A Notice of Violation was issued for the following rule violations where material having the appearance of septage or septage material washed out of pump truck tanks was observed on an unpermitted field adjacent to Field 4. 15A NCAC 13B .0832(h)Washings from the interior of septage handling containers such as pump trucks shall be managed as septage. N.C.G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater system that has been approved by the Department under rules adopted by the Commission or by the Environmental Management Commission or at a site that is permitted by the Department under this section. A permit shall be issued only if the site satisfies all of the requirements of the rules adopted by the Commission. 15A NCAC 13B .0840(a)No person shall establish or allow to be established upon any real property owned, operated, leased, or controlled by that person, a septage management facility to treat, manage, store, or dispose of septage, or any component of septage, unless a permit has been obtained from the Division. Septage shall not be disposed of by trenching or burial. During the follow up inspection of the unpermitted field on 2/10/2023 no new violations where observed. Dried septage residue remained in areas. The area was planted with grass. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: Violations of the following rules and permit operating Condition were observed during the 2/10/2023 inspection please see comments below for additional details. 1. 15A NCAC 13B .0842(a)(7) septage shall be applied to the surface of the land from a moving vehicle to have no standing liquid or soil disturbance resulting from the waste flow after the discharge is complete; 2. Permit Operating Conditions (9) …Septage shall be distributed evenly within the permitted boundaries in such a manner that there is no standing water when the discharge is complete… The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1) The access roads to the disposal area were posted with the required signage that was visible and legible. 2) The roads accessing the site were passable. 3) The disposal area boundaries were marked on the ground visibly and were distinguishable from the surrounding landscape. 4) No discharges were noticed outside of the permitted boundaries. 5) Applications of septage were made in violation of the nutrient management plan (NMP) and 15A NCAC 13B .0842(a)(7) where extensive ponding of septage was observed on field 2 in ruts left after the application was complete. Application methods should be modified to prevent ponding of septage after the applications are complete. 6) The warm season crop described by the nutrient management plan was mostly dormant, some evidence of winter overseeding was visible. All fields had areas with no actively growing crop stand. 7) No objectional odors where noticed. 8) Required setbacks appear to be met. 9) Land application records were received on 1/6/2023 for inspection. Required data was recorded. 10) The site of the NOV issued on 12/05/22 was inspected. Grass was planted and was emerging. Dried septage residuals (trash, stained soil) remained on the field. No written certification with supporting documentation on company letterhead confirming the noted compliance schedule has been completed was received form Atlantic OBX as requested.
