32' 36" and· the longitude is
077° 04' 27" .. The site, approximately eight acres in size, lies just to the
west-northwest of Washington city limits. The Tar River is less than one mile
to the south. About 11350 people live within three miles of the site, 2850 of
whom obtain their water supply from private or community wells. In the early
1970s, a trench approximately 12 feet by 250 feet by 10 to 12 feet deep was
dug and filled with waste pesticides, herbicides, and other agricultural
chemicals. Samples of the surface soil from the trench area showed
~oncentrations of various hazardous constituents, including Chlordane, Aldrin,,
DDT, DDE, Dieldrin, carbondisulfide, hexachlorobenzene, naphthalene,
phenan th rene, acenaph thy lene, fl uorene, dibenzof u ran, 2-methylna.ph tha lene, and
mercury. These chemicals may move into the groundwater of the Post-Miocene
surficial aquifer which, together with the Miocene Yorktown aquifer, locally
recharges the underlying castle Hayne aquifer. The Castle Hayne aquifer,
which top surface is about 30 feet below land surface at the site, is the
major water supply aquifer for wells in the vicinity •
. The site, owned by FCX, Inc., 609 st. Marys Street, Raleigh, NC 27602
from 1945 until 1986, was used for repackaging and sales of herbicides,
pesticides, and other farm chemicals. In the summer of 1986, the facility was·
sold to Fred Webb, Inc., P.O. Box 158, Greenville, NC 27834. The warehouse
on-site is to be used for grain storage. There have been no known remedial
actions to date; however, FCX, Inc. has employed Rose and Purcell, ·Inc. and
GSX to study on-site contamination and to recommend clean-up procedures for
the burial area and the warehouse.

BACKGROUND
Location
The FCX -Washington sit_e is located in the west quadrant of the
intersection of Grimes Road and Whispering Pine Road (SR 1404) in Washington,
Beaufort county, North Carolina 27889. The latitude is 35° 32' 36" and the
longitude is 077° 04' 27" (Reference 12).
Site ·Layout
The FCX Distribution Center property is approximately eight acres in
size and is bordered on the northeast by a railroad, on the southwest by a
wetland leading to the Tar River, on the northwest and southeast by
agricultural land. Land and buildings belonging to National Spinning Company,
a large textile manufacturer, lie to the south and southeast. On the FCX site
is a large warehouse with an adjoining tank farm (Reference 20 & 21). The
site of the chemical burial lies about 200 feet southwest of the warehouse. A
private well belonging to Cleon La~ham is.about 585 feet east of the trench
site and three wells owned by National Spinning are north, east, and west of_
the site approximately 450-to 1100 feet away from the burial area. surface
drainage from the site is southwest toward the wetland and southeast toward a
drainage ditch (Reference 17). Primary population areas in the vicinity of
the site are northwest and southwest along Grimes R_oad (Reference 12).
ownership and Site Use History
The site was owned by FCX, Inc., 609 st. Marys Street, Raleigh, NC
27602 from 1945 until 1986. The facility was used for the repackaging and
sale of herbicides, pesticides, and tobacco treating chemicals. wastes from
the operations were handled from late 1945 until 1985. About 1970, some
wastes were buried in a trench on-site. In the summer of 1986, the facility
was sold to Fred Webb, Inc., P.O. Box 1?8, Greenville, NC 27834. Apparently,
the warehouse is to be used as a grain storage building.
Permit and Regulatory History
There are no environmental permits known to have been issued nor has
there been any environmental regulation of the site.
Remedial Actions to Date
FGX Inc. has employed the engineering firm of Rose and Purcell, Inc. to
help study on-site contamination. Also, FCX Inc. has employed GSX to clear
the chemical warehouse and to recommend remedial action concerning the buried·
wastes.

Inc., just prior the site investigation. Letters confirming approval to
conduct the site investigation were received from William H. McCullough, legal
counsel for FCX, on behalf of both FCX and Fred Webb. Additional consent
letters for inspecting, sampling, and photographing the site were signed by
Fred Webb, President of Fred Webbj Inc., and by J. Stewart Hodges, Vice
President of FCX. This was to insure full approval for the site investigation
during the ownership transition.

