The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff David Powell inspected the Town of Carthage Yard Waste Notification (YWN) for routine inspection. The last renewal received was in 2021. A renewal should be submitted every year before June 1st, if the site wishes to continue operating. Mr. Smith sent confirmation that he submitted his renewal on 4/5/2023, good job and thank you.
2. Reminder: A Yard Waste Notification is a Small Type 1 facility. Renewal shall be submitted by June 1st of each year. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste
Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Otherwise, waste must go to disposal site for that waste type. Be sure and continue to record temperatures and log them for future inspections. 15A NCAC 13B .1406 rule explains the requirement of having the compost
reach 131 degrees F for at least 3 consecutive days before it can go out to public. These rules and the link to renewal form were sent on 4/5/2023, after Mr. Powell spoke with Mr. Smith requesting Town fill out renewal and submit the composting time and temperature records.

3. The gate was locked upon arrival, and no one was onsite during inspection. Signage was present, although the site isn’t open to the public. Good job. Very minimal waste at notification.

4. YW onsite was windrowed and had good shape and separation. Good job.
5. The previous Edge of Waste (EOW) markers were in place, although very hard to see. It was suggested previously to use large white PVC for visibility. Current small wooden stakes will easily be overtaken by surrounding vegetation. These should be visible for the inspector to see as well as any future operators or staff working at the YWN.

6. Older waste, over to side of open area of notification, should be utilized or removed to proper disposal site. Remember, waste should come in, be composted, but be utilized within the year of its arrival to the notification. If waste sits and decomposes then it becomes disposal, and site isn’t approved for yard waste disposal.
