Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1) DWM received a call from a property owner neighboring the Klebs Porta John facility. The caller was concerned septage was being mismanaged on the property and that septage was being stored at the facility in an unpermitted tank or tanks. 2) An inspection of the facility was conducted. No unpermitted storage of septage or storage tanks were observed. No evidence of septage leaks or spills were observed. No odors or vectors were observed. 3) A representative of Klebs Porta John was present and was advised of the following rules: • 15A NCAC 13B .0835 (f) Vehicles used in the transportation of septage, that are listed on an approved septage management firm permit application, may remain loaded or partially loaded on land owned by the septage management firm for up to seven days without obtaining a permit for a detention or treatment facility. • 15A NCAC 13B .0837 (a) No person shall establish or allow to be established upon any real property owned, operated, leased, or controlled by that person, a septage detention and treatment facility, unless a permit has been obtained from the Division… Please contact me if you have any questions or concerns regarding this inspection report. ____________________________________________ Phone: (919) 707-8283 .
