PURPOSE OF SITE VISIT: Follow up / Routine
STATUS OF PAST NOTED VIOLATIONS: On 12/05/2022 violations of the following rules and permit conditions were observed:
• 15A NCAC 13B .0842(a)(12) all septage discharges, including aerial drift from discharges, shall be made within the permitted boundaries of the land application site. (No new violations of this rule were observed).
• 15A NCAC 13B .0842(a)(17) approved nutrient management plans shall be followed. (As of 2/10/2023 no winter overseeding has been completed as required by NMP)
• Permit Operating Conditions (6) This site is only permitted for the land application of domestic septage, grease trap pumpings, portable toilet waste and commercial / industrial septage. Commercial /industrial septage shall only be land applied after the waste from each source is tested and the results approved by the Solid Waste Section. (Continuing violation, applications of lime sludge material were made after the 12/5/2023 report was sent).
OBSERVED VIOLATIONS: An NOV has been issued for violations of the following rules and permit operating conditions observed during the 2/10/2023 inspection. Please see comments section on page 2 of this report.
1. Permit Operating Condition (6) This site is only permitted for the land application of domestic
septage, grease trap pumpings, portable toilet waste and commercial / industrial septage.
Commercial /industrial septage shall only be land applied after the waste from each source is
tested and the results approved by the Solid Waste Section. (Please see item 5 of Additional
Comments on page 2 of this report)
2. 15A NCAC 13B .0842(a)(17) approved nutrient management plans shall be followed; (Please see
item 6 of Additional Comments on page 2 of this report)
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) The access roads to the disposal area were posted with the required signage that was visible and legible. 2) The roads accessing the site were passable. 3) Most disposal area boundaries were marked on the ground visibly and distinguishably from the surrounding
landscape. Several Markers were missing or knocked down. 4) No discharges of septage were visible outside of the permitted boundaries. 5) No applications of septage were made during the site visit. Material applied to the permitted fields was in violation of the nutrient management plan (NMP). Material discharged on field 3 and field 4 did not appear to be domestic septage, Portable toilet waste, or grease trap pumpings. Off-white chalky residue having the appearance of
lime mud was observed on large parts of field 3 and 4. This site is only permitted for the land application of domestic septage, grease trap pumpings, portable toilet waste and commercial / industrial septage. Failure to operate as permitted may result in the Department suspending or revoking this permit, initiating action to enjoin the unpermitted operation, imposing administrative penalties, or invoking any other remedy as provided in Chapter 130A, Article 1, Part 2 of the North Carolina General Statutes. 6) The warm season crop described by the nutrient management plan was present and was dormant. The warm season crop on field 3 and 4 appeared to be damaged from heavy traffic on the field during wet conditions and from applications of lime sludge material. Actively growing crop coverage on all fields was below 80%. No evidence of winter overseeding was visible and did not appear to have been completed as prescribed by the NMP. Until the warm season crop stand (Hybrid Bermuda Grass) has been restored and is actively growing (not dormant) and reaches or exceeds 80% coverage on fields 3 and 4 as specified in the approved Nutrient Management Plan, no further applications of septage shall be made on these fields without Division approval. 7) No septage applications were made during the site visit.
8) No objectional odors where noticed. 9) Required setbacks appear to be met. 10) Land application records were received on 1/6/2023 for inspection. Required data was recorded. Please note: This permit shall become void if the soils fail to adequately assimilate the septage and shall be
rescinded unless the site is maintained and operated in a manner which will protect the assigned water quality standards of both surface and ground waters.
