The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell, with the Section, visited the Yard Waste Notification (YWN) for a comprehensive inspection. Section staff contacted NCDOT Josh Brooks beforehand to have the gate open. Road access was good.
2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
3. There were workers onsite during inspection spreading out mulch across notification. Upon speaking with Josh Brooks, he explained the stockpile of soil would be mixed with the waste onsite, to make more of an enriched soil amendment that would then be ready for use on sides of roads in flower beds. Renewal submitted in 2023 states waste will be stockpiled until enough to get a tub grinder, its ground into mulch, then passively composted and then used for flower beds. The renewal also estimates 600 cubic yards will be received and removed. This renewal should reflect the actual quantity onsite and more accurately what process is occurring onsite. The operation meets the rules but should be better explained on the renewal. All waste should be kept inside the 2-acre footprint.

4. The waste onsite was clean and looked good. No unapproved waste visible in the mulch/compost. Good job.
5. There was some older waste partially covered with soil discovered onsite after recent earth works made it possible
to see the items. Some concrete, plastic, tires etc. were visible sticking out of the side of the hill. Waste cannot be buried at this location. Upon speaking with Mr. Brooks, he stated he would have the waste removed to the appropriate landfill within the next couple weeks with confirmation sent to David Powell. All buried wastes should be removed to landfill approved for that waste type.
Just as a reminder, the 75% rule, § 130A-309.05. Regulated wastes; certain exclusions, for the concrete waste onsite. Basically says, 75% of what’s taken in should be gone within a calendar year for recyclable materials such as asphalt, concrete etc.

6. Corrective measures are necessary as a result of this inspection. Waste removal documentation should be sent to Solid Waste Section Staff David Powell within 30 days’ receipt of this inspection report. All waste should go to landfill approved for that waste type and metal can be recycled. Failure to meet the conditions for compliance may result in further Compliance Actions.