The purpose of the investigation and the -preliminary sampling plan were
explained to all present. Holladay and Nicholson conducted a brief walk-over
of the site to re-appraise the sampling plan. It was found that GSX had used
a back-hoe to explore segments of the burial trench and an additional
previously unidentified burial area. The sampling plan was modified utilizing
the new findings to include sampling of the contaminated soils raised by the
ba·ck-hoe from the burial spots, as well as sampling from the warehouse
transfer areas, Mr. Lath.am's well, the adjacent drainage ditch, and the
background soil and groundwater areas.
Background-soil samples and drainage ditch samples were taken in the
area of Mr. Latham's ·home adjacent to the FCX property. Holladay and
Nicholson donned protective equipment and entered the trench area where some
substances suspected to be pesticides and other agricultural waste were
exposed. A HNu meter ·was used to scan the site for volatile organics. None
were detected at concentrations above background levels •. The odor on site was
like that at a garden supply store. A light wind swept the area to minimize
the exposure. Thus, tyvek suits and boots with no respiratory protection was
deemed saf~ as specified by the safety guide. Sampling was done from 11:59 to
16:40 hours on 26 August 1986. Seven soils samples, four groundwater samples,
and one sediment sample were taken. Background soil and ground water sample
were included in this number. three groundwater samples were taken from· the
deep wells adjacent to the FCX site which are operated by National Spinning.
All sampling was done following a standard sampling protocol and a chain of
custody for each sample was established on-site. Sketches and photographs
were·made before and during the sampling activities.

Topography
Reference 12, the USGS 7.5' Topographic maps, form the basis for this
section. The Site Sketch (Reference 21) shows a larger scale view of the
layout of the site. The Map· Showing surface water Flow Path (Reference 17)
shows the slope of the site as less than 31 and the slope of the intervening
terrain between the trench area and a small area of Kennedy Creek to be less
than 1%.

The closest.downslope water body is Kennedy Creek which flows
southeastward into the Tar River. At the US 17/264 bridge across the river,'
the Tar River becomes the Pamlico River. The river flows southeastward into
the Pamlico sound. Kennedy creek and the Tar River are classified as Class C
waters which best usage are "fish and wildlife propagation, secondary
recrea~ion, agriculture and other uses requiring waters of lower quality'.
The Pamlico. River is denoted as Tidal salt water and classified as Class SC
waters which best usage are 'fish and wildlife propagation, secondary
recreation, and other uses requiring waters of lower quality" (Reference 22).
Geology, Soils, and Groundwater
The site lies in the NC coastal Plain and is underlain by sedimentary
formations consisting of sand, silt, clay, shells, limestone, and combinations
of these lithologies. These sediments may be divided into three main
hydrogeologic units, or aquifers, based primarily on hydraulic conductivity
and other bydrogeologic characteristics. The aquifers, from the surface
downward, are: the Post-Miocene surficial aquifer or water-table aquifer
comprised of sand, silt, shells, and some clay; the Miocene age Yorktown
aquifer composed of interbedded sands and clays with some shells, and the
Eocene age castle Hayne aquifer composed mainly of shell limestone
(Reference 1).
In the area within three miles of the site, there are no extensive
confining units separating the three aquifers. Instead, the relative
hydraulic conductivities of the three units are the controlling factors in
groundwater movement. The hydraulic conductivity of the castle Hayne aquifer,
roughly 10-1 cm/sec, is 6 to 10 times greater than those of the Post-Miocene
surficial and Miocene Yorktown aquifers, which are about 1.7 x 10-2 cm/sec.
Therefore, the castle Hayne aquifer operates under semi-confined conditions
and is locally recharged from the two·overlying aquifers (References 1,4,8).

Hayne is typically 5 to 10 feet below land surface, which is only slightly
lower than the surficial aquifer's water table of 5 feet below land surface
(References 3 and 4). Water and contaminants move from the land surface
downward, slowly through the Post-Miocene surficial aquifer and the Miocene
Yorktown aquifer into the castle Hayne aquifer.

