Dear Ms. Urquhart-Foster: Enclosed arc the requested revised schedules for the groundwater remedy and the soil/sludge remedy. During our conference call on January 5, 2000 we discussed United States Environmental Protection Agency's (USEPA's) desire to obtain construction completion for the soil/sludge remedy before October I, 2000, the end of the fiscal year. It is our understanding that construction completion means that site work is completed (contractor de-mobilized) and the systems arc up and running. Required completion documentation may not necessarily be completed. We concur )Vith this date as a goal for "substantial" completion of the soil/sludge remedy but note that the schedule is very, very tight. In fact any difficulties with site access, document reviews, or significant weather delays will likely result in a construction completion after October I, 2000. A request for access was made to Norfolk Southern Corporation (Railroad) on January 10, 2000. In response, Norfolk Southern has requested additional information to be submitted to their legal department for review (sec attached letter). As requested by Norfolk Southern, we will setup a meeting with their representative at the site to discuss our remediation plan. Past experience with railroads is that they are very slow in granting access. We will provide you a report on these efforts on February 21, 2000. As requested by USEPA and North Carolina Department of Environment and Natural Resources (NCDENR) in our conference call on December 29, 1999, a line item has been added to the schedule to accommodate review of contractor health and safety plan and decontamination plan. TI1c Responsible Parties (RPs) arc committed to complete the construction in a timely manner. Given the very tight schedule and potential for delay, it is unreasonable to subject the RPs to potential penalties for not meeting the October I, 2000 deadline. With respect to financial security it is our understanding that the Responsible Parties may tcnninatc any financial assurance mechanisms required by the Consent Decree upon achieving construction completion. Please forward any future correspondence and submittals to me. It is EPA's goal that this Site obtains "Construction Completion" status by September 2000. Based on the conference call of December 29, 1999, and the Schedule for the Soil/Sludge Remedy Implementation attached to the Monthly Repo11 dated December I 0, 1999, this accomplishment seems feasible. Based on conversations with Mr. Mallary, I understand that schedules of the past have slipped and have been revised several tin1es. Since "Construction Completion" of this site is a top priority with EPA management, I am requesting you submit a revised schedule for the remainder of work to be completed at the Site for both the groundwater treatment system and the Soil/Sludge Remedy Implementation. These may be submitted as two separate schedules, if desired. Please also add a date for completion of the access agreement with Norfolk Southern Railroad. These revised schedules will be monitored and enforced through the Consent Decree for the Site. The purpose of this reminder is to stress EPA management's desire for Construction Completion this year. As stated in Section X, paragraph 28 of the Consent Decree, access to property owned by other entities shall be obtained within 45 days of the date of Consent Decree lodging or 45 days of the date EPA notifies the Defendants in writing that access is necessary. Mr. Shetty stated in our conversation yesterday that the access agreement has been drafted and will be mailed to.Norfolk Southern Corporation next week. The purpose of this paragraph is to notify you in writing that access to the Norfolk Southern Corporation property is needed, to start the 45 day clock. He informed me that the full amount of financial security must remain in place until all work is completed at the Site. The State of North Carolina does not approve of this request for the following reasons: The Amendment to the 1992 Record of Decision (ROD) was finalized in February 1999. The Amendment to the 1992 ROD proposes the implementation of a remedy that is technically and economically feasible. The proposed remedy would require a second treatability study, an evaluation of the feasibility of the requested remedy and a second Amendment to the ROD. If Arcadis Geraghty & Miller (AG&E), the consultants retained by JFD Electronics/Channel Master, had anticipated yet another remedy, that remedy should have been proposed prior to the Amendment to the 1992 ROD. The State of North Carolina does not agree with AG&E's beliefs that significant cost savings can be achieved nor that the remedial action can be completed in the same timeframe as the selected remedy. The costs and timeframes to implement a second treatability study and the timeframes required to properly evaluate the feasibility of this request and prepare yet another Amendment to the 1992 ROD are unacceptable, especially since there are no technical or economical reasons in which to abandon the selected remedy. Therefore, the State of North Carolina does not approve of this request. At Old A TC Refinery, Mike Taylor, EPA OSC, has requested that the NC Superfund Section have someone available for_oversight activities, no sampling involved, beginning early in November. At the Cristex Drum Dump, Tony Moore, the EPA OSC, will begin trenching a drum dump sometime during this month. We should have someone present during the trenching. In reference to Old ATC Refinery, Mike Taylor called me yesterday and told me that an AOC was signed on for this site on August 2. The PRP is Axel Johnson, Inc. Geraghty and Miller (G&M) has been selected to prepare a workplan for the removal of tanks, pipes, and drums. The tank and pipe removal has been subcontracted out to PetroClean (?) out of Pennsylvania. Two workplans have been prepared by G&M and rejected by EPA. Mike predicts that the removal activities will begin early in November. He has requested that the Superfund Section have personnel available, on a contingency basis, to do oversight