Observed Violations Violations of the following rule were observed during this inspection: 15A NCAC 13B .0842(a)(17) approved nutrient management plans shall be followed; (Please see item 6 of Additional Comments on page 2 of this report) Rye overseeding as prescribed by the NMP was not visible. A Notice of Violation is issued for the following rule violations: 15A NCAC 13B .0832(h)Washings from the interior of septage handling containers such as pump trucks shall be managed as septage. N.C.G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater system that has been approved by the Department under rules adopted by the Commission or by the Environmental Management Commission or at a site that is permitted by the Department under this section. A permit shall be issued only if the site satisfies all of the requirements of the rules adopted by the Commission.
15A NCAC 13B .0840(a)No person shall establish or allow to be established upon any real property owned, operated,
leased, or controlled by that person, a septage management facility to treat, manage, store, or dispose of septage, or any component of septage, unless a permit has been obtained from the Division. Septage shall not be disposed of by
trenching or burial.

Material having the appearance of septage or septage material washed out of pump truck tanks was observed on an
unpermitted field adjacent to Field 4. The practice described is a violation of the above stated rules and statutes:
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS
1) The access roads to the disposal area were posted with the required signage that was visible and legible. 2) The roads accessing the site were passable. 3) The disposal area boundaries were marked on the ground visibly and were distinguishable from the surrounding landscape. 4) On the permitted fields no discharges were noticed outside of the permitted boundaries. On an unpermitted field adjacent to field 4 to the east, septage wash water was observed discharged onto the ground surface. Please see the NOV documentation accompanying this report.
5) Permitted applications appeared to be made in accordance with the nutrient management plan (NMP).
6) The warm season crop described by the nutrient management plan was mostly dormant, no evidence of winter overseeding was visible and did not appear to have been completed as prescribed by the NMP. All fields had areas with no actively growing crop stand. Without overseeding as prescribed by the NMP crop coverage will likely fall below 80% with continued applications. Please note: the Permit Operating Conditions provide that: This permit shall become void if the soils fail to adequately assimilate the septage and shall be rescinded unless the site is maintained and operated in a manner which will protect the assigned water
quality standards of both surface and ground waters. 7) No objectional odors where noticed. 8) Required setbacks appear to be met. 9) Records were not inspected at the time of the site inspection. 10) An NOV was issued for discharging septage on an unpermitted field.
