(1) the waste first meets listing description (40 CFR 261.21, 22, 23, 24, 31, 32, 33(e)(f) contain listing descriptions_ Under this logic, the point of generation (or first opportunity to exhibit hazardous description and not after delivery to a treatment/disposal site) determines whether the waste is regulated as a hazardous waste. Two classes of hazardous waste There are 2 regulatory classes of hazardous waste. One is waste, from any source, that exhibits a defined characteristic(s) of ig~itability (40 CFR 260.21), corrosivity (40 CFR 261.22), reactivity (40 CFR 261.23) or extraction toxicity (40 CFR 261.24). This class of waste is hazardous due to a performance standard of exhibiting a characteristic that may cause human harm. This class is regulated as characteristic hazardous waste. The other class of waste are hazardous by a listing definition and are specific chemical entities or processes generating a specific chemical entity [40 CFR 261.31, 32, 33(e)(f)]. This class is hazardous due to known potential for human harm. This class is regulated as listed hazardous waste. ls concentration a factor in the determination of a hazardous waste? Neither class of waste requires a specific concentration to be a hazardous waste (except for extraction toxicity which is 100 x's drinking water standard). Characteristic waste are hazardous at any concentration that causes the waste to exhibit a desired characteristic. Listed waste are hazardous due to demonstrated toxicity to humans even at low concentrations, therefore, are considered hazardous at any concentration. For example, a human carcinogen is considered hazardous at any concentration (i.e. the mere existence at a detectable level). Jame~ B. Hunt, Jr/ Sarah T. When does a hazardous waste cease to be a hazardous waste? Waste with a characteristic ceases to be a hazardous waste when permitted treatment alters the waste so that it no longer exhibits a characteristic. Waste that is listed, even after treatment and includes treatment residues, remains a hazardous waste perpetually unless it is delisted. Delisting is a scientific analytical procedure that demonstrates that the waste either does not contain a specific hazardous constituent or the concentration of a specific hazardous constituent is of no harm or presents an acceptable non-hazardous risk (40 CFR 261 .3(c)(1)(2) & (d)(e); 40 CFR 260.20 & 22). Mixtures of waste Hazardous waste with a characteristic may be mixed with non-hazardous waste and be rendered non-hazardous and the resultant mixture is not subject to hazardous waste regulations. Hazardous waste which is listed waste and is mixed with a non-hazardous waste causes.the entire mixture to become a hazardous waste (40 CFR 261.3(b)(2)). Theoretically and legally, one drop of a listed hazardous waste added to water requires the mixture be regulated as hazardous. Practically this activity would be available for the deli sting procedure. Jadco Hughes relationship to this discussion? Waste on site contains hazardous constituents (benzene, methyl isobutyl ketone, toluene, xlyene, methyl ethyl ketone, naphthalene phenol, 2- chlorophenol, nickel, cadmium, chromium, silver, barium, and lead). Is the waste hazardous? Definite: The mobile tanker is hazardous waste due to lead content - can be rendered non-hazardous by mixing with concrete and landfilling. The waste does not exhibit~ other character- istic of hazardous waste (ignitability, corrosivity or re- activity) however, The other tanks contain hazardous constituents that if the constituents came from a listed process or hazardous waste, then the entire mass is a hazardous waste. However, we have no specific knowledfie that any of the constituents came from a listed waste or process. T 1s determination could only be made from knowledge of the waste streams prior to delivery to the site. If only one waste delivered to the site was hazardous and this waste was mixed, before or after treatment with the materials in the tanks, then the entire mixture is hazardous. • Dan Oakley Page 3 November 18, 1982 • • It is apparent that there were multiple opportunities (i.e. 20 to 30,000 55 gallon drums on site, site was operated for years, there are listed hazardous constituents, the process of distillation was suppose to have occurred on site and the residues from this recess is a listed hazardous waste for a listed hazardous waste to be mixed with the materials. This becomes significant when all it requires to demonstrate hazardous waste is one drop or one gallon from one listed process or listed waste being treated or mixed on this site. Our position c~n be one that with a reasonable degree of certainty the waste is hazardous and must be managed as hazardous waste, although this opinion would be based on probability. I would not hesitate to go before any jury with this argument or before a competent judge, Our position can be one that as the waste sits on the site now it is not ignitable, corrosive, reactive or EP toxic. Since we have no knowledge of the sources of waste or individual waste streams, we have no reason- able assurance that it is hazardous. Then it could be managed as a routine solid waste. I think this position is less defensible than the above position. However, for practical (problem solving) it is easier to handle the waste as non-hazardous (i.e. heat to drive off the hazardous organics and dry the residue, test the residue for EP toxicity and if acceptable landfill the residue or leave on-site. Again however, if all the above does not work out and we try to argue that the waste was hazardous all along and we were only doing what is practical or convenient, where does that leave us? Would a detailed consent