During the site inspection on 2/10/2023 cool season grasses were present on the field with coverage approaching 80% OBSERVED VIOLATIONS: During the site inspection on 2/10/2023, septage was observed applied outside of the permitted boundary on the northern corner of the field in violation of the following rule. 15A NCAC 13B .0842(a)(12) all septage discharges, including aerial drift from discharges, shall be made within the permitted boundaries of the land application site; The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The access roads to the disposal area were posted with required signage that was visible and legible. 2. The roads accessing the site were passable. 3. The disposal area boundaries were marked on the ground visibly and distinguishably from the surrounding landscape. 4. All applications of septage were not made within the boundaries of the permitted field. On the northern corner of the field septage was discharged outside of the permitted area onto a roadway adjacent on the field boundary in violation of 15A NCAC 13B .0842(a)(12). Please ensure that all drivers are aware of the importance of applying septage within the boundaries of the permitted field. 5. Applications appear to be made in accordance with the nutrient management plan. 6. The crop described by the nutrient management plan is present. The crop has not been maintained as prescribed. Winter overseeding does not appear to have been completed as prescribed. Crop coverage was approaching 80%. Large areas of the field had no viable crop coverage. Steps need to be taken to ensure the warm season crop will be viable with a coverage rate at or exceeding 80% to avoid field closure. 7. No septage applications were made during the site visit. 8. No objectional odors where noticed. 9. Required setbacks appear to be met. 10. 2022 land application records were submitted for inspection, required information was being recorded.