The site lies in a commercial-residential corridor about 1800 feet west
of Washington, a city of about 8500 people. Agricultural fields border the
site on the northwest and southeast and a wetland, approximately 180 acres in
size, lies between the site and the Tar River. Washington Park, a town of.
about 500 people lies 3 miles southeast of the site. The Tar and Pamlico
aiv~rs, bordered by extensive wetlands, lie south and southeast. Within three
miles.of the site to the west, north, and northwest are rural areas-with most
land in agricultural use. Tranters Creek flows from the northwest and enters
the Tar River abou~.1/2 mile upstream of the site. Both surface water intakes
for the city of Washington are on Tranters creek (References 12 and 13).

information about public and private water systems, and on an estimation of
the percent of the city of Washington within each radius of the site. Within
one mile of the site there are 994 residents, 850 using surface water from the
washington distribution system and 144 using private wells. Three industrial
wells, belonging to National Spinning company, and one surface water intake
for the city of Washington are within one mile also. Between one and two
miles of the site are about 6016 residents, 5100 of whom use city water, while
the rest use private wells. Between two and three miles of the site are 4340
residents, 2550 of whom use groundwater while the rest use private wells.
Three private groundwater supplies, Flanders Filters, Shad Bend Subdivision,
and Trails End Mobile Home Park, are between two and three miles from the site
also. The population served by these supplies is included in the 4340
residents. In total, within three miles of the site are 11350 residents, 8500
of whom are supplied by the city of Washington water system and 2850 of whom
use groundwater.

There are no federally designated critical environments within five
miles of the site. However, a freshwater wetland approximately 275 acres in
size lies adjacent to the Tar River and Kennedy Creek. It begins about 300
feet from the trench.area (Reference 12 ind 19).

In a telephone conversation (Reference 5) with Harry Holladay of the
NC solid and Hazardous waste Management Branch CERCLA Unit, FCX Vice President
J, Stewart Hodges explained that, in about 1970, a burial of ~esticides,
herbicides, and tobacco sucker control agent (MH30) occurred on the site. A
trench about 12 feet by 250 feet was dug 10 to 12 feet deep and intercepted
the water table. TWO to three feet of soil were put back into the trench and,
then paper· and plastic bags and jugs of wastes were put into the trench.
Based on observations during the site inspection it appears that the trench
was then covered with about two feet of soil. The quantity of wastes is not
known but can be estimated as 555 cubic yards based on trench dimensions of 12.
feet by 250 feet by 7 feet deep.

1988, on November 30 and December 1, 1988 our client, acting under
the supervision of Law Environmental, Inc. , will install a six foot
high chain link fence outside the p~rimeter of the trenches in
which FCX, -J:nc. may have deposited materials upon this property.
This fence will enclose and restrict all access to the entire
trench area. The area enclosed by the fence will include
approximately two acres. Also on November 30 and December lour
client, again acting under the supervision of Law Environmental,
Inc., will install a 40 mil. black visqueen cover over the entire
area enclosed within the fence. The visqueen cover will be
appropriately anchored, and vegetation will be removed'. as
necessary to install the visqueen, by bush axe.

This will acknowledge receipt of and respond to your letter of
December 9, 1988.
As indicated in my letter of December 7, 1988 and, as well, in the
transcript of the December 5, 1988 conference, the situation at·the
FCX Washington site warrants further investigation and the careful
development of a plan for remediation or removal, not immediate
excavation and removal. Except for several samples taken directly
from the burial trenches constructed and used by FCX, no sample of
any material taken from (or in the vicinity of) the site, when
analyzed, has revealed any detectible pesticide contamination. · No
sampling or analysis has been accomplished to ascertain whether
( and, if so,· to what extent) substances buried by FCX in the trench
.might have migrated. No sampling and analysis plan by which to
delineate, before excavation, the extent of contamination or
groundwater monitoring plan have been prepared or implemented.
And, no site safety plan has been developed or implemented.
The substances buried by FCX are presently contained. There is no
indication that the substances have migrated from the outer
perimeter of the FCX trenches. Access to the entire trench area
has been restricted by the installation of a 6' high chain link

