OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0201 (a) - No person shall treat, process, store, or dispose of solid waste or arrange for the treatment, processing, storage, or disposal of solid waste except at a solid waste management facility permitted by the Division for such activity, except as provided in G.S. 130A-294(b).
2. 15A NCAC 13B .0201 (b) - No person shall cause, suffer, allow, or permit the treatment, storage, or processing of solid waste upon any real or personal property owned, operated, leased, or in any way controlled by that person without first having been issued a permit for a solid waste management facility from the Division authorizing such activity, except as provided in G.S. 130A-294(b).
3. 15A NCAC 13B .0201 (c) - No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a currently valid permit issued by the Division for the specified type of disposal activity. It is the responsibility of every owner and operator of a proposed solid waste management facility to apply for a permit for the facility. The term "owner" shall include record owners of the land where the facility is located or proposed to be located and holders of any leasehold interest, however denominated, in any part of the land or structures where the facility is located or proposed to be located.
Upon inspection, it was discovered that land clearing and yard waste was being buried and covered with soil onsite to decompose inside the Yard Waste Notification (YWN). This site is a Yard Waste Notification only, which is a Small Type 1 Compost Facility, and not approved for this activity. During the last inspection on
7/23/2021, the waste that was onsite had a lot of soil mixed with the waste. It was stated, in part, of the inspection report dated 7/23/2021, “Remember waste cannot be buried…”. All waste that’s buried needs to be uncovered, separated from soil, and waste put into a window in the YWN or disposed of according to rule at a landfill approved for that waste type.

4. 15A NCAC 13B .1406 (9) Sign Requirements: (a) Signs providing information on waste that may be received, dumping procedures, the hours during which the site is open for public use, and the permit number shall be posted at the site entrance. (b) Traffic signs and markers shall be provided to direct traffic to and from the discharge area. (c) Signs shall be posted stating that no hazardous waste, asbestos containing waste, or medical waste may be received at the site.
It was understood last inspection that the site was used by Mr. Pope alone and not open to public. Since that inspection, W. G. Landscaping has been allowed to dump here according to Mr. Pope and Mr. Holder but has since been cut off from dumping at this location. A sign needs to be installed according to rules and installed at the YWN for anyone dumping or bringing waste onsite to see.
ADDITIONAL COMMENTS
1. David Powell, with the Section, visited the Yard Waste Notification (YWN) for a comprehensive inspection. Charles Pope and son in law, new operator, Davidson Holder onsite for inspection. Discuss rules, onsite operation and future options of permitting LCID. Discussed corrective actions as well.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. 3. The YWN renewal listed the property owner information as Mr. Pope, but the county tax GIS records indicates Mr. Popes deceased sister, Mary Pope, is still owner. Be sure this information is accurate and correct. If Mr. Pope has inherited this property, then the tax records may just be delayed in showing the updated information. Renewal is due by June first of each year and should reflect current owner of the property.
4. The site had previously installed four Edge of Waste (EOW) markers. Please reinstall. Although not required, this will help the inspector see EOW and to know the limits of operations for the 2-acre notification. Be sure and keep all waste inside the 2-acre footprint.
5. Yard waste accepted will need to be windrowed, with windrows separated for fire control, and then mulched. A YWN is limited to two acres, 6,000 cubic yards total waste at any time. If Yard Trash is accepted, then it must be composted according to .1406 rules for small type one compost facilities.

6. All corrective actions should be completed within 60 days and be ready for inspection at that time. All buried waste removed to appropriate landfill for that waste type or put into windrows inside the notification, EOW markers should be in place, all waste inside two acres, 2023 renewal submitted electronically with appropriate landowner information noted.
7. Corrective measures are necessary as a result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff about 60 days’ receipt of this inspection report or shortly
after. Failure to meet the conditions for compliance may result in further Compliance Actions.
