(CESI) is assisting a potential purchaser with due diligence tasks of former Reed Street Grocery located at 9 Reed Street, Concord, North Carolina. The property appears on the North Carolina Department of Environmental Quality (DEQ) Leaking Underground Storage Tank (LUST) database with incident number 27786. The attached letter from DEQ dated February 1, 2018, cancelled the Notice of Residual Petroleum issued for the LUST incident. While the DEQ letter implies No Further Action is required for the incident, for the comfort of our client, CESI requests a DEQ letter clearly stating No Further Action required. The current owner of the property is: Mr. Patrick Reilly Shelby Company LTD LLC 8601 Six Forks Road Suite 250 Raleigh, NC 27615 The remaining portions of this letter and attachments provide background data should you need it for your review. Reed Street Grocery was formerly located at 9 Reed Street and was identified on the LUST database. This facility discovered a release of petroleum products from two fuel oil Underground Storage Tanks (USTs) during their closure by removal in 2004. Confirmatory soil sample analyses from finished excavations at the time of tank closure documented concentrations of petroleum products in soil greater than the residential use Maximum Soil Contaminant Concentrations (MSCCs) established by the DEQ. Analysis of a groundwater sample collected from the site in 45 Spring Street, SW P.O. Box 268 Concord, NC 28026-0268 704-786-5404 www.cesicgs.com License NumberC-0263 9 Reed Street Concord, North Carolina February 10, 2023 Page 2 2005 did not report parameters at concentrations greater than the Groundwater Quality Standards (GWQS) established by the DEQ. In March 2006, a Notice of Residual Petroleum (NRP) was filed for the LUST incident. In response, the DEQ issued a Notice Further Action (NFA) with Land Use Restrictions prohibiting the use of groundwater and restricting development to industrial use. Additional assessment activities were conducted in 2018 consisting of re -sampling soil from the former tank pit. Analyses of soil samples from the resampling event did not detect petroleum parameters at concentrations greater than the sample detection limit. On February 1, 2018, the DEQ cancelled the NRP. UST Information Two underground storage tanks (USTs) were closed by removal on March 24, 2004. The USTs were of steel construction. UST#1 measured 5 ft., 4 in. x 3 ft. and had a capacity of approximately 270 gallons. UST#2 measured 6 ft., 6 in. x 4 ft. and had a total capacity of approximately 400 gallons. The USTs were located in two separate basins. 4. Site Characteristics Describe any past releases at this site. Unknown. Is the facility active or inactive at this time? If the facility is inactive, note the last time the USTs were in operation. The facility is inactive. It is not known when the USTs were last in operation. The grocery store building was demolished at some time between 2001 and 2003. Describe surrounding property use (for example, residential, commercial, farming, etc.). The property is located in downtown Concord and the surrounding property use is mainly residential. Describe site geology and hydrogeology. Fill material was encountered in each of the two UST basins from the land surface to a depth of approximately 7 ft. Brown sandy silt was encountered from approximately 7 ft. to 18 ft., the approximate bottom of the basin. Groundwater was not encountered. If a release has occurred, describe the results of the receptor survey performed within 1,500 feet of the facility. A receptor survey was performed and no supply wells were identified within 1,500 ft. of the site. B. Closure Procedures 1. Describe preparations for closure includina the steos taken to notifv authorities permits obtained, and the steps taken to clean and purge the tanks. The local fire marshall was notified of the UST removal approximately one -week before field activities. The USTs did not contain fuel oil or sludge. Note the amount of residual material pumped from the tank(s), and describe the storage, sampling, and disposal of the residual material. The USTs did not contain fuel oil or sludge. 