Bay View Road GPS COORDINATES: N: 36.16167° E: -75.84083° FACILITY CONTACT INFORMATION: Name: J Bryan Smith Address: PO Box 2560 Kitty Hawk NC 27949 Telephone: (252) 255-2030 Email address: info@atlanticsewagecontrol.com PARTICIPANTS: Jeffrey Bullard DWM, STATUS OF PERMIT: Active EXPIRES: 04/17/2022 PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: During a site inspection on 12/05/2022 septage was observed spilled onto the ground surface and vegetation within 5 feet of the tanks was grown up obstructing inspection of the tanks in violation of the following septage rules. 15A NCAC 13B .0838 (j) Septage shall be transferred to and from a detention system in a manner that prevents leaks or spills of septage onto the ground surface or exterior surface of the detention system, including septage in pipes used for transferring waste to and from vehicles. 15A NCAC 13B .0838 (i) The area around tanks shall be free of debris and vegetation to allow for access and inspection for a distance of 5 feet. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. An appropriate No Trespassing sign was displayed at the entrance to the site. 2. The tanks were accessible for inspection. The area around the tanks required to be free of debris and vegetation to allow for access and inspection for a distance of 5 feet was not being maintained. Tall vegetation was surrounding some tanks making inspection difficult. 3. The tanks appeared structurally sound. 4. All septage transferals were not being made in a safe and sanitary manner. At the northern end of the facility septage was spilled onto the ground surface where being transferred into the facility. A puddle of septage and residue from a previous spill was observed on the ground where trucks load and unload. (please see observed violation on page 1 of this report) Any spilled septage should be cleaned up and disposed of in accordance with NC septage rules. 5. No vectors or objectional odors were noticed. 6. Approved setbacks appear to be met 7. The access road was passable.