order help to define: What must be done, how and to what degree, in case we do have a problem? The site is already on the Superfund list. EPA is checking their files to see to what extent the State and EPA may share in responsibility (liability) (as a result of emergency measures) if a Superfund action is taken. Also Superfund would address the landfill on site. Do we want to open that can of worms? RUFUS L. Box 2091 Raleigh, N.C. 27602-2091 October 19, 1982 MEMORANDUM TO: Dan Oakley FROM: Bill Meyer SUBJECT: Jadco Hughes At the recent hearing before Judge Friday on October 15, 1982, a point was raised concerning the characterization of the waste as hazardous waste. The following is a discussion of this issue. One must consider that while the number of samples taken from the site are numerous, that the area sampled is small, i.e. through 1 access port in the center·or··end of a 17 to 34' tank, and it is difficult to strongly imply that·the State samples are representative of the entire tank contents. We can only do the best we can and make judgements as to the contents based on our analytical data from limited samples. There are several ways materials are considered to be hazardous including exhibiting characteristic (ignitability, corrosivity, reactivity, and/or EP toxicity) or being listed as hazardous. The following is a presentation for considering the materials as hazardous. Primary Reasons (1) Under 40 CFR 261.3(b)(2) and NCAC lOF .0029, a waste mixture becomes a hazardous waste when a listed hazardous waste is first added. There are no constraints on hazardous waste volume added or concentration. It is simply the fact the materials are mixed that initiates the hazardous waste definition. In order to demonstrate that the mixture of materials on this site are not hazardous, Jadco Hughes would have to demonstrate that not even a single drop of a listed hazardous waste was added to the mixture. This would be difficult since the State has identified multiple constituents. The State considers the material in tanks 1,2,3,4 to be hazardous waste from this prospective. (2) Tanks 2 and 4 (10 x 17' and 10 x 34' respectively) are hazardous waste from a toxic metal prospective in that tank 2 exceeds the maximum allowable standard for Cd and tank 4 for chromium. We have observed --over-'thff past several years a marked irnprov~ment in· collaboration between our program representatives and those with I'elated responsibilities in NRCD and the Department of Agrictilture. The issues of overlaps and gaps appear to us to have been largely, if not completely, solved due to the steps taken by officials at all levels of the involved departments. It would be our opinion that ·your Board's staff under your direction could and should provide the necessary oversight instead of yet another committee in state government. I would also caution against investing in any new organization responsibilities for grant and rules review that would further slow an already rather cumbersome and lengthy process. These programs are : interrelated and an integrated approach to f-nvironmental management is essential. Effective coordination among the various programs is needed with respect to both day-to-day activities and long-range planning. Absence of Effective Organizational Mechanism for Coordinating Environmental Programs The Committee finds that there currently does not exist an effective organizational mechanism for coordinating environmental programs among departments. As a result, many low-level problems are permitted to become acute.' The absence of an effective mi!chanism for coordination causes many problems to rise within the hierarchical structures of the departments and seek their resolution in interdepartmental negotiations at the secretarial level or in action by the Governor. or the General Assembly. This approach would facilitiate • coordination by establishing an organizational structure that would recognize the interre.lationships among environmental programs. The internal agency structure could be designed in ways to enhance coordination, avoid duplication · of effort, and help assure an.integrated approach to enviro:unental manage~nt. ·Another possibility would be t~ '~t ~~e • peison in ch.a°rge of envir~n~n~ai<'i{~(;:~/'.·; programs within the current organizational structure. The Committee will study possible organizational changes after the 1980 Session, in light of efforts by the Executive Branch to establish an effective mechanism for coordination of environmental programs within the existing organizational structure. Recommendation with Respect to Mechanism for Coordination The Study Committee recommends that the Executive Branch, in the immediate future, establish a committee or other mechanism for coordination of environmental programs. ". These recommendations were further refined after the 1979 legislative session, and the Commission report to the 1981 General Assembly contained the following recommendatia-ia. I •. Results of Recommendations in the Committee's Interim Report In the Interim Report to the 1980 Session of the General Assembly, the Study Committee made recommendations to enhance coordination among environmental progtams and to alleviate specific problems that had cane to the attention of the Committee. Coordination of Budget Requests In response to the. recommendation of the Study Committee, the General Asserntily included a provision in Senate Bill 1005, ·ch. 1212.of the 1979 Session Laws, to require· the Departments of Agriculture, Human Resoorces, and Natural Resoorces .-· ·and Community Development to coordinate eny requests for additional funds in the areas of environmental management.and environmental health. Study of Laboratory Operations .., .... 