The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell, with the Section, visited the NLCID for a comprehensive inspection. The items discussed during
inspection consisted of permitting the LCID, Mr. Powell agreed to send rules, closure letter from Ed Mussler (Section Chief) and contact information for Section Permitting via email. This NLCID is used just by Mr. Paul and is behind a locked gate. Site has access around working face and most of the Edge of Waste (EOW). 2. The working face was small with minimal unapproved wastes. Mr. Paul was removing unapproved waste as he dumps and had a couple piles of unapproved waste visible beside the working face. Good job.

has been purchased by Mr. Paul to expand mining/possible LCID activities if approved and permitted in future. 4. Section Permitting Engineer assigned to Scotland county is Ming Chao, (919) 707-8251 or
ming.chao@ncdenr.gov, whom is soon to retire. I would suggest getting an Engineer/Consultant Firm quickly. The Permitting Branch Supervisor is Sherri Stanley, (919) 707-8235 or sherri.stanley@ncdenr.gov, should also be copied. This Notified LCID will need to be closed according to rule or permitted by January 1, 2026.
