STATUS OF PERMIT:
Notified site, no permit required. Reminder: Renewal Notification Forms must be submitted by June 1st. every year. PURPOSE OF SITE VISIT: Facility Compliance Inspection & Technical Assistance STATUS OF PAST NOTED VIOLATIONS: None
OBSERVED VIOLATIONS:
Deficiency noted.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS: 01 – Self reported non-compliance by The Town of Murfreesboro Public Works Department. Ask for technical assistance help to get facility back into compliance.
02 – Facility was found to be out of compliance after staff turnover. A new Public Works Supervisor was hired and the Yard Waste Site was not being managed correctly. 03 – No windrows or fire lanes were present. Site had Yard Waste was scattered all over this notified site. 04 – The waste however is inside of the Edge of Waste Markers. 05 – The past staff was educated on operations of this Yard Waste Site by John College on February 09, 2021. This meeting is documented on an inspection form and is in the State Database (Laserfiche). 06 – John College during this inspection, presented and discussed options to come into compliance (mulching/grinding for removal and pushing up into windrows) with the Public Works staff and the Town Administrator. 07 – John College has requested a Plan of Action (POA) be submitted to him outlining the process and timeframe to come back into compliance with the rules of these type facilities. Rules were also presented during this meeting. 08 – If the POA isn’t submitted by April 14, 2023, a Notice of Deficiency or Violation will be issued. 09 – Several grinding contractor’s information was also discussed during this meeting. 10 – The staff has been in contact with staff from the Bertie County Regional Landfill for the possible outlet for the mulch to be used as alternative daily cover at the landfill. 11 – The site has a locking gate and signage at the entrance. 12 – If no staff is onsite, keep the gate locked to prevent the public from coming in and dropping off waste. The gate is there for site security. The gate was not locked or staff onsite when we arrived at the site. Please contact me if you have any questions or concerns regarding this inspection report.