'committee Composition The composition of the oversight Committee, consisting of members of the rule and regulation fi~king authorities of the affected departments and c~~isions i.e. Commission for Health Services, Environmental Manag·ement Commission, Radiation Protection Commission, and the NC Pesticides Board, and also representatives from the two department secretaries and the Commissioner of Agriculture should allow for an open forum in which these problems and concerns could be addressed on a regular basis. Most problems we have are brought about because of a lack of communications •. The membership of the canrnittee should consist of two members each from the four commissions previously mentioned. The two members fran each commission should be the Chairman and one other designated by the commission and both should be knowledgeablE in their duties, authority, and programs which they represent. The meetings of the Oversight Committee should be scheduled in such a manner as to allow any recommendations that may cane frcrn this ccxnmittee to be presented to the -full commissions represented by the committee. The Governor's Waste Management Board should not take any actiai on recanmendations from the Oversight'Committee until canments have been received from the affected commissions and agencies. Those recommendations on changes that may affect city and county governments should be referred to the appropriate organizations to all= for dissemination of this information and the receipt of input on the subject. Conclusion With the formation of this Oversight Committee, I feel the objectives and intent of the General Assembly's action can be carried out; this can be .achieved • without ma·ssive ·reorg~tion of departments, which woold be extremely costly and time consuming. The mechanism does exist for bring-the formation of this committee about. There also is _something to be said for checks and balances by -not having all regulatory authority under one roof. STATE HEALTH DIRECTOR On March 17, 1982 this agency sampled the 5 containers/tanks on the Jadco-Hughes Site to further determine the contents of materials. A combination of ne1·1 data and data from past sarnp ling indicates that the residual materials must be managed as a hazardous waste Based on this conclusion, the Solid and Hazardous Waste Management Branch has the following comments on the site. No PCB's were identified in any tank on the site based on 3/17/82 sampling. Tank #3 is not empty, as marked, and contains greater than 98% volatile materials (not water as reported by Chembac Labs),:;:> 3% COD and several hazardous waste constituents. The large tanks contain viscous·liquids with many hazardous constituents. Our data indicates that the materials ca~ be ignited but are not hazardous from an ignitability ·standpoint. Our lab cannot confirm that the ratio of 30 parts solvent to one part waste would be required fc: liquid injection incin- eration -casual testin~ indicates a much lower ratio especially for the large 10' x 32 tank #4. Again casual observation of the chemical and physical characteristics indicate little polymerization or total mass cross linkage has occurred but rather simple solidification into distinct phases throuqhout the tanks has occurred. ' The local landfill was evaluated for disposal oLthe materials on March 19, 1982. The materials cannot be accepted at ·a routine sanitary landfill. It is our opinion that the materials are a mixture of many hazardous wastes and appears to consist largely of tank bottoms from a distilled process. The data that we have on the site preclude management of the material except as hazardous waste. It is our opinion that the site should be included under CERCLA (Superfund), a copv of which is enclosed. The on-site landfilled debris should also be addressed. This does not assure clean-up any time in the near future because federal funds are limited and are to be used only for sites with high priority on a national basis. Even if "Superfund" money were availabe, EPA is bound by law to first attempt to have the responsible parties pay for the clean-up or to sue them to reimburse the fund .. Jadco-Hughes has never made an adequate effort to study the materials to determine chemical and/or physical characteristics. No plan of action for evaluation or disposal has ever been submitted. Nearly all statements from Jadco-Hughes have been inaccurate or cannot be substantiated by this agency. We have spent considerable resources on this project and still are not in· a position to firmly recommend a plan of action. It is requested that Jadco-Hughes accept responsibility fer developing a formal plan of action to manage clean-up and disposal of the materials as hazardous waste. Jadco-Hughes has never att~mpted to study the materials to determine chemical and/or physical characteristics. No plan of action for evaluation or disposal has ever been submitted. Nearly all statements from ,Jadco-Hughes have been inaccurate or cannot be substantiated by this agency. The only obstacle to execution of the agreement is the new requirement by the State of North Carolina that ownership be· acknowledged .. Jadco operated the plant under a lease for a very short while and denies that it ever acquired title to any of the materials in .the drums. or .in .. tjle tanks. My client is willing, however, in order to settle the controversy .to··go·beyond the call of duty and accept one-half of the costs-in completing cle_arance of the site. In addition, the water sampling and analysis will likely be completed by March 26, 1982, with a view toward providing a recommendation on dis- posal by the end of the month. Basically, the principles of Jadco, Inc. and Hughes, Inc. agreed to a two-step removal operation. 