Dear Mr. El-Khoury:

In response to our telephone conversation on September 12, 2012, I would like to confirm with
you that the purpose of the environmental work to be conducted at the above referenced
location is to resume investigation activities at the site that will bring the site into regulatory
compliance as soon as possible. ENVIRON has been retained by a former site owner, Gant Oil
Company to address prior releases of petroleum products when the site was under operation by
Gant Oil.

You should understand that a previous environmental firm, AET was not hired by Gant Oil
Company and but rather another former site owner, “Exprezit!”. ENVIRON is representing Gant
Oil Company, as described above, and Bruce Tease, PhD, PG will serve as Project Manager
under the supervision of Russell Kemp, PE. ENVIRON is under contract to Gant Oil and has
been tasked by Gant Oil with the following actions to be completed as soon as possible:

1. Inventory site monitoring wells and assess their operable conditions.

2. Gauge groundwater elevations and the thickness of any free phase petroleum in wells,
as free product has been found in at least two one monitoring well.

3. Confirm the status of private drinking water wells within 1,500 feet of the site.

4. Preparation of a status report for submittal to Thomas Moore of the NC Department of
the Environment and Natural Resources (NCDENR).

It is imperative that Task 2 be initiated immediately to remove this source of potential
soil/groundwater contamination. If free phase petroleum is found, ENVIRON will immediately
begin removing said petroleum by hand bailing and transferring to 55 gallon steel drum(s) to be
located on site within the protection of over pack drum(s) for secondary containment. Based on
the degree of product in the monitoring wells, a schedule of gauging and bailing and/or a more
automated system of product-only recovery shall be established as needed.

Based on the above and additional work to be conducted in the future, ENVIRON will develop
the necessary plan to bring the site into environmental compliance concerning the historic

releases. As site owner, you shall be kept appraised of the work progress and be provided
copies of reports submitted to the NCDENR. In order to accomplish this common goal to all
parties, we will need you, as current owner, to provide ENVIRON access to the site, in
particular to initiate Item No. 2 above as soon as possible for obvious reasons, most
importantly to remove this continuous source of soil and groundwater contamination and
prevent its spread, which will make its removal more difficult as time goes on.

We recognize that you as the current site owner have a responsibility to allow ENVIRON access
to the site to conduct this pressing need to remove any free product which may exist, as we
have been contracted by Gant Oil to do so. Please be reminded that the failure to grant site
access to allow the environmental investigation/remedial activities to continue may be reported
to the NCDENR. You may want to consider retaining counsel to protect your interests or
answer any questions, but we would like to make it clear that it is not our intention to assign
responsibility to you for the releases that triggered state regulatory actions; we merely want you
to understand the seriousness of the free product currently residing on the groundwater table
and the importance of removing this product as soon as possible.

We hope this addresses your questions concerning the work proposed at the site. Please let us