fence around the entire perimeter. The potential for atmospheric,
surface water run-off and groundwater contamination through
vertical migration have all been abated and mitigated through
-installation of an impermeable plastic barrier which extends ten
feet bey6nd the outer perimeter of the entire trench area.
Excavation of the substances buried by FCX without carefully
preparing and implementing plans for removal and storage on site,
as apparently contemplated by the Agency, will probably result in
further release of the substances and in contaminating air, soil
and water which are not presently affected.
Fred Webb, Inc. is now operating a grain storage warehouse on the
FCX Washington site within 200 feet of the FCX burial trenches, and
this warehouse is filled to capacity. Kennedy Creek, a tributary
to the Tar River, is located approximately 1,000 feet from the
trenches. Several families reside in homes adjacent or near to the
site. The surfical aquifer at the site is located approximately
ten feet below the surface of the ground. Excavation without
careful development and implementation of proper control procedures
and further release and contamination will obviously create a
serious risk of loss, damage and injury. ·
On September 30 and October 1, 1988, the Agency, apparently without
first developing or implementing a proper plan or procedures,
obtained samples from. the FCX burial trenches. Borings were made
by the Agency to a depth of approximately six feet; samples were
obtained; and, the Agency abandoned the boring holes without
caulking or filling. All samples of groundwater taken before then
had indicated -that no detectable groundwater contamination had
occurred. By abandoning the holes in this manner, the Agency
significantly increased the risk of release into (and contamination
of) groundwater. This illustrates the inherent risk of proceeding,
as contemplated by the Agency, without careful development and
implementation of appropriate plans and procedures.
On November 14, 1988, the Agency, after determining that the FCX
Washington site presents a threat to public health or the
environment, issued an Order requiring Fred Webb, Inc., among other
things, to ·secure the site and to develop for submission to the
.Agency sampling an analysis and site safety plans. Even before
that Order was issued, Fred Webb, Inc. had taken action to secure
the site and had retained Law Environmental, Inc. to begin
examining the site and developing these plans. Since receiving the
Order, Fred Webb, Inc. has fully complied with its provisions by
completing actions to secure the site and thereby abating the
"threat of direct public contact with trenches" and by continuing
to develop through Law Environmental, Inc. appropriate sampling and
analysis and monitoring plans. As indicated in the transcript of

the conference on December 5, 1988 and in my letter of December 7,
1988 -unless the Agency instructs Fred Webb, Inc. to cease
compliance or implements removal action before then in accordance
with your letter of December 9, 1988 and Section 104 of CERCLA -
these plans will be submitted to the Agency for approval by
January 4, 1989.
However, we find the directly conflicting instructions from the
Agency regarding sampling and analysis to be confusing. The Order
issued by the Agency on November 14, 1988 specifically requires
Fred Webb, Inc. to prepare sampling and analysis plans. Yet, you
state in your letter of December 9, 1988 that preparation of these
plans is not even authorized by the Agency. These squarely
inconsistent positions taken by the Agency simply cannot be
reconciled.
It would appear from a reading of your letter of December 9, 1988
that the Agency contemplates immediate excavation and removal.
Presumably, the Agency is proposing to proceed without even
complying with the sampling and analysis and site safety plan
requirements set forth by the Agency in the· Order issued
November 14, 1988. This is neither warranted, nor appropriate
under the circumstances presented by the FCX Washington site.
These substances and contaminated soil at the site ought not under
any circumstance to be excavated, removed and stored on site until,
as a minimum, appropriate procedures are developed by which to
properly secure the impermeable plastic material which will be used
to contain and store the substances and contaminated soil, by which
to control potential atmospheric contamination during removal, by
which to properly sample and analyze material during excavation and
removal, and by which to control potential groundwater
contamination from surface water runoff and collection in the
excavated area. Without these procedures, it is very likely that
a release of substances, contaminating air, soil or water not
presently affected, will occur. To the . extent that actions
undertaken by or for the Agency lead to this result, they will be
directly adverse to public health and the environment and, as well,
patently inconsistent with the National Contingency Plan.
Moreover, the request for access to the FCX Washington site
contained in your letter has been issued by the Agency in an
obviously ar:bi trary manner. Despite refusal of the Agency to
confer on December 5, 1988, Fred Webb, Inc. has complied fully with
all of the requirements contained in the Order issued on November
14, 1988. Notwithstanding this compliance, the Agency has elected
to proce,ed under Section 104 of CERCLA and simultaneously refused

