The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS: 01 - The property owner is Anderson & Company parcel ID# 473981696100 and is recorded on Book 1134 Page 538 of the Edgecombe Co. Register of Deeds.
02 - The LCID Notification was recorded in Book 1231 Page 0957 of the Edgecombe Co. Register of Deeds. 03 - The sign at the entrance was posted as required. 04 - The access road is of all-weather construction. 05 - A gate secures the entrance of the facility. 06 - This facility is inactive at this time for any Land Clearing Waste. All Land Clearing Waste has been covered. 07 - Side slopes have a good vegetative cover. Some small concrete needs to be covered. 08 - John College (DWM) provided and reviewed with Mr. Anderson the copy of the Letter Sent to All Owners or Operators of Notified Land Clearing and Inert Debris Landfills sent on October 06, 2021. 09 - John College (DWM) also provided and reviewed with Mr. Anderson the Readopted Rules, Effective January 01, 2021 for LCID Landfills, 15A NCAC 13B - .0563, .0564, .0565, .0566, .0567 and GS 130A-294.
10 - Mr. Anderson stated that he would most likely close this notified LCID before the deadline stated in the requirements in the October 06, 2021, letter. 11 - Some tree removal and side slope work will need to be done to meet the closure requirements.
