DUE FOR 2023. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff visited the Yard Waste Notification (YWN) to do a routine Comprehensive Inspection. David Powell met with Ms. Kelsey Hammond, Town Administrator, Addison Simmons, and Randy Coates, also with the Town of Bladenboro. The site was behind the town’s wastewater treatment plant, behind locked gate with minimal signage, although the site is only used by the town. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. 3. The notification was not completely full of waste at time of inspection. Ms. Kelsey indicated the town removes waste from the notification approximately once a year. The waste is mostly taken to Bladen Counties NLCID for disposal. The time for annual removal is within next couple months according to Ms. Kelsey. There is some older waste needing removal in the rear, behind newer waste. Waste cannot stay in the notification, or it becomes disposal, and this site isn’t approved for disposal. Please be sure and remove it with this years hauling. 4. The Town should review its options and determine if straight hauling to a disposal site would save trouble, time, and money. This would cut down on hauling, storing, reloading, and hauling and then disposing. The Town could keep the notification for a backup plan. Please be sure and inform David Powell/Section with any changes to current operations. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 5. Edge of waste (EOW) markers were still in place on the corners, to mark the limits of the notification. Good job. Size is less than two acres, approximately 1 acre. 6. No unapproved wastes were visible during inspection. Good job. Please be mindful with removing unapproved wastes and getting them to the appropriate disposal site appropriate for that waste type. Rules for YWNs were sent to Ms. Kelsey on 4/27/2023, along with link to Sections website and site locator tool for assisting with finding approved sites for disposal in surrounding community. Please review and save copies and share the operational requirements with any staff operating in the notification to assist with compliance.
