None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On April 04, 2023, Chuck Kirchner met with Robert Fryar to conduct a comprehensive inspection of the Fryar Grading and Hauling, Inc. LCID Landfill on McLeansville Road in McLeansville, Guilford County.
1. The facility is a land clearing and inert debris (LCID) landfill owned and operated by Robert Fryar.
2. The facility permit, site plan, and operations plan were discussed. 3. The facility is open to the public.
4. The facility is in operation Monday through Friday 7:30 am to 5:00 pm [8:00 am to 4:30 pm November through February].
5. The facility is permitted to receive waste generated within Alamance and Guilford Counties.
6. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt.
7. No unpermitted materials were observed in the working face during this inspection.
8. During the inspection, the working face appeared to be properly maintained.
9. Two small areas of exposed LCD were observed on the northwest corner of the landfill. Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of
soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material per 15A NCAC 13B .0566(4).
10. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and
compacted as densely as practical into cells.”
11. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.”
12. Adequate soils for cover observed on site.
13. Excavation, grading, and fill material side slopes shall not exceed three to one (3:1).
14. A ready supply of soil is available for cover material.
15. Silt fence posts are used as permanent edge of waste markers.
16. Stockpiles of ground and unground asphalt and concrete observed on site. No painted concrete was
observed in the concrete stockpile.
17. Concrete grinding operations were observed on site during this inspection.

18. The facility annual report (FAR) was received by the SWS, dated July 23, 2022. Estimated facility
throughput for July 2021 through June 2022 is 35,520 yd3.

19. There was no indication of erosion or runoff.
20. Continue to stabilize bare areas with vigorous grass cover.
21. No open burning of solid waste is permitted on site.
22. The owner or operator shall provide verbal notification to the Division of fires that occur at the site
within 24 hours of the fire and shall submit written ‘Fire Notification Form’ to the Division within 15
days of the fire. 23. Access roads are of all-weather construction. 24. The facility is secured by a locked gate.
25. The facility has a proper sign.
26. The PTO expired on April 19, 2021.
27. Mr. Rankin stated that he is awaiting a new Special Use Permit from Guilford County and that has held up the permit renewal process.
28. A permit renewal application was received on November 16, 2020. Additional information was
requested per the current regulations. Continue to provide complete and timely responses to the Permitting Branch staff request for information as it pertains to the permit renewal. Please contact me if you have any questions or concerns regarding this inspection report.
