PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE ACTIONS IN PROGRESS:15A NCAC 13B .0503(2)(a)(ii) states: "A site shall meet the
following design requirements: The concentration of explosive gases generated by the site shall not exceed the
lower explosive limit for the gases at the property boundary."
Transylvania County has implemented the approved Landfill Gas Remediation Plan. Landfill gas monitoring data
is being submitted to the Section quarterly. Results show that landfill gas levels are decreasing but are still
exceeding 100% of the lower explosive limit in well 12R during some monitoring events. Additional measures
may be required, should the plan fail to reduce landfill gas levels at the facility boundary.
B. CORRECTIVE ACTIONS IN PROGRESS:15A NCAC 13B .0203(d) states: `By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with conditions of the permit." The facility received a closure letter from the Solid Waste Section
[Section] on December 21, 1995 which stated post closure conditions.

Post Closure Condition 1 states: "MANAGEMENT OF LANDFILL GAS: The owners shall take the measures
necessary to ensure that the closed site shall continue to meet the design standards for landfill gas found in Rule
.0503(2)(a)."

OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on April 25, 2023.
2. The facility is secured by a gate which is located at the Calvert Road Solid Waste Convenience Site.
3. Edge of waste markers constructed of PVC are installed around the perimeter of the landfill cap.
4. Groundwater monitoring is being conducted semi-annually, the reports are being sent to the section and are
available on Laserfiche for review.
5. The cap of the landfill had good vegetative cover and was mowed the week of April 17, 2023.
6. The drainage ditch around the south side of the landfill had some depressions forming in it. Facility staff stated
that they had plans to add soil to low areas and were going to rework the drainage features on the cap in the
upcoming weeks.
7. Monitoring wells GP12-R, GP-6R and GP-4R were observed to be locked at the time of inspection.
