The subject incident is located at 1040 (former 1041) E. Lexington Ave, High Point, Guilford County. Conoco Stores, Inc. owned and operated a UST system on the property and sold the system to Circle K Stores, Inc. in December 2003. In April and May 2004, ACT Associates, Inc. was contracted by Circle K Stores to conduct environmental assessment (EA) at the facility. ATC assessment report of June 4, 2004 indicated that soil and groundwater at the site were impacted by release from the UST system. According to the letter of May 27, 2004 form Andrew Stow of ConocoPhillips to Mr. Grove Nicholson, NC UST Section Chief, petroleum contamination discovered before June 14, 2004 (180 days after closing of the transaction) was the responsibility of ConocoPhillips. I have contacted Mr. Steve Booe of NC UST Permit and Inspection if they have found any fail tightness test and/or suspected release during their compliance inspections since June 2004. According to Mr. Booe, they have not found any fail tightness test or suspected release from the system since 2004. Based on the date of release conformation and compliance results since June 2004, ConocoPhillips is the responsible party for the petroleum contamination detected at the site. A review of ACT EA report indicates that no soil and groundwater samples were analyzed by risk-based methods including MADEP VEP and VPH. A soil and a groundwater samples need to be collected for risk-based analysis, and analytical results need to be submitted for our review. If no free product and no GCL violation, we can close this incident after completion of notice of residual petroleum and public notice for 2L violation.