3. Document soil excavation activities Describe excavation procedures noting the condition of the soil encountered and the dimensions of the excavation in relation to the tanks, piping, and/or pumps. Overburden was excavated with a backhoe until the top of each UST was exposed. The fill covers of each UST were removed and vapors inside the tank were monitored for hydrocarbon content and oxygen. After it was established that the environment inside of the USTs were within established safety parameters, soil surrounding each UST was excavated. UST #1 measured 5 ft., 4 in. (length) x 3 ft. (diameter). UST#2 measured 6 ft., 6 in. (length) x 4 ft. (diameter). The final excavation of each UST basin excavation measured approximately 15 ft. (length) x 15 ft. (width) x 18 ft. (depth). Product lines were removed and were located in the excavated areas. Note the depth from the land surface to the top of the tank Approximately 1 to 2 ft. Note the volume of soil excavated. The quantity of soil removed from the former UST basins was approximately 200 tons (both basins combined; approximately 100 tons from each basin). Describe the soil type(s) encountered. The soil was a mixture of sand, silt, and clay. Describe the type and source of backfill used. The backfill was a mixture of sand, silt, and clay. Describe condition of UST system(s) (i.e., pitting, holes, etc.). UST#1 exhibited a small hole in the bottom of the tank. UST#2 exhibited a small hole in the bottom of the tank. Note if water, free product, or bedrock was encountered during the excavation process. No water, free product, or bedrock was observed in the bottom the UST basins. 4. Document contaminated soil Describe how the extent of soil excavation was determined. The extent of soil excavation was determined by the same method for both UST basins. Page 4 Initial soil samples (TPH) were obtained following the removal of the tanks, samples SS-1 and SS-2. Hydrocarbon affected soil was encountered in both UST basins. Therefore, a total of 6.8 tons of soil was removed from each basin. Hydrocarbon affected soil was encountered following the removal of the initial 6.8 tons, therefore, a total of 50 tons of soil was removed from each basin. Hydrocarbon affected soil was encountered following the removal of approximately 50 tons of soil from each basin, therefore, a Trust Fund Preapproval Form was submitted to the NCDENR, Mooresville Regional Office for the removal of an additional 50 tons of soil per basin. The Preapproval Form was executed by the NCDENR on March 26, 2004. An additional 50 tons of soil was then removed from each UST basin. Hydrocarbon affected soil was encountered following the removal of approximately 100 tons of soil from each basin. The NCDENR was contacted and advised of the condition of the soil. The NCDENR stated that additional preapproval would not be granted for further excavation, therefore, sidewall and basin bottom samples were obtained. The samples were analyzed using "risk -based" methods. Describe the method of temporary storage, sampling, and treatment/disposal of soil. Soil removed from the UST basins was stored temporarily on -site. 5. Document the location and method of disposal of the tanks The USTs were disposed of by the property owner. C. Soil samples were handled with either a stainless steel trowel, dedicated sample shovel, or stainless steel hand auger. Latex / nitrile gloves were used to minimize human contact. Sampling equipment was thoroughly cleaned and a fresh pair of latex / nitrile gloves were used after the handling of each sample. Analytical samples for transport to the laboratory were sealed in the appropriate sampling containers. The samples were placed in a pre -chilled, ice -filled cooler, and transported to Pace Analytical Laboratories, Inc. in Huntersville, NC for analysis. Decontamination procedures. Distilled water and an alconox cleansing agent were used to clean sampling devices. Time and date samples were submitted to lab. See chain of custody forms. Samples collected for quality control purposes (e.g. duplicates, field blanks, trip blanks, etc.). Field blank / trip blank samples were not used. 5. Describe Investigation Results. Methods of analyses used (i.e. EPA method number). UST basin and soil pile samples: GRO, DRO. Over -excavation confirmatory soil samples: EPA 8260/8270, MADEP VPH/EPH. Page 7 ' Provide analytical results for samples; discuss the results in relation to the cleanup levels or action levels, as appropriate. ' The following samples were found to exceed the NCDENR TPH standard of 10 ppm: SS-1, SS-2, Soil#1, Soil#2, and Soil TP. Soil related to SS-1 and SS-2 were removed during excavation. ' Soil related to Soil#1, Soil#2, and Soil TP were composite samples obtained from the excavated soils. The following samples were found to exceed the NCDENR "soil to groundwater" standard: Tank 1A, Tank 1SWC, Tank 1SWD, Tank 2SWD, Tank 2SWE. The property contains approximately 1.0 acres, and it