to rescind the Order which was issued under Section 106. It is
inherently inconsistent for the Agency to seek access for purposes
of removing within ten weeks the substances buried by FCX and to
slmul taneously require Fred Webb, Inc. to remove the very same
substances.
Notwithstanding these observations and compliance with the Order
issued by the Agency on November 14, 1988, without accepting
responsibility for any action undertaken by or for the Agency or
for any loss, damage or injury that might be caused by such action,
and without waiving objection and challenge to the propriety of any
action proposed or actually undertaken by the Agency, Fred Webb,
Inc. will consent to providing the Agency with access to the FCX
Washington site for· the purposes stated in your letter of December
9, 1988. In consenting to provide the Agency with access to the
FCX Washington site, Fred Webb, Inc. will expect that all actions
undertaken by the Agency will be carefully planned and monitored
to avoid causing any loss, damage or injury to Fred Webb, Inc. and
that all actions undertaken by the-Agency will not be inconsistent
in any respect with the National Contingency Plan. Also, upon
initiation of the action described in your letter of December 9,
1988, the Agency will, of course, effectively revoke the
Section 106 Order issued on November 14, 1988.
Insofar as actions proposed or undertaken by or for the Agency
pursuant to this consent are concerned, we must ask, on behalf of
Fred Webb, Inc., that the Agency provide us with copies of· all
plans, proposals, sampling and analysis data, logs, reports,
diaries, studies, contracts and other documents relating to these
actions, and we must further ask that this information be provided
to us in a timely manner so that we will have a reasonable
opportunity before any plan or action is implemented to participate
( through comment and suggestion) in any plan adopted or action
undertaken by or for the Agency. We· are particularly concerned by
Item 5 listed on the first page of your le.tter which is vague,
ambiguous and general, and while consenting to access so as not to
interfere with the actions contemplated by the Agency, we must ask
that the Agency immediately provide us with a more concise
description-of "any other tasks." Also, we must ask that all of
. this information, including any comments or' suggestions we might
offer, be included as a part of the administrative record relating,
to this matter. ·
We have already advised the Agency that it is our position that
Fred Webb, Inc. has been fraudulently induced to take ti_tle to the
FCX Washington site; that FCX, Inc., which transferred title to

Fred Webb, Inc., · has failed to satisfy a condition which is
material to that transfer;. and, that we have instituted a lawsuit
seeking to rescind the transaction by which title has been
transferred to Fred Webb, Inc. The Agency should clearly
understand that if the transaction is rescinded and title reverts
to FCX, Inc. while the Agency is involved at the FCX Washington
site in any of the activities described in your letter of
December 9, 1988, the consent of Fred Webb, Inc. will be terminated
and without effect. The Agency should act accordingly with respect
to obtaining consent from FCX, Inc.
Although we still have not yet received a copy of the documents
which we have requested and which are contained within the present
administrative record and notwithstanding that the Agency refused
to actually confer with us on December 5, 1988, we reiterate that
we would very much like to have an opportunity to confer with the
Agency regarding this matter. However, unless the Agency is able
before any such conference to produce for our review and evaluation
all of the documents contained in the administrative record, we
will be at the same substantial disadvantage as we were on
December 5.
In the interest of time, this letter is being sent to you by
Telefax. As indicated in our telephone conference of December 13,
1988, we have discussed the matter with our client and, we
understand, obtained the consent expressed herein. We will be
obtaining our client's signature on December 14, then forwarding
the fully signed original to you by express mail.
Please include this letter as a part of .the administrative record
and do not hesitate to contact us if you have any questions
concerning the matters addressed in it.

The laboratory results for air sampling for pesticides conducted by Bill
Pate, PE, CIH and I on October 21, 1988 at the propose·d Charlie Tom's
Restaurant (located at the old FCX property on Grimes Road in a building
currently owned by the Gerard Company and leased by Larry Picard) indicated
only trace levels of one insecticide, chlordane.
We ran portable air samplers in tandem in three locations to determine
residual air levels of pesticides in the facility. The locations were 1)
adjacent to front entran'ce, 2) kitchen area, 3) south west corner of dining
area. Results were:
Location 1 -. 10 ug·Chlordane/m§
Location 2 -.05 ug Chlordane/m3 Location-3 -.14 ug Chlordane/m
These levels are·quite acceptable ~s the National Academy of Sciences (NAS)
safety guideline allows up to 5.0 ug/m chlordane for long-term residen3ial ·
exposure for this compound and the Industrial OSHA standard is 500 ug/m.
Results for each of the sampling trains at each location were blindly identical
giving us great confidence in the validity of these findings.
Our conclusion, based upon our testing, our review of the clean-up
procedures and construction remedies, and the proposed operation is that a
restaurant operation would not be hazardous from the standpoint of pesticides
formerly stored at this facility.
As explained at the site visit and by phone conversation to both you and
Mr. Picard, we do feel that the construction remedies we suggested near the
front entrance-way to reduce odor would be in the best aesthetic interest of
the business.

information.
The r"'.C{ facility in Statesville, NC, land and buildings, is still
owned by FCX, Inc., Debtor and Debtor-in:-Possession. Space in· the warehouse
is being leased, 30 days at a time, to Rubbermaid for raw material storage.
There is no contamination study or remedial acti_on in progress at the site.

