The Permit for Closure, issued April 8, 2015, allows for the collection of yard waste, scrap tires and white goods. The Permit for Closure states that the operations plan should be review every five years from the issuance of the Permit for Closure. PURPOSE OF SITE VISIT: Compliance inspection STATUS OF PAST NOTED VIOLATIONS: None. NOTICE OF VIOLATIONS: A. 15A NCAC 13B .1406 (4), "Leachate shall be contained on site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters." Vance County is in violation of 15A NCAC 13B .1406 (4) in that leachate was observed flowing from the leaf pile in the yard waste processing area, into a drainage feature that was converging with what appeared to be freshwater from another drainage area and flowing in the direction of an unnamed tributary of Crooked Run. Leachate was found to be flowing from the leaf pile and into a drainage feature to the north of the leaf pile. Ms. Thompson followed the leachate flow from the northern edge of the leaf pile, along the drainage feature to the north Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA °°°­°° 0E` !=�'Solid Waste Section of the leaf pile. Leachate was found to have been pooling in and flowing down the drainage feature eventually meeting a freshwater drainage feature. The leachate had mixed with the freshwater and continued to flow to the west in the direction of an unnamed stream. Ms. Thompson was unable to find the end of the leachate flow. Ms. Thompson has notified the Division of Water Resources about this leachate release. In addition, a large pool of leachate was identified to the east of the limb pile. At the time of this inspection, Ms. Thompson was unable to determine if the leachate had flowed to a nearby drainage feature due to the lush vegetation. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility is fenced and is secured by a locking gate when it is not open for operations. 2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 3. The facility accepts yard waste, white goods, electronics, and scrap tires Monday through Friday from 0800 to 1630 and Saturday from 0800 to 1200. MSWLF (Closed) 4. The site had been mowed. 5. Some thorny woody vegetation was observed near the riprap for the slope drains. The thorny woody vegetation should be removed from the landfill cap. During a follow-up telephone conversation, Mr. Falls stated that the thorny vegetation had been sprayed and would be removed from the riprap. 6. No areas of standing water or subsidence were observed during this inspection. Continue to monitor the closed MSWLF and repair areas as needed. 7. Edge of waste markers were observed around the Closed MSWLF. Yard Waste 8. Several areas of standing water were observed within the yard waste area. Ensure that the area is graded to promote drainage away from the yard waste storage area. 9. No unacceptable waste was observed within the yard waste area. Continue to monitor incoming loads and remove any unacceptable waste as needed. 10. The yard waste piles were accessible on all sides. White Goods and Scrap Tire Area 11. The large concrete pad for the white goods and scrap tires was in good condition and properly sloped to prevent ponding water. 12. The white goods were upright and neatly stored on the concrete pad. The refrigerants are removed by the contractor. 13. The electronics are palletized and wrapped prior to transportation to the recycler. 14. Scrap tires are stored at the opposite end of the concrete pad from the white goods. The scrap tires are picked up once or twice a week. 15. Digital photographs were taken during the inspection.
