Dear Mr. Reilly:
A Notice of Residual Petroleum with a soil restriction was filed on the parcel for Reed Street Grocery
(Former) on March 29, 2006. The site received No Further Action status on June 22, 2006. The Limited
Soil Assessment Report received by the UST Section, Division of Waste Management, Mooresville
Regional Office on January 31, 2018 was reviewed. The review indicates that soil contamination does not
exceed the residential maximum soil contaminant concentrations (MSCCs), established in Title 15A NCAC
2L .0411 and that groundwater contamination does not exceed the groundwater quality standards
established in Title 15A NCAC 2L .0202. The Notice of Residual Petroleum for the parcel was cancelled
on February 6, 2018. The site maintains the no further action status issued on June 22, 2006.
The UST Section determines no further action is warranted for this incident. All required actions have been
completed. As soil contamination exceeds the lower of the soil to groundwater or residential MSCCs,
public notice in accordance with 15A NCAC 2L. 0409(b) was provided to the UST Section. On June 28,
2006, the UST Section was provided with proof of receipt of the conditional Notice of No Further Action
letter or of refusal by the addressee to accept delivery of the letter or with a description of the manner in
which the letter was posted.
This determination shall apply unless the UST Section later finds that the discharge or release poses an
unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title
15A NCAC 2L .0407(a) you have a continuing obligation to notify the Department of any changes that
might affect the risk or land use classifications that have been assigned. This No Further Action
determination applies only to the subject incident; for any other incidents at the subject site, the responsible