is currently undeveloped. According the Cabarrus County tax records, the property is identified as tax parcel number 5630-09-2510-0000, and it is currently owned by the Joseph W Lippard Family Limited Partnership. A Site Location Map is provided as Figure 1, and a Site Map is provided as Figure 2. In March 2004, one 270-gallon heating oil underground storage tank (UST) and one 400-gallon heating oil UST were removed from two separate excavations at the Former Reed Street Grocery property by Nightingale Geologic Consultants, PC (NGC) of Charlotte, North Carolina. NGC identified the 270-gallon tank location as UST #1 and the 400-gallon tank location as UST #2. Petroleum impacted soil was encountered in both areas during tank removal, and approximately 200 tons of affected soil (approximately 100 tons from each tank excavation) were removed from the site. The historical analytical results from the tank closure and soil excavation activities are provided in summary form on Table 1. The following findings/conclusions were provided in the UST Closure Report prepared by NGC: • Soil samples from both basins, following final excavation, exceed the "soil to groundwater" standards. • Soil samples from Basin 2 exceed the "residential" standard. A Limited Site Assessment (LSA) Report was completed by NGC in November 2005. One groundwater monitoring well (MW-1) was installed between the two tank (UST #1, UST #2) excavation areas. The depth to groundwater during the LSA field activities was recorded as approximately 34.15 feet below ground surface (BGS). The following findings/conclusions were provided in the LSA Report prepared by NGC: • No constituents exceeding the North Carolina standards were detected in the LSA soil samples. Constituents exceeding both the "soil to groundwater" and "residential" standards were detected in soil samples from the UST Closure and soil excavation investigation. • No constituents exceeding the North Carolina standards were detected in the LSA groundwater sample. In March 2006, a Notice of Residual Petroleum (NORP) was filed with the Cabarrus County Register of Deeds for the subject property. The NORP established a Perpetual Land Use Restriction for the site that limited property usage to "Industrial/Commercial Use Only". A copy of the filed NORP is provided in Appendix A. (Mid -Atlantic) was contracted by the Joseph W. Lippard Family Limited Partnership to investigate the current soil quality in the historical UST #2 excavation area and, based on those findings, determine what steps may be required in order to resolve the existing NORP at the property. The following report summarizes the field activities and findings of the additional soil investigation and provides recommendations for further action. 2.0 FIELD ACTIVITIES Soil sampling activities using Geoprobe direct push technology were conducted at the subject property on November 21, 2017. This investigation was conducted to determine if petroleum constituents identified during the 2004 removal activities remain on site in excess of current NC residential soil standards. Soil samples were collected to determine the current soil quality in the area of two sidewalls of the UST #2 historical soil excavation area. The general location of the UST #2 excavation area was identified by a visible slight surface depression in the area of the site corresponding to the UST #2 excavation as shown on the NGC Site Configuration Map that was obtained from the NGC UST Closure Report. A copy of the NGC Site Configuration Map is provided in Appendix A. Prior to initiating field work, Mid -Atlantic notified the NC OneCall system to locate municipal utilities within the work area. In addition, Mid -Atlantic contracted with Priority One locating services to identify any private subsurface utilities at the site and to clear the proposed soil boring locations. Geoprobe sampling services were provided by Environmental Drilling & Probing Services (EDPS) of Charlotte, North Carolina. John Sherrill of Mid -Atlantic was on site to oversee the field work and to collect the soil samples. During tank closure and soil excavation activities conducted in April 2004 by NGC, soil samples 2SWD and 2SWE indicated the presence of target semi -volatile and target VPHIEPH hydrocarbon fractions at concentrations in excess of the applicable North Carolina Maximum Soil Contaminant Concentrations (NCMSCC) Residential Standards. The 2SWD and 2SWE sample locations were respectively situated along the southwestern and northwestern excavation sidewalls on the UST #2. To confirm the