1. The liquid in the tankers will be pumped out and properly disposed of. It is presently believed to be primarily rainwater and hopefully can be conventionally treated. The Division of Human Resources (DHR) will check with municipal treatment plants in the area (the first contact will be with Belmont), and sample and analyze the liquid prior to disposition. (A) If the liquid is treatable, the State will notify Jadco/ Hughes and the disposal will be arranged. (B) If the liquid is not conventionally treatable, I feel the companies should arrange for proper disposition. l • Page Two 5 March 1982 2. The semi-solid cross-linked resins in the two large tankers and one small tanker will be treated as an entity. The determination of the process of fixing the material so that it is insoluble and the designation of a landfill site will be made by DHR (and the appropriate county officials) and provided to the companies. Although the conditions under which this will be acceptable are not yet known, the general consensus was that the process would involve movement of the tankers to a landfill, the filling of the tankers with an absorbent or concrete, and the lining and capping of the disposal trench with concrete. At least two dry-wells for monitoring purposes would be installed at the companies' expense. I have informed Judge Friday of our progress and he has agreed to continue the matter for 60-90 days, depending on the needs of the parties to appear before him. In any event, a final hearing will be scheduled to terminate the matter, when appropriate. Please note that samples were taken from three steel tankers and one mobile tanker. Also attached is a copy of an analysis provided by Mr. Dave Neill. The position of the State at this time is that the adjudged nuisance at the site has never been abated in accordance with the Judgment and orders entered herein. Furthermore, in the interim an entirely new area of Federal and State regulatory law has been firmly established. The Federal Resource Conservation and Recovery Act (42 use 6901) and the State Solid WasteManagement Act (G.S. 130-166.16) now specifically provide for the proper management of the hazardous constituents in this waste. There- fore, any plan for removal, disposal or even storage must comply with the State's hazardous waste program, administered by the Department of Human Resources. The previous alternative for disposal in Alabama, to be handled by Shenandoah Recycling, would constitute an acceptable plan. In light of the recent analyses not confirming the presence of PCB's, it appears possible' that SCA Services in South Carolina may again be a less expensive alternative. In addition, some possibility of incin- eration exists and should be explored. Hughes-Jadco Chemical Reclaimation site on October 8, 1981 by Jerry.Rhodes and Rick Doby of the N.C. Solid and Hazard- ous Waste Management Branch. Primary purpose of this visit was to obtain · samples from the tanks and the old mobile tanker remaining on this site. Three tanks remain that contain chemical residues. The back, large tank (10-20,000 gallons) appears to be a single compartment and is almost full of sludge and liquid. The chemical odor coming from this tank was very strong. The other large tank, same size as the back one, has two compart- ments. One end is almost full of a black sludge that will barely flow. The other compartment contains liquids which appeared to be water and another, lighter layer. Again, a chemical odor was detected from both compartments. The third tank is much smaller and only contains a few inches of almost solid residue. The ground under the large tanks appears to be contaminated with chemicals. Just to the north is a large puddle of tar-like material. Pressing this tar releases liquids.· A leaking 55-gallon drum is also in the immediate area. An area south of the tanks is free of any vegetation. A chemical odor can be detected around the tanks and downwind from the tanks. The rusted mobile tanker is in very poor condition. The solid sludge con- tained in this tanker is falling on the ground as the tanker rust away. Sample data are tabulated in Table l. The solid residue from the mobile tanker failed the EP Toxicity test (7 .4 ppm Pb extractable). The tanks contain complex organic residues that create problems with analysis. A lot of the materials appear to be organic acids and esters. However, all tanks contain spent solvents. PCB was not detected in these samples. • Table l. Hazardous Constituents in Tanks at C. A. While I would like to express some optimism over the use of "super fund" money in this situation, I am afraid that avenue is not promising. My understanding of the funding is that each state has been allowed one priority situation, not involving an imminent hazard (emergency), for which the funds can be used. The Belmont site is not this state's priority non-emergency situation. Funding is also available in emergency situations if the state and EPA agree on the imminent hazard. Due to the nature of the steel, tankers indications are that this would not be an emergency matter of the type for which funds would be available. Other points about the super fund, of which you may be un- aware, are that (1) its primary purpose is to alleviate hazards from abandoned sites, for which no responsible party has been located, and (2) reimbursement of the money actually spent will be pursued wherever possible. It seems likely that contracting by EPA for removal would actually result in an ultimate increase in the cost of the removal. I regret that this avenue appears to be