A. 15A NCAC 13B .0101 (28), “’Inert debris waste’ means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead-based paint.” UNRESOLVED: Silt fence, plastic, and painted brick and concrete were again identified within the inert debris disposal area on the northside of the facility. Mr. Everett stated that he has instructed his staff to reject and/or remove
commingled waste and unacceptable material from incoming waste loads and is working on removing these items currently found in the inert debris disposal area. Ensure that facility staff are knowledgeable on the permit, operations plan, and rules for this facility. B. 15A NCAC 13A .0566 (2), “Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.”

C. UNRESOLVED: The northside slope of the landfill containing inert debris continues to exceed a ratio of three horizontal to one vertical (3:1). The waste boundary in this area is still within the required 100-foot buffer from the adjacent property and inert debris waste was still present within the tree line. Mr. Everett stated that he was working on pulling the slope back to achieve the required 3:1 slope and 100-foot buffer but conceded this might not be possible with the limited amount of space available. Mr. Everett stated that he will investigate the option of purchasing the adjacent property and recombining the parcels to create additional buffer space. Any changes to the
landfill boundaries must be submitted to Permitting for approval.
ADDITIONAL COMMENTS Mr. Everett stated that he did not receive a copy of the previous October 22, 2022, Inspection Report, as it was sent to a non-working email account. Past observed violations listed above are in the process of being resolved.
1. Please provide the Section with an updated, detailed facility map depicting all waste processing, storage, and disposal areas as described in the Operations Manuel.
2. Permit Approval to Operate, Attachment 3, Part I (2), “Signs must be posted at the entrance to the facility that state that no hazardous waste or liquid waste can be received at the facility; and provide information on dumping procedures, the hours of operation, the permit number, contact name, telephone number, and other pertinent information [such as types of waste accepted]. Traffic signs or markers must be provided as necessary to promote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions.” Ensure posted entrance signs contain all required information as stated in the Permit. Traffic signs or markers must be utilized to ensure safety and efficiency. 3. Interior roadways were of all-weather construction and are maintained in fair condition. Significant rainfall combined with facility grading operations in the days prior to this inspection had rendered some portions of the road on top of the landfill impassable to vehicles. Ensure all interior roadways are maintained in good condition and in a manner conducive to vehicular traffic. 4. Permit to Operate, Attachment 3, Part I (5), “Copies of this permit, the approved plans, and all records required to be maintained by the permittee must be maintained at the facility and made available to the Section upon request during normal business hours.” Copies of the permit and operations plan are kept in Mr. Everett’s truck and were produced upon request. Copies of the permit and operations plans, as well as any random soil screenings, waste rejection records, and training records need to also be kept onsite. Ensure up to date copies of all pertinent documents are kept onsite and are accessible to all facility personnel. NCDEQ representative contact information needs to be updated. 5. Solid waste must be restricted to the smallest area feasible, compacted densely as practical into cells by proper construction management.
6. Excavation, grading, and fill material side slopes must not exceed three horizontal to one vertical (3:1). 7. All waste shall be covered with no less than 6 inches of soil monthly or when the active area reaches one acre in size, whichever occurs first by rule. The approved operations plan part 2.5.1 states that the exposed waste will be covered when it exceeds ½ acre in size. 8. Permit to Operate, Attachment 3, Part V (13), “Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material.” 9. Permit to Operate, Attachment 3, Part VII (21), “The permittee is allowed to accept and manage partially hardened concrete as described in the approved plan.” The approved operations plan for this facility states in part, “Trucks are permitted to back up to the designated disposal area, located outside the working face, dump
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

excess concrete, and rinse off the chute.” In the previous inspection it was noted that partially hardened concrete was not confined to a designated disposal area and was observed being dumped at random adjacent to and on top of facility roads, next to the inert debris stockpile, and left to cure in untended mounds. During this inspection, partially hardened concrete was observed to have been dumped along the sides of facility roads and left to cure in untended mounds. Mr. Everett stated that this concrete was supposed to be applied evenly to the facility roads but was dumped in the adjacent ditches by mistake. Ensure partially hardened concrete is dumped only in the
designated disposal area outlined in the approved operations plan and used solely for beneficial use on-site for erosion control, stabilization applications, or road base. Please provide an updated map showing the location as described in 2.7 and 2.8 of the approved operations plan. 10. 15A NCAC 13B .0564 (6)(b), “Buffer requirements: A site shall maintain the following buffer requirements: 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells.” During this inspection, it appeared that the northern waste boundary is
encroaching on the northern adjacent property and inert debris waste is falling into the tree line. The waste needs to be moved out of the trees and away from the property line so that the 100-foot buffer line has been met. Cease dumping and pushing waste into the buffers. Ensure that necessary buffers are met, and edge of waste (EOW) and property line markers are in place. 11. 15A NCAC 13B .0567 (c) (1) (B), “Post Closure Care Requirements…maintenance of the vegetative cover of the cap and ensuring trees and other woody vegetation do not become established on the cap.” Trees and
woody vegetation were again observed growing on the northern and eastern side slopes and vegetative cover needs to be mowed. Mr. Everett stated that he would get this done himself. Ensure any trees are removed from the side slopes and cap and that vegetation is rough cut/mowed to prevent woody growth. Landfill vegetative cover should be mowed at least twice a year or as often as necessary to prevent overgrowth and allow for proper inspections of the facility. 12. 15A NCAC 13B .0564 (7), “The site shall establish and maintain an access road around the waste boundary for access by emergency or fire fighting vehicles or equipment.” A partial access road was identified around the waste boundary but remained incomplete at the time of this inspection.
13. Stumps to be sheared for the purpose of grinding are being stockpiled on top of the landfill cap, which is not in an area designated for grinding/chipping. A designated wood grinding and processing area is not depicted on any operations plan map. Please provide the Section with a map depicting all areas associated with the wood processing described in Section 2.10.2 of the Operations Manuel. Stockpiling stumps on top of the landfill can potentially cause water to impound over waste and possibly damage the integrity of the landfill cap. This activity should be approved by Permitting. 14. Dust was an issue during the previous inspection but was not present during this inspection, possibly due to significant rainfall in the previous days. A water truck was identified onsite. 15. Corrective measures are necessary as a result of this inspection. A corrective action plan should be submitted to Section Staff within 15 days of receipt of this report, detailing your actions to bring this site into compliance. Staff will review the plan and establish a reasonable schedule to accomplish agreed upon actions. 16. Digital photographs were taken during this inspection.