location of the historical excavation sidewalls, shallow hand auger borings were advanced by EDPS personnel prior to Geoprobe sampling to investigate the type of subsurface material and to confirm the presence of native material. Backfill material was originally encountered in the hand auger borings, and the borings were advanced outward from the excavation area until native material was identified. Soil sample 2SWD-01 was collected from the Geoprobe boring at a depth of approximately 8 feet BGS. After collection of sample 2SWD-01, a second boring was advanced approximately 3.5 feet from the approximate location of the southwestern sidewall in order to obtain additional information on the lateral extent of soil quality in the area. Soil sample 2SWD-02 was obtained at a depth of approximately 8 feet BGS. After sampling along the southwestern sidewall was completed, soil sampling was conducted along the northwestern sidewall of the former UST #2 excavation. The edge of the native material area was identified by EDPS using a hand auger, and the Geoprobe boring was advanced along the northwestern sidewall. Soil sample 2SWE-01 was collected from the Geoprobe boring at a depth of approximately 8 feet BGS. Sample 2SWE-02 was collected in the native soil approximately 3.5 feet outside of the northwestern sidewall at a depth of approximately 8 feet BGS. EDPS backfilled the soil borings with bentonite pellets upon the completion of sampling activities. The Geoprobe tooling was decontaminated between sampling locations using liquinox and water. New nitrile gloves were worn during the collection of each sample, and samples selected for laboratory submittal were placed into laboratory -supplied bottles. After collection, the samples were packed into an ice -filled cooler and shipped under chain -of -custody to Shealy Laboratories, Inc (Shealy) in West Columbia, South Carolina for analysis for semi -volatile compounds by EPA Method 8270 and for petroleum hydrocarbon fractions by MADEP VPH and MADEP EPH. Samples 2SWD-01 and 2SWE-01 were initially analyzed by the laboratory. After receiving and reviewing the analytical results for samples 2SWD-01 and 2SWE-01, Mid -Atlantic instructed Shealy to proceed with the analyses of samples 2SWD-02 and 2SWE-02. Photographs documenting site conditions and the sampling locations are provided in Appendix B. Copies of the Boring Logs are provided in Appendix C. A Sample Location Map is provided as Figure 3. 3.0 LABORATORY RESULTS A copy of the laboratory analytical report and chain -of -custody record for the soil samples collected at the site by Mid -Atlantic is provided in Appendix D. Northwestern Sidewall Analytical ResultsAnalytical testing of soil sample 2SWE-01 by EPA Method 8270 indicated the presence of Pyrene at a concentration in excess of laboratory minimum detection limits and indicatged the presence of bis(2- Ethylhexyl)phthalate at an estimated concentration above its limit of quantitation but below its minimum detection limit. Neither Pyrene nor bis(2ethylhexyl)phthalate were reported at concentrations that exceeded their respective NCMSCC Residential Standards. Analytical testing of sample 2SWE-01 by MADEP EPH indicated the presence of C9- C18 Aliphatics, C19-C36 Aliphatics and C11-C22 Aromatics at concentrations above laboratory minimum detection limits but below their respective NCMSCC Residential Standards. 4.0 SUMMARY AND RECOMMENDATIONS The following field work was conducted during this additional soil investigation Two soil samples (2SWD-01, 2SWD-02) were collected at a depth of approximately 8 feet BGS in the area of the southwestern sidewall of the historical UST #2 excavation area. • Two soil samples (2SWE-01, 2SWE-02) were collected at a depth of approximately 8 feet BGS in the area of the northwestern sidewall of the historical UST #2 excavation area. • Analytical testing of the soil samples by EPA Method 8270 and MADEP VPH and MADEP EPH did not indicate the presence of any target compounds or petroleum fractions at concentrations in excess of the respective NCMSCC Residential Standards. : Md Atanticiln Additional Soil Assessment Report Former Reed Street Grocery Concord, North Carolina Mid -Atlantic Project 0001-11197.00 Recommendations January 12, 2018 Page 5 Based on the findings of this investigation, it appears that the petroleum impacted soil previously located on the subject property has degraded, and that concentrations of target compounds and target petroleum fractions that exceed NCMSCC Residential Standards are not present on the subject property.
