B. Background and Initial Response Activities
The subject site is a former petroleum bulk storage facility located at 201 Arendell Street, Morehead City,
in Carteret County, North Carolina. The approximate location of the site is graphically presented on Figure
1 and Figure 2 (included in Appendix A), and is situated at approximate coordinates 34.719765 N and –
76.704401 W. An aerial photo of the site is included as Figure 3.
Highlands Environmental Solutions, Inc. (HES) was contracted by Atlantic Coast Marine Group (ACMG), to
provide oversight of the excavation of soils in an area that formerly operated as a bulk petroleum storage
facility. The facility was previously owned and operated by J.M. Davis Properties, Inc (J. M. Davis). Bogue
Holdings, LLC (Bogue) purchased the property from J.M. Davis on February 1, 2021. J.M. Davis removed
the aboveground structures to include the loading/unloading rack, the aboveground storage tanks (ASTs),
and the secondary containment for the ASTs as a condition of the purchase.
Bogue Holdings, LLC intends to re-develop the subject property for use as a dry-dock boat storage facility.
Residual petroleum-impacted soil was suspected to be present near the former bulk fuel storage area. In
advance of the excavation of soil in the area of the former bulk storage facility, ACMG personnel utilized a
trackhoe and dozer to remove a layer of rock and clean fill that had been emplaced after the removal of the
aboveground structures. HES personnel collected two composite samples of the clean backfill stockpiled
at the site, and submitted the samples to RedLab, LLC (RedLab) for laboratory analysis of gasoline and
diesel range organics (GRO and DRO, respectively)..
The closest surface water body is the Bogue Sound located approximately 200 feet South and
downgradient of the release area on the property. This surface water body was neither impacted nor
threatened by this release. Stormwater is uncontrolled at the site and flows according to topography.
The land uses of the properties to the North are Arendell Street beyond which is Harlow Creek, to the East
is the North Carolina Port, to the South is Bogue Sound, and to the West is a commercial property with a
residential property located further to the West of the incident site.
After excavation activities were completed and a release of petroleum was identified, HES submitted a
UST-62, 24-Hour Notification of Discharge form to the North Carolina Department of environmental Quality
(NCDEQ). A copy of this form is included in Appendix B. Prior to any on-site remediation activities, ACMG
was responsible for notifying the NC One-Call Center (811) to mark the area for buried utilities. A site-
specific health and safety plan (HASP) was developed by HES for site activities. A copy of the HASP is
included in Appendix C.
C. Free Product Investigation and Recovery
As noted in Section B, the subject site previously operated as a bulk petroleum storage facility. Staining
and other evidence of suspected petroleum releases from the former bulk fuel storage facility was present.
No free product was observed during site excavation activities.
D. Groundwater and Surface Water Investigation
As noted in Section B, petroleum-impacted soil was discovered at the site near the former bulk fuel storage
area. The closest surface water body is the Bogue Sound located approximately 200 feet South and
downgradient of the release area on the property. This surface water body was neither impacted nor
threatened by this release. As such, a surface water investigation was not performed.
Groundwater was not encountered during the excavation activities. As such, a groundwater investigation
was not performed.

E. Initial Response and Abatement Activities
Initial response and abatement actions are summarized in Section B, above.
F. Excavation of Petroleum Impacted Soil
HES and ACMG personnel and equipment mobilized to the site on December 20, 2022, to conduct soil
excavation activities. HES personnel utilized a RedLab’s mobile laboratory to analyze soil samples
collected during excavation activities. RedLab utilized their NCDEQ approved QED UVF technology to
analyze soil samples collected during excavation activities. Two areas were excavated at the site.
Area #1
Area #1 was the former loading/unloading rack and underground piping. Personnel from ACMG utilized an
excavator to excavate the soil in the area of the former loading/unloading rack. Prior to the initial excavation,
HES personnel collected two soil samples based on the former footprint of the loading rack (LR) area to
delineate the extent of possible contamination to the West of the loading rack. Both samples (LR #1 and
LR #2) were analyzed, and analysis did not result in the detection of GRO or DRO at concentrations greater
than their respective reporting limits. As excavation proceeded, the soils were examined for evidence of
petroleum impacts (i.e. staining or odor). During soil excavation, HES personnel collected a series of soil
samples from the bottom (B) and sidewalls (SW) of the excavation, and submitted the samples to Red Lab
personnel for analysis for GRO and DRO in their mobile laboratory staged at the site. GRO and DRO data
were utilized to delineate the extents of soil excavation. Areas where sample analysis resulted in the
detection of GRO or DRO at concentrations greater than their respective Action Limits were over-excavated
and re-sampled.
The final area of excavation of the loading rack area measured approximately 18 feet wide by 25 feet long,
with most of the excavated area being approximately three feet in depth. The area associated with LR
#10B and LR #11B were excavated to approximately four feet in depth. Over excavation of the North
sidewall associated with NSW #2 and NSW #3 and ESW #1 was also completed until sample results were
below the State Action Limits. The locations of the sample collection points are depicted on Figure 4. A
total of 26 confirmation samples were selected from the excavation associated with the loading rack area
and submitted to Red Lab for onsite analysis.
The excavation proceeded from the loading rack area along an area identified by the ACMG site contact
as having been where the underground piping was situated, and formerly extended from the loading rack
to the AST containment area. Two piping runs (PR) were identified, and the areas measured approximately
four feet wide by 10 feet long by 15 inches deep. Soil samples were collected from these areas, and
analyzed on-site to determine the extent of soil excavation activities. Excavation continued until analytical
data for the samples were below the State Action Limit. The locations of the sample collection points are
depicted on Figure 4. A total of seven confirmation samples were analyzed from the excavation associated
with the loading rack piping run area and submitted to Red Lab for onsite analysis.
Area #2
Area #2 was the former AST containment area. Personnel from ACMG utilized an excavator to excavate
the soil in this area. Soil samples were collected from this area to determine the extent of soil excavation
activities. In areas where analytical data for samples indicated the presence of GRO and/or DRO at
concentrations greater than their respective Action Limits, over excavation was performed until the sample
results were below the State Action Limits.
The final area of excavation of the AST area measured approximately 45 feet wide by 40 feet long with
most of the excavated area being approximately 2.5 feet deep. The area near samples AST #3 B, AST #4
B, AST #5 B and AST #9 B was excavated to a depth approximately three to 3.5 feet below grade The
locations of the sample collection points are depicted on Figure 5. A total of 43 confirmation samples were
selected from the excavation associated with the AST area and submitted to RedLab for onsite analysis.
A summary of the soil analytical data is presented in Table 1, included as Appendix D. The complete
laboratory analytical data report and chain-of-custody record for all samples are included in Appendix E.

