OBSERVED VIOLATIONS:
1. At the time of the inspection leachate was observed concentrating down slope of operations area,
evidence of leachate exiting the operation area was visible downslope from this point in the buffer
area in depressional areas. Failure to properly manage leachate runoff in this regard is a violation of
the following rules and Solid Waste Compost Demonstration Approval Condition below.
15A NCAC 13B .1406 (2) Erosion control measures shall be practiced to prevent on-site erosion and to
control the movement of silt or contaminants from the site.
(4) Leachate shall be contained on site or treated prior to discharge. A National Pollutant Discharge
Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to
the discharge of leachate to surface waters.
Solid Waste Compost Demonstration Approval Condition
(4) The site shall be prepared to control run-off and run-on. Best management practices shall be
utilized for this purpose. All run-off from the site and any leachate generated shall be managed to
prevent any impact to ground or surface waters.

2. Signage posted onsite did not contain required information such as prohibited materials, dumping
procedures and operating hours in violation of the following rule.
15A NCAC 13B .1406 (9) Sign Requirements.
(a) Signs providing information on waste that may be received, dumping procedures, the
hours during which the site is open for public use, and the permit number shall be posted
at the site entrance.
(b) Traffic signs and markers shall be provided to direct traffic to and from the discharge
area.
(c) Signs shall be posted stating that no hazardous waste, asbestos containing waste, or
medical waste may be received at the site.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS

1. The facility is currently operating as a Solid Waste Compost Demonstration Approval.
2. Required records of compost windrow temperatures were being kept and made available for
inspection.
3. No objectionable odor was detected beyond the facility boundary during the inspection.
4. The access road to the facility was of all-weather construction and well maintained.
5. Signage posted at the entrance to the site did not display required information such as prohibited
materials. Please see the Observed Violation section of this report. Signage needs to be updated to
meet the rule requirements of 15A NCAC 13B .1406 (9).
6. Approved setbacks to property lines appear to be maintained.
7. Established windrows appeared to be sufficiently spaced to allow access for firefighting equipment.
Windrow height was approximately 10 to 15 feet.
8. Evidence of stormwater and/or leachate leaving the approved operational area was observed. Please
see the Observed Violation section of this report. Compost leachate and particulates, oily residue and
soil staining were observed at the edge of and in the wooded buffer area downslope from the
operational area. At the time of the inspection liquid material was not actively leaving the
operational area. Action must be taken to clean up any solid and liquid compost related
material that has migrated beyond the boundary of the compost operational area. Steps must
also be taken to contain and prevent the flow of leachate and contaminated stormwater from
leaving the operational area and polluting and/or impacting to ground or surface waters.