The FCX facility in \-lashington, NC 11as sold in two parcels and no part
of the site is presently o.-med by FCX, Inc. In August 1986, Fred Webb, Inc.
of Greenville, NC bought the main warehouse and four acres of land. The
pesticide burial trench is contained on this four acre parcel. In August
1987 the remaining t1-.'0 acres containing a block building and another small
building were sold to \-1.B. Gerard and Sons, a fertilizer distributor next
door to the FCX facility. Tnere has been no additional site study or
remedial action at the facility since the site inspections by tl1e NC CERCIA
Unit in August and November 1986. Previously, GSX, Inc. l1ad cleaned the
block building, which was used for chemical storage, and had investigated the
contamination in the trench area. Tne warehouse was not cleaned.

I called Cleon Latham (919) 946-8216 and received his permission to
resample the ground water from his well.
I called.Ed Riddle on 14 Nov. 1~86 at National Spinning Company
(919)946-8111. He gave permission for the inspection team to take ground
water samples from the company wells surrounding the FCX site. He asked that
we stop by the plant before sampling and check in with him.

The FCX property in Washington, which includes tl1e area of
reported pesticide burial in a trench, was in the process of being
sold to Fred Webb, Inc., just prior to the site investigation.
Letters confirming approval to conduct the site investigation were
received from William H. McCullough, legal counsel for FCX, on behalf
of both FCX and Fred Webb. Additional consent letters for inspecting,
sampling, and photographing the site were signed by Fred Webb, .
President of Fred Webb, Inc., and by J. Stewart Hodges, Vice President
of FCX. This was to insure full approval for the site investigation
during the ownership transition. ·
On 26 August 1986 Harry Holladay and Grover Nicholson met
with the following at the site:

The purpose of the investigation and the preliminary sampling
plan were explained to all present. Holladay and Nicholson conducted
a brief walk-over of the site to re-appraise the sampling plan ... It
was found that GSX had used a back-hoe to explore segments of the
burial trench and an additional previously unidentified burial area.
The sampling plan was modified utilizing the new findings to include
sampling of the contaminated soils raised by the back-hoe from the
burial spots, as w~ll as sampling from the warehouse transfer areas,
Mr. Latham's well, the adjacent drainage ditch, and the background
solid and groundwater areas.
Background soil samples and drainage ditch samples were taken
in the area of ~Ir. Lathan's home adjacent to tl1e FCX property.
trf"')Ch area where some substances suspected to be pesticides and other
a/ ~.1cultural wastes were exposed. An HNu meter was used to scan the·
si'te for volatile organics. None were detected at concentrations
above background levels. The odor on site was like that at a garden
supply store. A light wind swept the area to minimize the exposure.
Thus, Tyvek suits and boots with no respiratory protection was deemed
safe as specified by the safety guide. Sampling was done from 11:59
to 16:40 hours on 26 August 1986. Seven soil samples, four
groundwater samples, and one sediment sample were taken. Background
soil and ground water sample were included in this number. Three
groundwater samples were taken from the deep wells adjacent to the FCX
site which are operated by National Spinning. All sa1npling was done
following a standard sampling protocol and a chain of custody for each
sample was established on-site. Sketches and photographs were made
before and during the sampling activities.

scheduled a site investigation at FCX -Washington facility at 10:00 a.m. on
Tuesday, 26 August 1986 for EPA evaluation. We plan to meet with FCX

On August 26, 1986, Grover Nicholson and Harry Holladay, North Carolina
Department of Human Resources. (DHR), Division of Health Services, Environmental
Health Section, Solid and Hazardous Waste Management Branch, conducted a CERCLA
samplin·g investigation at the FCX -Washington facility in Washington, North
Carolina. Water samples were collected from four wells, and soil samples were
collected from eight locations on. and in the vicinity of. the FCX site. Steve
Hall, US-EPA, Environmental Services Division, conducted the oversight inspec-
tion.
The FCX contact at the facility was Mr. Stewart Hodges; Mr. Arch Purcell,
Rose and Purcell, Inc. (consultant for FCX) was also present.
SUMMARY
Grover Nicholson and Harry Holladay conducted the investigation in a
professional manner. All sampli.ng, sample handling, including identification,
record keeping and chain-of-custody procedures observed during the oversight
were generally acceptable.
FACILITY PROCESS
FCX -Washington is no longer in operation. ·It was an agricultural supply
distribution center which included the handling of pesticides and fertilizers.
No formulation of pesticides occurred at the facility.
SAMPLING TECHNIQUES AND SAMPLE HANDLING
The following observations were noted during the oversight inspection:
Prior to ground water sampling at the private well located adjacent to
the site (Lathem property), the water level and total depth was determined
properly. · New disposable surgical gloves were worn during this determination.