During soil remediation activities, 107.53 tons of petroleum-impacted soil were excavated and transported
to the Triangle Area Earth Corporation in Zebulon, North Carolina for proper disposal. A copy of the waste
manifest documentation for the disposal of petroleum-impacted soil is included in Appendix F. The
excavated area was backfilled with clean base material, then compacted with the excavation equipment
and covered with gravel to prevent erosion and allow for equipment to be staged in the area. Select
photographs of the site are included in Appendix G.
G. Conclusions and Recommendations
The subject site is a former petroleum bulk storage facility located at 201 Arendell Street, Morehead City,
in Carteret County, North Carolina. HES was contracted by ACMG, to provide oversight of the excavation
of soils in an area that used to operate as a bulk petroleum storage facility. The facility was previously
owned and operated by J.M. Davis Properties, Inc. Bogue Holdings, LLC purchased the property from J.M.
Davis on February 1, 2021. J.M. Davis removed the aboveground structures to include the
loading/unloading rack, the ASTs, and the secondary containment for the ASTs as a condition of the
purchase.
HES and ACMG personnel and equipment mobilized to the site on December 20, 2022, and HES personnel
utilized RedLab’s mobile laboratory to analyze soil samples collected during excavation activities. During
excavation activities, a series of soil samples were collected in the areas of the former loading/unloading
rack, the AST containment area and the underground piping that formerly connected the ASTs to the
loading/unloading rack. During excavation, the soil samples in several areas were analyzed and yielded
concentrations for either GRO and/or DRO above their respective North Carolina State Action Limit using
RedLab’s approved NCDEQ QED UVF technology. Over excavation of soils in these areas resulted in
samples results below the State Action Limits.
During soil remediation activities, 107.53 tons of petroleum-impacted soil were excavated and transported
to the Triangle Area Earth Corporation in Zebulon, North Carolina for proper disposal.
A total of 76 confirmation samples were selected from the excavation and submitted to RedLab for onsite
analysis. While laboratory analysis of post-excavation confirmation soil samples resulted in the detection
of GRO and DRO above the State Action Limits, those areas were over-excavated until all confirmation
samples were below the State Action Limits for GRO and DRO.
The closest surface water body is the Bogue Sound located approximately 200 feet South and
downgradient of the release area on the property. This surface water body was neither impacted nor
threatened by this release. Groundwater was not encountered during soil excavation activities.
Based on the results of environmental assessment activities, HES concludes that soil excavation activities
successfully remediated the area impacted by this petroleum release. As such, HES does not recommend
additional environmental assessment or remediation activities at the subject site with regards to this
incident. HES recommends that correspondence documenting “No Further Action Required” be forwarded
to Bogue Holdings, LLC and JM Davis Industries, Inc. regarding this incident.

FIRST AID FOR PETROLEUM HYDROCARBON EMERGENCIES
Ingestion: DO NOT INDUCE VOMITING. Call Poison Control; follow instructions. Administer
cardiopulmonary resuscitation (CPR), if necessary. Seek medical attention.
Inhalation: Remove person from contaminated environment. DO NOT ENTER A CONFINED
SPACE TO RESCUE SOMEONE WHO HAS BEEN OVERCOME UNLESS
PROPERLY EQUIPPED AND A STANDBY PERSON IS PRESENT. Administer

Skin Contact: Brush off dry material, remove wet or contaminated clothing. Flush skin thoroughly

Project and Health and Safety Information
HES will be performing an environmental assessment and remediation at the subject site.
All work will comply with the Occupational Safety and Health Act (OSHA) standard, "Hazardous Waste
Operations and Emergency Response," (29 CFR 1910.120), and other federal, state and local procedures
that require the development and implementation of a HASP. Generation of this document certifies that the
workplace has been evaluated for the hazards as described. A hazard assessment has been performed and
the adequacy of the personal protective equipment (PPE) selected is hereby certified per
29 CFR 1910.132(d) and is duly noted by the signature(s) and date appearing on the cover page of this
document. If any site conditions are encountered that are different from typical retail petroleum operations,
the field investigator is to stop work immediately and notify the Project Manager.
This plan addresses the safety issues associated environmental investigation and assessment activities
performed at retail petroleum operations. For this project, site investigation activities will involve the
following (checked items):
