Over the last few years at least six monitoring wells in Nonh Carolina were mistaken as Underground Storage Tank (UST) access pons by delivery men. Thousands of gallons of petroleum products were immediately released to the subsurface, resulting in severe environmental degradation and costly cleanups at each site. For exam pie ... On January 2, 1991, 1,730 gallons of kerosene were pumped into a monitoring well at a convenience store in Raleigh, Nonh Carolina. The responsible party estimates that it will cost more than a million dollars to clean up that site. According to a srrict interpretation of the UST regulations (15A NCAC 2N), the costs associated with the cleanup of a release of this son are not likely to be reimbursed from the State Leaking Underground Storage Tank Trust Fund Why else should monitoring wells be locked and labeled? North Carolina State Regulations require that every groundwater monitoring well be ... "Labeled as a liquid monitor well" (15A NCAC 2N .0504 (b)(9)) with "A warning that the well is not for water supply and ... may contain hazardous materials" (15A NCAC 2C .0108 (c)(l0)) and "Protected with a water tight cover and lockable cap" (15A NCAC 2N .0504 (b)(8)) and "Secured to ... insure against unauthorized access and use" (ISA NCAC 2C .0108 (c)(7)) These regulations also apply to vapor monitoring wells and observation wells, with the exception that they be labeled "vapor monitoring well" and "observation well," respectively. To enforce these regulations, representatives of the Division of Environmental Management (DEM) have begun inspecting the leak detection systems of facilities with underground srorage tanks. The inspection of 24 of these facilities revealed that 20 of them did nm have sufficiently secured monitoring wells. Each facility out of compliance with the regulations was issued a Notice of Violation (NOV) by DEM. Potential penalties for noncompliance with I SA NCAC 2C regulations can be$ I 00 for every consecutive day of noncompliance (see G.S. 87-94). Potential penalties for noncompliance with ISA NCAC 2N regulations can be as much as $10,000 (see G.S. 143-215.6). In addition, potential penalties for having a well that has been injected with wastes or contaminants can also be as much as $10,000. Over the last few years at least six monitoring wells in North Carolina were mistaken as Underground Storage Tank (USD access pons by delivery men. Thousands of gallons of petroleum products were immediately released to the subsurface, resulting in severe environmental degradation and costly cleanups at each site. For example ... On January 2, 1991, 1,730 gallons of kerosene were pumped into a monitoring well at a convenience store in Raleigh, North Carolina. The responsible pany estimates that it will cost more than a million dollars to clean up that site. According to a strict interpretation of the UST regulations (15A NCAC 2N), the costs associated with the cleanup ofa release of this son are not likely to be reimbursed from the State Leaking Underground Storage Tank Trust Fund. Why else should monitoring wells be locked and labeled? North Carolina State Regulations require that every groundwater monitoring well be ... "Labeled as a liquid monitor well" (15A NCAC 2N .0504 (b)(9)) with "A warning that the well is not for water supply and ... may contain hazardous materials" (15A NCAC 2C .0108 (c)(l0)) and "Protected with a water tight cover and lockable cap" (15A NCAC 2N .0504 (b)(8)) and "Secured to ... insure against unauthorized access and use" (15A NCAC 2C .0108 (c)(7)) These regulations also apply to vapor monitoring wells and observation wells, with the exception th at they be labeled "vapor monitoring well" and "observation well," respectively. To enforce these regulations, representatives of the Division of Environmental Management (DEM) have begun inspecting the leak detection systems of facilities with underground storage tanks. TI1e inspection of 24 of these facilities revealed that 20 of them did not have sufficiently secured monitoring wells. Each facility out of compliance with the regulations was issued a Notice of Violation (NOV) by DEM. Potential penalties for noncompliance ,vith ISA NCAC 2C regulations can be $100 for every consecutive day of noncompliance (see G.S. 87-94). Potential penalties for noncompliance with 15A NCAC 2N regulations can be as much as $10,000 (see G.S. 143-215.6). In addition, potential penalties for having a well that has been injected with wastes or contaminants can also be as much as $ I 0,000.
