PURPOSE OF SITE VISIT: Follow-up inspection for NOV 12/8/2021 STATUS OF PAST NOTED VIOLATIONS: Observed violation noted on 12/8/2021 for uneven or heavy application of septage on Field 1 is resolved.
An NOV was issued on 12/08/2021 for:
• applying septage to Field 2 without raising pH to 12 or higher by alkali addition. in violation of 15A NCAC 13B .0842 (c)(1).
• Disposing of septage wash water on a field adjacent to the permitted site not permitted for land application of septage in violation of 15A NCAC 13B .0832(h), 15A NCAC 13B .0840(a) and N.C.G.S. 130A‐291.1(d).
A follow-up inspection of the unpermitted field septage was discharged onto confirmed the septage was cleaned up and
the field planted with rye grass. Atlantic OBX provided a written certification with supporting documentation on company letterhead advising the compliance schedule was completed, received 12/27/2021. Violations noted on 12/8/2022 are resolved.
Observed Violations During the 1/18/2022 inspection, ruts were observed on Field 1 greater than three inches in depth in violation of the following rule.
15A NCAC 13B .0842(a)(9) septage shall not be applied to a site if the application method will result in ruts greater than three inches in the soil surface;
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) Ruts were observed on Field 1 that were greater than 3 inches in depth (please see observed violation on page 1 of this report). Applications of septage should not be made when the field is too wet to
support the weight of the pumper vehicle.