The static. volume of this well was also petermined correctly. When the
i.nvestigation was planned, DHR personnel intended to purge three volumes prior +-
to sampling the .well; however, they were misinformed as to the depth of the
well and the diameter o.f the well casing. (The well was· deeper and the dia-
meter was 4 inches --not 2 inches). Therefore, because the well had been
sampled previously, it was determined to purge less than the three volumes
prior to sampling. A closed top, tefl0n_ 1:-.:iili::>r ¥1th new, unused nylon rope
was used to purge and ,;ample the well. Precautions were taken to be sure
that neither the rope nor the bailer touched the ground.

Soil samples were collected directly into the~. glass sample containers
with wooden tongue depressors which were ne...,, and unused but not 1precleaned.

OHR personnel indicated that the samples were mixed in the: laboratory prior ,(-
to analyses.
A minimum amount of information wa~ placed on the sample containers at
the time of sample collection. Subsequent information was added back at the
office prior to transferring the samples to the laboratory.
The intent of the sampling program was to sample from the least contaminated
area to the mOst contaminated area. However, site soil samples. were collected
before the off site industrial water supply wells.
Samples were not chemically preserved in the field since they are received 1:.---
in the state's laboratory within 24 hours of sampling. However, they were
refrigerated imoediately with ice.

All field documentation was maintained in a bound log book, and a receipt
for samples was presented to the Fcx· personnel and to Mr. Lathem at the con-
clusion of the sampling activity. Samples were securely maintained during the
inspection.
The bailer had been precleaned according to DHR's ·standard operationg pro-
cedure, also ESD's. procedure, and was wrapped in -aluminum foil. Precautions
were taken to prevent contamination of the bailer, bailer rope and sample
containers; However, plastic cubitainers used for m<<«ls and some inorganic
analyses were stored compressed and needed to be inflated prior to filling.
The method used by DHR was to .. blow .. into the container in order to inflate it. i::-
During discussions with DHR personnel, it appeared that there was a need (:-
for basic first aid and CPR for all field personnel. Suggestions were given
in that both the Red Cross and local hospitals can usually supply both courses.·
A checklist covering this oversight inspection is attached to this report.
RECOMMENDATIONS
Plastic cubitairiers should be inflated manually instead of blowing
into ther.i.

protocols should be preserved immediately .upon sampling, regardless
of the time lapse between sampl'ing and.analysis.

To preserve a sample's integrity, stainless steel spoons or spatulas
should be used instead of wooden tongue depressors. (Even if new and
unused, the tongue depressors could interfere with a sample I s inte-
grity, either through absorption or leaching).
Soil samples should be mixed prior to analyses in.the field if not done
in the laboratory. A cleaned, pyrex type glass cake pan is recommended
if done in the field.

A telecon on 16 July 1986 between H. Holladay, NC SHWNil .CERCLA Unit,
and Arch Purcell of Rose and Purcell (919) 323-3400, an engineering firm,
supplied the following information.
1. GSX quoted FCX a price of $573680 to remove 2000 cubic yards of
waste and associated soil from the approximately 25' x 200' x 4' trench.
2. The quote seems big to Purcell. He wants to soil test the trench
area using a grid system for sampling point location.
3. A judge will rule on final payment by FCX.

Enclosed please find the Preliminary Assessment report for the
subject site. This priority is based on review of available data. ' .
FCX Inc. is roughly an 8 acre'site located in Washington NC on
Grimes Road. The site was a farm distribution center for pesticides,
_herbicides, and tobacco treating products. Waste from these products were
handled from late 1945 to 1985. Apparently, about 1970, some of these toxic
wastes were buried on-site about 10 feet deep and 3 feet above the water table
in a 12' x 250' trench.
FCX is now in bankruptcy. A sale of the property to Fred Webb of
Greensboro, NC apparently is likely. GSX has been employed to dear the
chemical warehouse and to recommend remedial action for: the buried wastes.
FCX is .not a RCRA facility.
. Since substantial amounts· of a variety of toxic wastes are reported
buried on site and groundwater contamination is possible, it is recommended
that soil and possibly water sampling be conducted. Based on available
information, a medium priority for inspection is recommended for this site.