during the removal. A geophysical survey was conducted at the Cristex Drum Dump in July 1996. Tony Moore talked to me on the phone yesterday. He said that the survey was inconclusive that trenching would be done sometime during this month. Tony is in the process of arranging for a backhoe to do the work and will contact me when he is ready to proceed. Compensation. and Liability Act (CERCLA) as amended in 1986 JFD ELECTRONICS/CHANNEL MASTER Oxford, North carolina •The JFD Electronics/Oiannel Master Site occupies 13 acres on Industrial Drive in Oxfc,rd, Granville County, North Carolina. During 1962-79, JFD Electronics manufactured television antennas on the site. A lagoon covering approximately 23,400 square feet was built in 1964-65 to dispose of sludge generated by treating waste water, primarily rinse water fran a chranate conversion process and oopper/ nickel electroplating. In 1980, Channel Master, a division of Avnet, Inc., purchased the property. In 1983, half of the lagoon was filled and used as a truck parking lot. A building on the property is rented by a local department store and used as a warehouse. · " About 25 percent of the property is contaminated, according· to Channel Master. 'Ihe company found chranium, lead, and other heavy metals in the sludge, and halogenated organic canpounds, including trichloroethane, tetrachloroethylene, and trans-1,2-dichloroethane, in on-site shallow monitoring wells it had constructed. This contamination appears to be associated with leaking underground tanks of waste oil used by JFD and with an area where trucks with waste oil had been rinsed. An estimated 2,500 people obtain drinking water fran private wells within 3 miles of the site, the closest approximately 2,000 feet to the southeast. The site drains to an unnamed tributary of Fishing Creek, which is used for recreational fishing. Channel Master has contracted for ·several studies of the site. One study developed a plan for cleaning up the lagoon and contaminated soil. 'Ihe work started in June 1987 and is nearing completion. JB/dk/6 • 9 October 1990 TO: File FROM: Jack Butler SUBJECT: JFD Electronics/Channel Master N CD 122263825 • On 9 October 1990 the North Carolina Superfund Section received a report from Mr. Bobby Green, Granville County Health Department (919/693-2688), that Mr. Robert "Bud" Daniels, a former employee of JFD Electronics and Channel Master, had some information on the subject site. Mr. Daniels was contacted at his home (919/693-5043) on 9 October 1990. Mr. Daniels reported that he worked at the subject site from 1964 until 1990 when he retired. Mr. Daniels was familiar with the removal of the lagoon, however, he reported that a septic tank containing plating wastes under the southwest corner of the concrete pad behind the main building had not been removed. He also reported that there were 2 fuel tanks under that same concrete pad. Mr. Daniels also reported that the new warehouse east of the main plant building was built on top of a second lagoon containing chromium and nickel plating wastes. A third lagoon was covered in front (north) of the new warehouse. These two additional lagoons were used by JFD Electronics and were filled with stone and covered without removal of sludge. Mr. Daniels added that the floor in the new warehouse was replaced several years after it was built due to settling and shifting of sludge under the building. This information was relayed by phone to Mr. Ken Mallary, EPA Region IV (404/347-7791) on 10 October 1990. Mr. Mallary responded that EPA was aware of one lagoon in the area of the new warehouse from old aerial photographs of the site, however a third lagoon was not present in these photos. Mr. Mallary was also aware of a septic tank and two fuel tanks that had been excavated behind the main plant building, however he was not aware of additional tanks under the cement slab. Mr. Mallary was given Mr. Daniels phone number so he could contact him directly. Mr. Mallary also discussed the Remedial Investigation (RI) that is scheduled to begin late in November 1990. Ms. Bennett also reported that Mr. Ken Mallory, formerly of NUS was coming to work for EPA and would be the new project officer for the subject site. Ms. Bennett also invited our staff to a Scoping meeting at the Bechtel office in Tennessee on 18 January 1990. Ms. Bennett was infonned that our staff would not be able to attend because of a scheduling conflict for that date. Ms. Bennett added that a Draft Work Plan was due by mid February. Ms. Bennett confinned that Gary Govert, attorney for O!annel Master, infonned EPA and Bechtel of approximately 11 sludge burial pits behind the eastern warehouse on the site. We appreciate the cordiality of the meeting and look forward to working with the agencies to effect a prompt and amicable resolution of this matter. As we discussed, Channel Master did not cause the contamination of the Site. Notwithstanding, Channel Master, without any threat of governmental action, already has spent substantial sums --over $3.5 million --to investigate and remove contaminated materials from the Site. Channel Master's past removal activities at the Site were discussed in detail, and we all concurred that these past activities were necessary, appropriate and consistent with the National Contingency Plan. All parties recognized the need for addition~l work to be conducted at the Site. As we described in detail at our meeting, Channel Master conducted appropriate environmental inquiries prior to the acquisition of the Site and was assured that there were no environmental violations. After Channel Master acquired the Site, Channel Master learned of the improper disposal or placement of hazardous substances on the property. Channel Master did not cause that contamination. In addition, Channel Master is committed to taking the additional response activity set forth in the Work Plan prepared by Channel Master's consultant, Westinghouse Environmental Services. This work would be accomplished in accordance with the aforementioned de minimis settlement, entered through an administrative order on consent which would include, inter alia, acceptable contribution protection and covenant not to sue. Channel Master is willing to enter into a de m1n1m1s settlement notwithstanding its third party defense in order to resolve its potential liability as quickly as possible. We understand that the moratorium presently in effect will be extended in order for an agreement to be finalized among the Agency, the State and Channel Master. 