The reports compiled by Northwest Geoscience, PC indicate that the areas where the contaminants have been detected were previously occupied by underground storage tanks (USTs). Five regulated USTs were owned and operated by Gilbert Hardwoods Inc. and were removed in 1982, 1983, and 1992. Subsequent to their removal, a release from the system was discovered. The resulting soil and groundwater contamination was assessed and the incident was closed on July 11, 2005. Trinity Road LLC (Trinity), a subsidiary of Directed Capital of St. Petersburg, Florida, acquired the property in 2013. Because USTs were never owned or operated by Trinity and the incident has met the requirements for closure in 2005 (prior to the acquisition of the property from Gilbert Hardwoods), Trinity would not be considered the responsible party for the contamination related to the former UST system. However, it should be noted that if during any redevelopment activities, contaminated soil in the vicinity of the USTs were encountered, Trinity would be responsible for the removal and disposal of the contaminated soil in accordance with applicable regulations.