Mr. William McCullough (828-0S64) legal counsel for FCX in Bankruptcy
was contacted to arrange a site visit for 26 August 1986. Mr.· McCullough said
he could see no problems and would issue a letter to the concerned parties to
inform them. He noted that sale of the property was imminent to Fred Webb of
Greenville, NC, but that the new company owner was expected to be agreeable
since they also wanted any problems present to be cleaned up.
Mr. McCullough was told that Grover Nicholson of .this office and Steve
Hall of EPA would be part of the visiting team. Of particular interest was
the trench disposal area·where soil samples would be taken. Well water
samples may also be taken. Mr. McCullough said that the well.water had been
tested and found clear. A copy of the test results is to be sent here.
Mr. J. Steward Hodges, V.P. FXC (828-4411), was also contacted. The
site is about 8 acres in size. Information has been collected from a number
of sources to. define the on-site disposal of the early 1970s. An aerial
photograph shows the· trench to be about 12' x 2S0'. It appears that the
·french was dug to the water table and backfilled 2 -3 feet to an estimated
10' -20' below ground level. Pesticides, herbicides, and tobacco sucker
control (MH-30) materials are thought .to be buried in bags and jugs.
Residuals from the chemical building are being cleaned up GSX. GSX has been
told·about the trench material. They will develop a plan for the trench area.
FCX has a buyer for the warehouse which is considered -by them to be a
safe distance from the disposal area. The buyer, Fred Webb, knows of the
· disposal, and will be in agreement with our visit. Mr. Hodges, or another
representative, will be available to show us the disposal area, pwnp water for
a well sample if possible, and answer questions during our August 26 visit.
The well is not on FCX property but used under a special agreement
with the owner of that land. The well is about 200' from the warehouse toward
the road. It is about 60' deep. National Spinning has four wells nearby.
No mercury or methoxychlor compounds for seed treating are thought to
be on site.
Willy Hardinson of NRCD [(919) 946-6481} indicated that National
Spinning had wells designated numbers 8 and 9 w1der permit number 06-0047-WC.
These 8" wells are about 100 yards from FCX and are about 244' deep. The well
used by FCX was not shown in NRCD records.

Narrative: The site is described as being similar to FCX Statesville
in the Section 103(c) notification form submitted by William H. McCullough on.
ll JUi,e 1986. The facility is in Chapter 11 bankruptcy proceedings.
Materials which ·could include pesticides and heavy metals are allegedly buried
in-a 12' x 250' trench on-site. There is a well on-site which has been
repor~ed to be clear of contamination by a consulting firm. Mr. Stewart·
Hodges, Vice-President of FCX, Inc. (not contacted) would appear to have the
best company information relating to the site.
Soil contamination by pesticides and seed treating compounds (Hg) 1s
suspected. Potential for groundwater contamination exists. Residual
materials are located in the warehouse which are to be removed.

Dear Mr. ·Holladay:
This is to confirm our telephone conversation today whereby you
requested to make an on-site visit at the FCX Distribution Center at
Washington, North Carolina on August 26, 1986. You indicated that three
persons would be attending, namely, you, Mr. Grover Nicholson (a State of
North Carolina employee), and Mr. Steve Hall of the Atlanta office of EPA.
Certainly FCX has no objection and can arrange to have a person to
meet you and show you the area in which certain products were buried many
y·ears ago. As I remarked to you, by then we expect that most of the
property will have been conveyed by FCX to Fred Webb, Inc. of Greenville,
North Carolina. I presume there will be no objection by that· company,
inasmuch as it . is very interested in resolving any environmental problems
which may exist at that location. However, I shall request a definite
confirmation by that company by sending a copy of this letter to Louis
Gaylord, Esquire, the company's attorney.
This is further to confirm that I have requested our consulting
engineer, Mr. Purcell, to advise you of the results of the well testing done
earlier at the site. Mr. Purcell may also_ be present on August 26, although
that decision has not yet been finally made. In any event, I am sure that
you will have the complete cooperation of FCX's employees or representatives
in facilitating your visit to such site.