'lhis facility was constructed in 1962 am used by JFD Electronics until 1979. JFD was a manufacturer of television reception antennas. A lagoon was built on the site in about 1964 or 1965 am used to dispose of sludge generated by treating wastewater. 'lhe wastewater was primarily rinse water from a chromate conversion process am copper/nickel electroplating. In 1983 about 50% of the lagoon was backfilled am used as a truck parking area. 'lhe lagoon reportedly held 800,000 to 1,000,000 gallons of sludge. D.!ring 1986 Cllannel Master installed 5 pennanent groundwater rronitoring wells am perfornied chemical analysis on the sludge in the lagoon am soil on the site. Analysis of a composite of the sludge showed 99, 000 ppm total Chromium, o. 05 ppm extractable Chramium, 320 ppm total Lead am other heavy metals. Analysis of water samples collected from on-site rronitoring wells 1 through 4 indicate no significant chromium contamination in the groundwater. Analysis of core samples form rronitoring well #5 did not indicate the presence of extractable chromium. Analysis of groundwater from the rronitoring wells also indicate the presence of halogenated hydrocartlons including trichloroethylene am tetrachloroethylene. FUrther soil sampling indicated that the halogenated hydrocartlon contamination was part of a plllIOO originating near a loading dock on the south side of the main building. In the early summer of 1987, Channel Master undE:lrtook a cleanup of the chromium sludge contamination in the lagoon area. 'Ihis chromium sludge removal is intended to be phase one of a two part clean up pr=ess. Fhase two is intended to address the halogenated hydrocartlon contamination in the ~ter. Cllannel Master removed approximately 14, ooo yards of contaminated soil am sludge which created a pit approximately 20 feet deep in the former lagoon area. Sampling of soil from the bottom of this pit indicate chromium contamination had been reduced to no rrore than 300 to 500 ppm total chromium with less than 0.20 ppm extractable chromium. • • Contamination levels on the side walls of the pit are in the range of background levels at 10 to 15 ppm total chromitnn and less than 0.20 ppm extractable chromitnn. A description of the cleanup levels achieved in the pit was submitted to Dr. Mark A. McCalahan, Agercy for Toxic SUbstance and Disease Registry on April 28, 1988. Based on a review of the data and on the June 21, 1988 response from Dr. M<::Calahan, Channel Master was given approval to fill the excavated lagoon area with clean fill and restore the area to the original grade. No further remedial action to remove chromitnn contamination from this area appears to be necessai:y. As we discussed, Reme::l.iation of the halogenated hydrocarbon contamination in the groundwater is still pending a this time. As you may already know, JFD has received a Notice of Violation from the North Carolina Department of Natural Resources and Community Development (''DNRCD") stating that JFD is jointly and severally liable with Channel Master Satellite Systems, the current owner, is for the at the site. A copy of that Notice contam· attached. In addition, the Unimax Corporation has received a letter from the United States Environmental Protection Agency (''EPA'') pursuant to CERCLA which requests information regarding the including any groundwater contamination. I also groundwater understand that DNRCD will review the assessment and will have final authority to approve the adequacy that is proposed. of such assessment and any remedial plan • • POYNER & SPRUILL As we have informed DNRCD and EPA, the May, 1980 Agreement pursuant to which Channel Master purchased the property provided that Channel Master has inspected the property, accepted it "as is'' in its then condition and that Channel Master undertook to indemnify and to hold the seller, its successors and assigns, harmless from and against all actions, claims, penalties, damages and expenses resulting from any Violations against or affecting the Site noted or issued after May 28, 1980, or from any failure of Channel Master to correct or comply with such violations. We therefore believe it is Channel Master's responsibility to remedy the groundwater contamination at the site. Channel Master disagrees with this interpretation and the matter is part of iln ongoing lawsuit. Nevertheless, JFD and Unimax want to stay apprised of the ongoing groundwater assessment and remedial plan approval process. We therefore request that JFD and Unimax be notified of any meetings concerning the groundwater assessment and/or development of a groundwater remedial plan for the site so that-we may attend such meetings. We also request that you send us copies of all correspondence in any way relating to the assessment and remedial plan. We assume that we would be provided such notices and copies as a matter of course since we have been notified by DNRCD and EPA as potentially responsible parties. Analysis of a composite of the slu9ge sho~d 99,000 ppm total Chromiun, 0 .05 ppm extractable Chromium, 320 "\·'"ppm total lead and other heavy metals (see attachrrent 2). I appreciate your support for the proposed policy as outlined in the National Contingency Plan (NCP) draft Section Section 300.12(a) State Involvement in the Listing and Delisting Process. However, the existing NCP requires EPA to evaluate and score all sites based on conditions prior to any remedial action. Therefore, at this time, the Agency will not defer any Update #7 site where HRS scoring criteria are met, based on the current agency policy. The a·gency is aware of the ability of the North Carolina program to address remediation of Superfund sites.
