Dear Mr. Fraley and Mr. Gabriel:
Information provided by Mr. Barry Nelson, PG of Northwest Geoscience, PC concerning soil
and groundwater contamination at the above-referenced site has been reviewed. The reports
compiled by Northwest Geoscience, PC indicate that the areas where the contaminants have been detected were previously occupied by underground storage tanks (USTs). Five regulated USTs were
owned and operated by Gilbert Hardwoods Inc. and were removed in 1982, 1983, and 1992. Subsequent to their removal, releases was discovered. The resulting soil and groundwater contamination was assessed and the incident was closed on July 11, 2005.
Trinity Road LLC, a subsidiary of Directed Capital of St. Petersburg, Florida acquired the
property in 2013. Trinity has never owned or operated the UST system. Therefore, discovered
contamination from these USTs is considered to be related to prior activities by Gilbert Hardwoods. According to the North Carolina Department of the Secretary of State website
(http://www.secretary.state.nc.us/corporations/Corp.aspx?PitemId=4626113, Gilbert Hardwoods, Inc.
continues to be an active entity. The North Carolina Department of Environment and Natural Resources (NCDENR) would pursue Gilbert Hardwoods, Inc. for the cleanup of contamination from the USTs.
Should Gilbert Hardwoods, Inc. be dissolved or be recalcitrant, the incident may be eligible for the State
Trust Fund Program (“state lead site”) whereby NCDENR will be responsible for assessment and if deemed necessary, any remedial actions needed to protect human health and the environment.
It should be noted that the current and future owners of the property will be expected to provide access to the property in the vicinity of the former USTs, and if needed, to restrict activities within the
areas impacted by the contamination during assessment and any remedial actions deemed necessary.