fruitless. If you have any other questions regarding this, the North Carolina con- tact person for EPA is Mr. Gregory Fraley (404/881-2234). I have not heard anything regarding possible removal of the material since our last meeting in Lincolnton. I feel it is incumbent on the parties to follow through on the Chem-Waste Mr. James B. Edmisten, Attorney General, and Daniel C. Oakley, Assistant Attorney General, and shows unto the Court: (1) This action has been stayed pending resolution of certain hazardous waste issues in North Carolina; (2) The defendants herein have completed the clean-up of the subject site in accordance with orders of this Court, with the exception of the removal of the sludge contained in the steel tankers presently located on the site; (3) The plaintiffs have obtained an estimate for the removal of the sludge material from the tankers to a proper disposal facility, but have been unable to secure the commit- ment of the defendants for said removal; (4) The removal of the sludge material is necessary to complete the cleanup of the subject site, previously ordered. WHEREFORE, plaintiffs respectfully move this Court (1) to conduct a hearing into, and order, the removal of the sludge material from the steel tankers presently located on the subject site, and (2) to order such further relief as • -2-• may0 be appropriate._ This the 96 day of July, 1981. He informed me that his procedure in May of this year was to send the sample directly to Chem-Waste Management for a determination of disposal availability. Chem- Haste responded favorably, but neither he nor I have any more recent analyses than what you already have. The people Mr. Quillin has worked with are Jay Kaplan (800/248-7829, Marietta, Ga.) and Ed Bazier and Becky McClure (205/652-9531, Emelle, Ala.). You may want to speak with them directly. As a note,. the estimate set out in the June 10, 1981 letter vrom Mr. Quillen totthis office is now approximately 15% higher due to an increase in disposal and transportation costs. There has been little activity in this matter for two yaars, while the hazardous waste disposal problem received the general attention of the legislature. The matter should be closed out, however, and Judge Jo'hn R. Friday has tenta- tively agreed to hear a motion by the State seeking removal of the sludge on September 11, 1981 at 2:00 p.m. in Gastonia. I will need a repeesentative from each division to attend and testify concerning the present status of the site, the necessity for removal and the applicable RCRA requirements rega.rding storage/handling/disposal. The last formal hearing of this matter was in September, 1978, at which time it was ordered by consent that the matter would be stayed indefinitely pending certain State actions with regard to PCB disposal and hazardous waste management. I believe my last correspondence to you was in March, 1980 concerning our hope that the parties would obtain estimates for removal of the material, since ft did not appear likely a disposal site in North Carolina would be available in the immediate future. While the situation has stayed essentially the same for the past two years, the State has always been interested in the removal of the sludge from the tankers and termination of the suit. To this end, we have obtained a firm estaimate for the disposal by Shenandoah Recycling, Inc. -$62,285.00. We have requested voluntary action by the defendants to no avail, and would like to request this removal option be ordered by the court. To this end, I have enclosed an Order, for your consideration, setting a hearing in this matter. (A copy of a Motion to be filed herein is enclosed also for your information.} In order to give the parties time to accommodate their schedule to this hearing, I would suggest you consider some date after August 10, 1981. Hughes-Jadco Chemical Reclamation facility, Belmont, N.C., Cason Street DIRECTOR Inspection made by C. Richard Doby, Sr., on 1-28-81, and found the following: -Inadequate gate providing easy access by vehicle. -Poor drainage with significant amount of ponding water. -Slight odors near collapsed building -odor like sweet esters. -Approximately 50-75 deteriorating paper bags containing 3 separate items: some bags contained aluminum sulfate, some of them contained alum, others contained concrete mix. All the bags had become hardened and appeared to be somewhat oxidized. Also on the site, found 3 large tanks (approx. 15 feet tall), unable to check contents. In order to check contents, need ladder and sampling equipment. When the site was closed in 1978, these tanks were partially filled with solid sludge, There was a fourth tank which is an empty water tank. There was also a deteriorated mobile tanker on the site with a solid green sludge and it appeared to be an oxidized copper compound. Found one 55-gallon drum of leaking sludge that appeared to be like tar, This drum was not on the site when·it was closed·. The label on the drum said Butane. Belmont Waste Situation A memo dated December 4, 1980, concerning the above referenced matter was sent to you, Page Benton and myself from Dan Oakley, attorney for NRCD. In this memo Dan requested information concerning the status of the site and what remedial actions, if any, are needed. This matter is still in the courts and Dan wanted this information so he could determine his next legal move this month (January). Bob Reilly and myself asked you at a meeting on December 11, 1980, to investigate the site and report your findings. By phone last week I again requested this information. As of the date of this memorandi.nn, neither Bob, Dan nor myself have received any information concerning the Belmont site.
